HomeMy WebLinkAbout17 - Harbor View Hills South Reforestation• CITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 1 May 24, 2005 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: General Services Department Michael Pisani, Acting General Services Director, 949 - 644 -3055, mpisani @city.newport- beach.ca.us SUBJECT: Reforestation Request Harbor View Hills South Homeowners Association ISSUE: Should the City Council uphold or reverse the May 3, 2005 decision of the Parks, Beaches and Recreation Commission denying the reforestation request of the Harbor • View Hills South Homeowners Association? RECOMMENDATION: Review the decision of the Commission and approve the reforestation request. DISCUSSION: Background: Earlier this year the Harbor View Hills South Homeowners Association requested the reforestation of 19 City parkway trees in their community. The applicant requested the tree removals under the reforestation guidelines delineated in the G -1 Policy. This is the fourth phase of reforestation in Harbor View Hills South; the first phase was completed in 1997, the second reforestation occurred in 1998, and the third phase was completed in 2004. In its submission, the applicant met all requirements of the G -1 Policy. Staff brought the reforestation request forward at the May 3, 2005 Parks, Beaches and Recreation Commission meeting. A copy of the complete agenda report is included as Attachment A. • As required in the Policy, staff completed and attached the Tree Inspection Reports, Tree Appraisals, an area map and photographs related to each reforestation site and had HVHS Reforestation Request May 24, 2005 Page 2 determined and advised the Commission that the Association had met all requirements of the G -1 Policy. The Commission voted in a deadlock (3 -yes/ 3 -nay), and the motion to approve the reforestation failed. [See attached Parks, Beaches and Recreation Commission Minutes from the May 3 meeting (Attachment B).] At the May 10 Council meeting, Councilmember Nichols, as allowed in Council Policy G -1, called up the item for review before the City Council. Yvonne Houssels, President of the Association was present at the May 3, 2005 meeting to answer any questions or concerns that the Commission expressed. Additionally, she has received a copy of this report and a notice of the City Council meeting. Likewise, the Parks, Beaches, and Recreation Commissioners have been notified. Discussion The Harbor View Hills South Homeowners Association has submitted the attached Tree • Reforestation Request form, requesting the reforestation of 19 City parkway trees in their community (Attachment A). Staff has completed and attached the Tree Inspection Reports, Tree Appraisals, an area map and photographs related to each reforestation site (Attachments B, C & D). The applicant requested the tree removals under the reforestation guidelines delineated in the G -1 Policy. This is the fourth phase of reforestation in Harbor View Hills South; the first phase was completed in 1997, the second reforestation occurred in 1998, and the third phase was completed in 2004. As outlined in the attached letters dated January 22 and April 16, 2005, the applicant has met all requirements of the G -1 Policy (Attachment E). The Association will fund the total cost of $6,292 for the removal and replacement of the trees. The applicant has been prepared to undertake reforestation for several months, but it has been delayed at the request of staff due to other pending issues under consideration by the Commission. Those issues have been resolved, and staff feels it is appropriate for the Commission to consider this request at the present-�. r Yvonne Houssels, President of the Association has advised residents of the proposed reforestation request in the Association newsletters distributed in November 2004 and March is 2005 ( Attachment F). Residential communities, neighborhoods, or business organizations who apply for reforestation must submit a petition signed by a minimum of 60% of the property owners within the area defined. Areas represented by a legally established community association, may submit a resolution of the Board of Directors formally requesting a reforestation. =Individual property owners must submit a petition signed by a minimum of 60% of a maximum of 30 private property owners (up to 15 contiguous private properties on both sides of the street • up to 500' in either direction from the location of the proposed reforestation site) as well as the endorsement of the appropriate homeowners' association, if applicable. *A request for reforestation requires a written agreement submitted to the Parks, Beaches, and Recreation Commission by the petitioning sponsor (Individual private property owner(s) or group) to pay 100% of the costs of the removal and replacement of the public tree(s) in advance of any removal activity. The actual removal and replanting will be coordinated by the General Services Department using the City tree maintenance contractor. *There shall be a minimum of a one - for -one replacement of all trees removed in reforestation projects. Replacement trees shall be a minimum size of 24" boxed trees and cost $195 per tree, unless the parkway space will not accommodate a 24" boxed tree or a