APPLICANT: St. Andrews Presbyterian Church RECOMMENDATION Staff recommends that the St. Andrews application be referred back to the Planning Commission for further consideration. DISCUSSION On December 9, 2004, the Planning Commission acted to recommend approval of the St. Andrews project to the City Council. The recommendation includes several conditions related to parking, one of which requires that the Church obtain a 30 -year parking agreement from the Newport Mesa Unified School District (NMUSD) for the use of the 15th Street parking lot at Newport Harbor High School. The Commission's recommendation also would require an increased supply of parking spaces within the school parking lot by approximately 70 spaces. Lastly, the Commission recommended that the parking agreement be reviewed by the Planning Commission prior to consideration of the project by the City Council. On December 14, 2004, the City Council reviewed the Commission's suggestion to hold off Council hearings until the parking agreement was reviewed by the Planning Commission and the Council acted to follow the Commission's recommendation. The applicant has been working with District staff and the School Board to secure the parking agreement and on April 12, 2005, the Board of Education tabled further consideration of the matter until after the City Council takes final action on the application (Exhibit No. 1). Given the Planning Commission's recommendation and the Council's concurrence with the timing of further hearings on the project, the applicant cannot proceed consistent with the Commission's recommendations. St. Andrews Presbyterian Church (PA2002 -265) April 26, 2005 Page 2 The applicant submitted a letter on April 15, 2005 (Exhibit No. 2) requesting that public hearings be scheduled. Additionally, the Church would like the City to consider a change to the recommended conditions of approval such that they could satisfy parking requirements with on -site or off -site parking and therefore not be limited to a parking agreement with the NMUSD as a means of providing required parking. Public Notice: Notice of this hearing was published in the Daily Pilot, mailed to property owners within 300 feet of the property (excluding roads) and posted at the site a minimum of 10 days in advance of this hearing consistent with the Municipal Code. Additionally, the item appeared upon the agenda for this meeting, which was posted at City Hall and on the city website. Altematives: Schedule a public hearing before the City Council. As is no doubt apparent from the local media by now, at its meeting of April 12, the Board of Education voted 6.1 to table the question of any long-term lease of the I e street parking lot at Newport Harbor High School to any third party, including St. Andrews. The Board raid so upon the recommendation of Superintendent Dr. Robert Barbot. Additionally, the motion to table the question included five points that the Superintendent had set forth for the Board. The five points were: 1. Contention In the community over this Issue does not seem to be focused on whether a long -term parking lease is a good thing or a bad thing, but on whether or not the church should expand. 2. The question of church's expansion is not a matter within the authority or purview of the Board of Education. Resolution of that question belongs to city government. 3. It may be appropriate for the Board of Education to consider the premise of a long -term lease which generates funds for additional parking and other improvements at NHHS once the issue of the church's expansion is resolved. 5. However, until such a time that the issue is not also a focal point of extraneous contention within the community, the question of a long -term lease of parking at NHHS should not be addressed further by the Board of Education. The conditions recommended by the Superintendent and included in the motion a3 Iterated above speak for themselves. If I might interpret, the Board has indicated that it has no intention of further considering a long -term lease of the 15th Street parking lot to any third party, including St. Andrews, until the question of St. Andrews conditional use permit has been resolved by the Newport Beach City Council. Furthermore, as a procedure[ matter, once an issue is tabled it requires a two -third vote of the Board to bring the question forward for a vote. In other words, once some resolution is determined by the City Council, the Board may further consider the matter if a minimum of five board members consider it an appropriate question to be before the Board of Education at that time, Points four and five of the conditions included in the motion would leave that option open. In the meantime, the District is pleased to continue its historic "good neighbor" relEstionship with St. Andrews as I described in my letter to you of June 16, 2003. Dear Ms. Temple: I am writing on behalf of the Building the Future Committee for St. Andrew's Presbyterian Church to respectfully request that the City recommence public hearings on the St. Andrew's Youth Project and consider a modification to the proposed parking regulations embodied in Planning Commission Resolutions 1655 as adopted December 09, 2004. As you will recall, the Planning Commission desired that St. Andrew's seek and obtain an offshe parking agreement from the Newport -Mesa Unified School District for improved parking facilities at Newport Harbor High School. St. Andrew's diligently pursued such an agreement beginning with the filing of an initial proposal with the N- MUSD on July 12, 2004. On April 12, the N -MUSD Board of Education, on the recommendation of Superintendent Robert Barbot, tabled any consideration of such a parking facilities improvement agreement until final action by the Newport Beach City Council on our pending land use applications. St. Andrew's would like the City to consider a change /modification to the conditions of approval relating to on and off site parking including,but not limited to, operational condition No.3 set forth on Exhibit C to Resolution No-1655. St. Andrews would like the option to satisfy parking requirements with on site OR offshe spaces and therefore not be required (but St. Andrews would like to retain the option) to obtain an offshe parking agreement as a condition to its project. The proposed project consists of the replacement of the existing fellowship hall and the construction of a new multi - purpose gymnasium, youth center, educational building and a below grade parking structure on the existing St. Andrews Church campus. The General Plan Amendment would increase the maximum allowable floor area that could be built on the site by no more than 22,000 sq. ft. with no change to the existing land use designation of Governmental, Educational & Institutional Facilities. My husband, Don, and I have been members of St. Andrew's for forty -five years. We raised our three children in the church. In 1994, I chaired the Student Ministries Committee as an elder on the Session Board. At that time, I helped our then youth pastor, Reverend Kirk McCormick, present a Student Ministries Strategic Plan to the Session of St. Andrew's which was then approved. This three - part plan included interns to work with the youth and a bus to meet the transportation needs of the youth department. These needs were met several years ago. The third part of this Strategic Plan was a facility for the junior high and high school students to meet together for games, music, computer work and any other activities that would meet their needs in a safe haven. In 1994, according to School Administration sources, there was an increase in crime and drug/alcohol use with gang issues creeping into the schools. They stated then that during the prior five year period no new groups or organizations had been organized within a ten -mile radius of the Church, excluding sporting clubs and St. Andrew's Youth Department, who were offering these students alternatives to the negative and destructive behavior. Both school administrations were resoundingly of that opinion. I personally don't see how this situation has improved and probably has worsened in these past eleven years. Although I am no longer involved with the Youth Ministries, I remain active in the life of St. Andrew's as the Coordinator of the Grief Support Ministry. I strongly feel that the time has come for us as a community to help these students at Ensign and Newport Harbor by providing this safe haven at St. Andrew's. To make this a successful facility, I ask that you not reduce this plan beyond its ability to function for these students' needs.