tree cannot be planted due to planting restrictions contained in City Council Policy G -6. This form does not replace the requirements of any of the City tree policies. Its use is intended to expedite the tree removal or reforestation requests and to ensure compliance with all City requirements. Please refer to individual City Council Policy G -1 for additional information. It is an abbreviated edition in that there was no regular meeting of the Board this month. Normal coverage of community events and Board activities will resume in December. ANNUAL MEETING/INOVEMBER ELECTION The Annual Meeting of Members of the Harbor View Hills South Homeowners • Association was held at the Oasis Center on the evening of Wednesday November 3rd, 2004. In attendance were approximately 35 - 40 homeowners including the two Directors who's terms -of- office continue for another year - Don Brigham and Peter Morin. In addition, Cynthia Davis and two associates from The Emmons Company were present to sign -in homeowners, receive ballots and proxies and handle the mechanics of the election for new Directors. Secretary of the Association Board Don Brigham conducted the meeting. This year there were three candidates for three open seats on the Board. Each of the candidates made a brief statement outlining their background and why they wanted to serve on the Board.The Emmons Company confirmed that there was a quorum present represented by those in attendance and proxies that had been submitted in advance. In that the number of open seats and the number of candidates were the same, the three candidates were elected by acclamation. The three new Directors are Yvonne Houssels, Kay Paciorek and Chad Cooper. Thus, the HVHS Board of Directors for the next year will include Peter Morin, Don Brigham, Yvonne Houssels, Kay Paciorek and Chad Cooper. The Directors will meet in Executive Session before the December meeting to choose President, Vice President, Secretary, Treasurer and Member -at- Large. HVHS HALLOWEEN PARTY • The annual HVHS Halloween Party was held on the greenbelt on Sunday, 31 October. This really neat event, which was attended by some 150 — 200 kids of all ages, was 1 • organized by Pete and Samantha N5orin who have been doing this for six years now. There were bouncy- houses, food and drink, all kinds of games and some terrific costumes. Thank you Peter and Samantha and the many volunteer helpers who put on a wonderful neighborhood party. A great time was had by all! MARGUERITE LANDSCAPE PROJECT There have been two recent and important events conducted by our Landscape Committee that need to be reported on: 1. The public debut of the new design for the re- landscaping of the Marguerite corridor took place at this year's Halloween Party. Our Landscape Committee presented a display of charts, photographs and a rendering illustrating our exciting new- design.-There is clearly a great deal of interest in the project and enthusiasm for the prospect of upgrading the look of the landscaping and entryways that border our community along Marguerite. Many homeowners stopped by to view the display and the feedback was almost universally positive. 2. This same landscape design road show made an appearance at the Annual Meeting at the Oasis Center. Following the election formalities, Landscape Committee Chairman, Paul Siconolfi, made a brief presentation describing the rationale behind our project, its goals, features and benefits to the community. Landscape architect, Dale Waldo, and Margee Drews who heads up our homeowner landscape design team were on hand to field questions and provide • details of the new design. Those in attendance asked many good questions and exhibited considerable enthusiasm for the project. The Landscape Committee will now turn its attention to the cost - estimating phase of the overall effort. Our goal is to obtain competitive bids for the various aspects of the job and then to work with the new Board to begin presenting the overall cost and schedule picture to the community early in the new calendar year. CITY PARKWAY TREE UPDATE The Association has received requests for reforestation at the following addresses: 1400 Keel; 3606 Seabreeze; 3921 Sandune; 3927 Sandune; 3900 Sandune; 4000 Topside and 4000 Inlet Isle. At the December 1, 2004 Homeowners meeting the new Board will be voting on these requests and also be considering reforestation of the City Parkway Trees in the Association's common area parkways, next to the greenbelt where Seabreeze and Surfview come together. The annual election of the Board of Directors was held at the Homeowners meeting in October with results published in the November Newsletter. Even now we need interested homeowners to volunteer for various committees to bring their talents to your Association. The Board of Directors and membership needs your involvement. MONTHLY BOARD OF DIRECTORS MEETING On Wednesday December 1st, in Executive Session at the Oasis Center, Yvonne Houssels was elected Presidert of your Association. Don Brigham was elected as Vice - Present, Kay Paciorek; Secretary, Chad Cooper, Treasurer, with Peter Morin; Member -at - Large. Our congratulations to each new and continuing Board Member. During the regular monthly Board of Director meeting, the Board was represented by Directors Yvonne Houssels, Don Brigham, Kay Paciorek, Chad Cooper and Peter Morin. Highlights of the meeting were as follows: Homeowners Forum Eleven homeowner members were present at the meeting. Several homeowners expressed concern about stakes erected without an application and plan provided to Property Management and the Architectural Committee. Homeowners are reminded that an application and plan must be sent in to Property Management before stakes are erected. Please see the • Architectural Committee report for additional information. One family registered their concern with an ongoing tree obstruction issue. The Board will be meeting on their property to view the issue first hand at their first opportunity. Another reported that the .slope bordering and belonging to the Terraces of Corona del Mar has been trimmed to reduce the danger of brush fire. The Newport Beach Fire Department aided our Association in reaching the agreement with the Terraces and a letter will be sent thanking the Terraces. Another member suggested that we contact the University of California COOP Extension Agent to brief the Association on water management and usage, one of our Association's largest continuing monthly financial obligations. Tony Christopher met with the Newport Beach Police Department and was briefed that crime in HVHSA was presently 0 %, however, crime is rising in Newpon Beach proper. Landscape Committee Chairman Paul Siconolfi discussed the plans for the future landscaping proposal. He further illuminated the costs and the arranging for a future bidding process and the need to drive down the overall cost in the process. Margee Drew also contributed to the discussion as it related to design and implementation of the project. Maintenance The Green belt is in much better condition due to a new watering program and proper grass height cutting. In that vein, Committee Chairman, Jack Swan is retiring from this position. He has been a tireless representative for our membership. Many of his innovations are present today largely due to his dedication and guiding hand. Thank you so very much, Jack; splendid job. Tree Committee Chairperson Cheryl Livingston was absent, however, her report was filed and will be • discussed both in the January monthly meeting and the January Newsletter. In the intervening months, each member family should assess their own property as it relates to tree and hedge heights. I[ should again be noted that we have new guidelines and form letters as it pertains to informing those neighbors that need reminding. He brings an engineering background and a special discipline to the post and is a quick study. In the meantime, for all long time residents and those new members that have joined our Association, the Architectural Committee and the Board of Directors is formulating an Architectural initial summary checklist for those members contemplating a major structural remodel and/or demolishing for future building. The checklist will be published and put into the hands of all member families for its addition as an addendum to the current Architectural Guidelines. We hope this checklist will better inform those members who contemplate changes to their property. No changes are allowed without-this due process. City Parkway Trees Yvonne Houssels, Chairperson of City Parkway Trees reported that she was ready to ask the City for the reforestation application forms. After hearing no objections at the meeting and no written objections to the previously publicized reforestation requests, the Board unanimously approved reforestation at the following addresses: 3506 Seabreeze Lane, 3921 Sandune, 3927 Sandune, 3900, Sandune, and 4000 Inlet Isle, 3701 Inlet Isle, 3901 Inlet Isle, 1412 Seacrest and 1030 Sandcastle. WATER DRAINING ONTO ivLARGUERITE SLOPES *Another reminder for those families whose property backs up onto the slopes of Marguerite. It is gainst both our community CC &Rs and the City Code for them to permit water from their yards to drain onto the Marguerite slope. The discovery of a number of drain lines pouring water onto these slopes causes landscape washout and disastrous vegetation over watering. The rainy season is upon so it is now particularly important that these drain lines be rerouted. Summary of the Steps required for Major Structural Modifications in the Architectural Guidelines and Procedures Enclosed. In our previous newsletter, the Summary of the Steps required by the Applicant using the Architectural Guidelines and Procedures did not include some of the important requirements. This was due to improper editing by the Association's Management Company. • The Emmons Company has apologized for any confusion and/or inconvenience this may have caused our homeowners and they have paid for mailing this newsletter with the correct summary enclosed. • City Parkway Tree Trimming and Reforestation Rain Rain Go Away! The City has been so busy with fallen trees and other emergencies due to the rain that our tree trimming and reforestation has been delayed. The City Parkway Tree View Chair, Yvonne Houssels, is presently working with the City's Urban Forester to put us back on schedule. 2 additional homeowner requests for reforestation were approved and added to the reforestation list at the March 10 Board of Directors meeting: 3515 Seabreeze and 3508 Seabreeze. Landscape Renovation Project along Marguerite The Landscape Committee has turned over their finalized suggestions and bids received for the Landscape Renovation Project to the Board for review. The need to relandscape and upgrade the monuments along Marguerite was approved by the previous Board and presented to the homeowners at the Annual Homeowners Meeting and Election in November. L� P J Minutes of HVHS April 11 Board of Directors Meeting City Tree Committee Report April 11, 2005 The City is presently trimming the parkway trees in HVHS. They are continuing the policy of trimming the trees to a height of 14' for view preservation. They will be shaping the newer Magnolia and Orchid trees to form a canopy effect. The reforestation is now scheduled with the PB &R in May. Following the PB &R approval, the homeowners requesting reforestation will have to send their checks to the association and the association will provide one payment to the City before the reforestation can be scheduled. Please approve the additional reforestation for the homeowners at 3620 Seabreeze and 1407 Outrigger Drive so that they can be included on this reforestation list. • Thank you, Yvonne Houssels City Tree Chairperson Hearing no objections, the additional reforestation requests were unanimously approved. • Attachment B Parks, Beaches ft Recreation Commission Regular Meeting May 3, 2005- 7pm Page 2 NEW BUSINESS Reforestation Request - Acting Director Pisani stated that staff had received a request from the Harbor View Hills South Homeowners Association to reforest 19 City parkway street trees in their community. He went on to say that this is the 4h phase with the first completed in 1997, second in 1998, and the third in 2004. Acting Director Pisani stated that the Association has met all the requirements of the G -1 Policy and that they are a legitimate homeowners association and so it is different from last month's reforestation request. He stated that the HOA will fund the total cost of $6,292 for the removal and replacement of the trees. He noted that HVHS President Yvonne Houssels is here tonight to answer any questions that the Commission might have. Commissioner Garrett asked if it was the responsibility of the petitioner to reimburse the City for the value of the tree that is removed in addition to covering the costs of the removal and replacement. Commissioner Allen stated that they are only responsible for covering the costs for removal and replacement and not the value. Commissioner Garrett commented that then the value of the tree that is placed in the report is somewhat meaningless. • Commissioner Allen stated that was correct. She also noted that this Association has been a stellar example of reforestation when it works and then reminded the Commission that this was not her neighborhood, although she wished it was, but noted that HVHS has view issues and that basically the G -1 Policy was designed so that communities with view issues that have CCER's • that the City subjects its trees to basically the same rules that the neighborhood has to abide by and because the City is not bound by the CCER's that the requests still must come through the Commission. Commissioner Brown stated that this HOA was just here about 6 months ago and that the Commission knew at that time that they would be returning. Commissioner Skoro stated that he has the following concerns: 1. The values of the trees are listed at $49,320 and would be replaced with 19 trees at a cost of $3,610 and that is a ratio of 14 to 1 as far as value to what is being replaced. 2. In looking at the pictures of the trees it appears that there are larger trees on the property in the courtyards of many of the homes, i.e. looking at 3701 you will notice that the larger tree is in the courtyard behind the tree that they want replaced and in looking at the pictures it appears that those trees were recently trimmed. 3. Regarding damage everyone of the requests indicates N/A under damages and so in looking in the whole community there are many large trees on private property where the Association does not seem to be enforcing there own guidelines as far as other trees go. Commissioner Ruzicka stated that he as well visited everyone of these trees and looked at the sidewalks and candidly did not notice any damage to any sidewalks, that these trees seemed appropriate for the age of the community and noted that he.felt that it was almost an affront to the Commissioner at the end in saying if we allow them to reforest these trees then they think they should only have to put in the 24" twig instead of the 36" tree. He went on to say that he saw nothing compelling to believe that these trees should be reforested. He agreed with Commission Skoro in regard that a lot of the homes had trees on their property that were much bigger then the one that was being reforested. He stated that he had definite reservations about • the request. • Parks, Beaches Ei Recreation Commission Regular Meeting May 3, 2005- 7pm Page 3 Commissioner Allen pointed out that when the G -1 Policy was being discussed about the view communities it was unanimous amongst all committee members as well as everyone one else in the bodies that approved that policy. She went on to remind the Commission that when it involved a view community that had CC &Rs which requires that trees be maintained to a view plane, and that Association came to the City and requested a reforestation because City trees are violating their CC &Rs, that it was a given and would go so far to say for those that understand what a "taking" is, if the City were to build a building in the view plane of a homeowner and thus devalue their view and the City could be potentially sued for a "taking" and the same is true with trees. if the HOA Board chooses to reforest trees that are in the view plane, and noted that there is nothing more important in this City then neighborhoods with CC &R's that protect views. Commissioner Allen went on to say that it is a sign of arrogance for the Commission to say that you have to have sidewalk damage because that is not what the CC &R's say. Commissioner Ruzicka stated that the only comment he could make while certainly respecting Commission Allen's opinion is that he had looked specifically at that issue and looked at these trees and is sorry but is hard to see how these trees could impact views when there are others trees on the same property that are higher. Commissioner Garrett stated that he would support the request because no one on this Commission lives in this neighborhood and agrees with Commissioner Allen about the arrogance of the Commission dictating to these homeowners that live in a legitimate HOA who have • concerns about views when they have met the requirements of the policy, staff has recommended approval, and for this Commission to sit here and say that we just do not think it is a good idea or for whatever reason that there are trees on private property and therefore he stated that he could not agree with that and would support the reforestation request. Chair Tobin stated that he had reviewed the tree locations and, speaking as a citizen, did not see any damage, and just saw many trees in people's yards that were a lot bigger then the ones that they wanted to remove from the parkway. Chair Tobin opened the public discussion Yvonne Houssels, HVHS HOA President stated that as Commissioner Allen pointed out that they have worked very hard with the City in regard to the G -1 Policy and read the following from the Santa Ana Register from when the community was developed: High design luxury dwellings mark Lusk Harbor View Hills South Homes - This community features unobstructed panoramic views of Newport Harbor and are one of the most attractive features of the final homes that have opened. EG Warmington Jr., Director of Sales and Marketing for Lusk Homes said "that the 37 luxury homes in this scenic hill overlooking the harbor represent one of the final increments of view homes in the beach area retreat and went on to say that HVH homes will not have their views impaired by development in the future and that the entire area has been master planned so that homeowners are assured that the view they enjoy today can be enjoyed forever." Ms. Houssels went on to say that when Jasmine Creek was developed and wanted to raise the roof lines, City Council put a mandate that all roof lines and all trees in Jasmine Creed association must be kept below those roof lines and not impact the views from HVHS. With that background, she asked the Commission to understand that HVHS has governing documents and • CC &Rs that give view homeowners and view easements over other homes and over other trees in the Association. Ms. Houssels stated that it had been mentioned that there were some larger trees on properties that were possibly higher then the City tree that was to be reforested, but Parks, Beaches E Recreation Commission Regular Meeting May 3, 2005- 7pm Page 4 noted that HOA members do not drive through the community asking people to chop down their • trees because it is above the roof line. Instead the HOA waits for a homeowner to submit a complaint and then action is taken. She stated that all 19 of these trees were studied by the Board and have been trimmed and appear much lower now, and the problem is that the Pepper trees (which represent the bulk of these trees) have been a problem for many years in that they grow into the view plane so quickly after being trimmed. Within 6 months they are as high as they were and pointed out that both the homeowner that has the parkway tree and the impaired view homeowner are all in agreement to have these trees reforested and that there is no concern between homeowners over this and all are in agreement. Commissioner Brown stated that he is concerned about these trees and is usually not in favor of pulling out healthy trees and having said that, there are other issues such as the consistency of what the Commission does, i.e. this reforestation has been planned in four phases and the Commission has approved the other three requests, He went on to say that he would be concerned how policy is uniformly applied, and stated that what separates this request from last month is that the removal of these trees is not in dispute among neighbors and that this is a CCER HOA and all are in agreement and that he would have trouble telling HVHS that they cannot do what has been already been agreed to those that have CCER's. He stated that those are his thoughts but is still not sure how he will vote. Commissioner Ruzicka stated that he has one observation knowing that Commissioner Garrett had stated that just because the City had recommended approval of this request but it would be superfluous for commission members to come to meetings if they just arbitrarily always went with the recommendation and not exercise discretion. • Commissioner Garrett stated that it is certainly not a reason to deny the request. Chair Tobin closed the public discussion Motion by Commissioner Allen to approve the Harbor View Hills South Homeowners Association request to reforest 19 City parkway street trees. Cameo, with the assistance of the city staff, has nearly finished its first reforestation, replacing old street trees that were planted 40 years ago with new trees. We had the cooperation and approval of the Parks Beaches and Recreation Committee, once we complied with the city and all the new regulations. Homeowners and the Cameo community in general are pleased with the long overdue improvement. Now I understand that Harbor View Hills South had a reforestation plan turned down by the PB &R committee, even though it complied with all the regulations. What is going on? Does each member of that PB &R committee really want to become intimately involved in all association plans? Does it want to come out to each homeowner, talk to them, go through their property, check the views, check the CC &Rs, check with the neighbors, and oversee our Architectural Committee meetings and Board of Directors meetings? No little effort goes into planning improvements to the community and I am dubious that PB &R members who voted against the Harbor View Hills South proposal went, with due diligence, through the entire process with each homeowner, each application, each association committee, and each city staff member. The city should back up its rules and regulations so that all of us have the assurance that when we follow the procedures, we can effect change in our communities. All of us, including Harbor View Hills South, deserve that. So, we ask that you overturn their reforestation denial and give them the approval that is merited. Otherwise, all Newport Beach communities will be stymied in effecting change in our associations and it will appear this is not a community of laws. I am requesting - that you approve the reforestation request for Harbor View Hills South. The Association has complied with all of the requirements of the G -1 Policy and the reforestation has been approved by the Urban Forester and the City Staff. The same steps and procedures were followed and the same information was provided for the three previous stages of reforestation in Harbor View Hills South. The City Council, Parks Beaches and Recreation and the City staff approved these three stages. Lusk and Sons developed Harbor View Hills South as a view community in a joint venture with the Irvine Company. In an article in the Santa Ana Register, February 1, 1970, E.G. "Bud" Warmington Jr., director of sales and marketing for Lusk Homes said, "Harbor View Hills homes will not have their view impaired by development in the future. The entire area has been master - planned so that homeowners are assured the view they enjoy today can be enjoyed forever." When Jasmine Creek was developed in 1974, the City of Newport Beach issued a mandate that all trees had to be maintained at roof top height to protect the views in Harbor View Hills South. This mandate is referenced in the Jasmine Creek CC &Rs. A copy of the Warmington article and the page from the Jasmine Creek CC &Rs are enclosed for your review. The Board of Directors has followed the requirements and procedures of our governing documents in establishing that the trees to be reforested are impacting the views of our homeowners. The pertinent page of the CC &Rs and our Tree View Policy are enclosed. Per the requirements of the G -1 Policy, prior to the HVHS Board of Directors voting on this reforestation, all members of the association were officially notified by newsletter and given an opportunity to respond at our Board of Directors Meetings, the first Wednesday of each month. Copies of the HVHS November and December 2004 and the March 2005 Newsletters and the April 2005 City Tree Committee Report have been provided to the City. At the May 3 Parks Beaches and Recreation (PB &R) meeting, we were surprised when 3 members of the PB &R took exception to the manner in which we enforce our governing documents. They stated that they had driven to our association and viewed the trees from the street. In their opinion the trees did not appear to block views because there were other higher trees in some of our homeowners' yards. They did not view the trees from the homes where the views were impacted. Unfortunately, they did not contact the Association's Board and ask to see our governing documents and our procedures for enforcing them. if they had done so, we would have informed them that the Board attempts to maintain as many trees in the association as possible. Therefore, we do not require trimming and /or removal of trees unless we receive a complaint from an impacted homeowner. When a complaint is received, the Tree View Chairperson visits the site and confirms the view obstruction before the Board takes any action. One member of the PB &R stated that we should use 36" box trees. The use of 24" box is permitted under the G- I Policy in view communities. The previous 3 stages of our reforestation were all approved by the City Council, PB &R and the City staff using 24 "box trees. The City Staff and the Board have concurred that the larger 36" box trees are too large for our narrow parkways and are very likely to result in compacted roots and unhealthy trees. Starting with the 24" box tree, we have been able to shape the trees to be beautiful at a height below the roofline in our community of mostly one -story houses and preserve the valuable views in our association. Please see photos of our newly reforested trees enclosed. The Associations have to establish their own procedures to enforce their governing documents in conformance with the law. Please allow the G- I Policy to continue to work effectively by approving our reforestation request. Thank you for your time and consideration. Every Member and the family and guests of a Member shall have a right of enjoyment in and to the Common Area, if anv, and such right shall be appurtenant to end shall pass with the interest required to be an Owner to every Lot, subject to the following provisions: (a) The right of the Association to limit the number of guests of Members and to limit the use of the Common Area by persons not in possession of a Lot, but owning a portion of the interest in a Lot required for membership. In no event shall any such improvement or alteration be allowed to be placed or maintained, which in the opinion of the Architectural Committee, obstructs or impedes in any manner, the View of any lot within the Service Area. Notwithstanding approval by the Architectural Committee of any such improvement or alteration as herein provided, the Architectural Committee shall have the rightto subsequently require any member to remove any such improvement and /or alteration, which in the reasonable opinion of the Architectural Committee impedes or detracts from the View of any lot within the Service Area. Section 4. Trees and Shrubs. In order to preserve the natural View which the Lessee /Owner of each lot is intended to enjoy, and to preserve the esthetic beauty of each lot involved, no member shall undertake to commence the planting or placement of any tree, bush, shrub or plant, which at its maturity, and without the clipping and pruning thereof, would exceed the height of the dwelling house on said lot without first submitting to the Architectural Committee in writing, for its approval, proposed plans for the placement of any such trees, bushes, shrubs or plants. Said plans as submitted shall show in detail, the proposed elevations and locations of said trees, bushes, shrubs and plants, including the location and elevation of same in relation to all other lots subject to these restrictions. Approval of said plans by the Architectural Committee may be withheld if in the reasonable opinion of the Committee, the View of any lot within the Service Area would be impeded by the location of such tree, bush, shrub or plant, or in any other manner. Any tree bush shrub or plant that at its mature height and /or breadth does not impede the View of any lot within the S aLe Area will not be subject to a height restriction. The final authority as to view impediment rests with the Board of Directors. event the Architectural Committee shall have the right to require any member trim, top, or prune any tree, or shrub, which in the reasonable belief of the ir- mmittee_ impedesordetractsfromtheViewofanylotwithinthe Service Area. No planting at tops of banks shall be allowed to grow more than twenty -four (24) inches above the finished first floor elevation of the house at the top of the bank. Any other planting on the bank shall not penetrate a line of vision drawn between a point twenty -four (24) inches above the top of the'bank along perimeter to roof lines or other permanent structures which would limit view. The bank rule applies only to slopes contiguous or adjacent to the side of the lot affected. This section shall include all Properties within the Service Area, including the Common Area and Easement Areas owned and maintained by the Association. In the event that the Board has not appointed an Architectural Committee, all powers and duties of that Committee shall be exercised by the Board of Directors. Section 5 Maintenance of Lots and Slopes. In order to maintain the beauty of this residential area, no weeds, rubbish, debris, objects or materials of any kind, plants or seeds infected with insects or plant diseases, shall be placed, grown, or permitted to accumulate upon any portion of the property which renders such portion of the property unsanitary, M HARBOR VIEW HILLS SOUTH HOMEOWNERS ASSOCIATION TREE VIEW MAINTENANCE PROCEDURE Revised — October 2004 It is the policy of the Harbor View Hills South Homeowners Association that the individual homeowners shall have the option to resolve any view impairments issues on a personal basis and/or by seeking assistance in writing from the Association's Management Company. The Association's Board of Directors or Tree View Committee will review and decide each situation on a case by case basis using criteria spelled out in the Association's governing documents. Should an impairment issue remain unresolved after all reasonable efforts have been taken, then the Association shall request its legal counsel to intervene in the matter. General 1. Views are an important asset to our community. 2. It is understandable that homeowners who have views want to protect them. These homeowners may have paid a view premium for their homes. 3. Current governing document guidelines for trees not being higher than an existing roof line and other sight lines will be enforced. 4. Homeowners shall have the option, but shall not be required, to resolve view issues with their neighbors before the Board of Directors or the Tree View Committee addresses any alleged failure to comply herewith. 5. The Board will create a Tree View Committee which will function under the direct supervision of the Board, and will be composed of such homeowners as the Board shall appoint thereto, one of which will serve as the Chairperson of such Committee. 6. Parkway or street trees ( "city trees ") are owned by the City of Newport Beach. The City Tree Committee, an ad hoc Committee of the Board, coordinates an annual trimming of the street trees by the City in accordance with the Association's Street (Parkway) Tree Trimming Procedures and Standards. Requests for trimming of street trees which impact views should be submitted to the Association's Management Company for consideration by the Tree View Committee. 7. Greenbelt and other common area (e.g., slopes) trees are subject to annual trimming coordinated by the Maintenance Committee, an ad hoc Committee of the Board, which administers the Association's dealings with the various landscape contractors. Requests for trimming greenbelt and other common area trees which impact views shall be submitted to the Association's Management Company for consideration by the Tree View Committee. 8. The Management Company shall maintain a Tree View Maintenance Log, which will record the status of all pending view matters. The Tree View Committee will work with the Management Company to review and update the Tree View maintenance Log, which shall be forwarded to the Board on a monthly basis. 9. The Board will generally only intervene on tree view matters when requested to do so by the Chairperson of the Architectural Committee, Tree View Committee, Street Tree Committee or Maintenance Committee. Additionally, any homeowner may request a hearing with the Board to appeal a decision by the Tree View Committee. All decisions by the Board regarding tree view matters are final. 10. The Board will administer this Tree View Maintenance Request Policy consistent with the Association's governing documents. Timeline 1. Homeowner to homeowner contact may be initiated as the first step in the view maintenance process. Any homeowner alleging a failure to comply herewith shall communicate in writing the specific location and nature of any alleged non- compliance to the owner of the property at which the alleged non - compliance exists and request the correction of the alleged non - compliance within 30 days of the date of such written notification. In lieu of the foregoing, the complaining homeowner may notify the Association's Management Company in writing and shall submit therewith documentation describing the view impairment. 2. If, after thirty (30) days from the date of the initial homeowner to homeowner written communication or the written communication by Association's Management Company, the alleged non - compliance has not been resolved, the complaining homeowner shall make a request in writing to the Tree View Committee c/o the Association's Management Company requesting additional assistance in resolving the subject dispute. The request shall include copies of all previous communications, whether sent by the homeowner or the Association's Management Company, the date of mailing thereof, and the specific location and nature of any alleged non - compliance. A form letter attached to this procedure may be used to document this request. 3. If, in the opinion of the Tree View Committee, the trees and/or shrubs need to be trimmed, they will notify the Association's Management Company who in turn will send a letter of noncompliance to the non - complying homeowner requesting that they trim their trees and/or shrubs within thirty (30) days of the date of said letter. A decision of the Tree View Committee shall be determined within ten (10) days of the receipt of the homeowner's written request for assistance. 4. As part of the process, a copy of the letter of noncompliance and request for compliance will be sent to the complaining homeowner. It will be the responsibility of the complaining homeowner to inform the Tree View Committee c/o the Association's Management Copy if the required trimming has not been completed by the thirty (30) day deadline date. If there is continued noncompliance, the Tree View Committee, upon verification of such noncompliance, shall recommend to the Board that immediate legal action be instituted and that the non - complying homeowner be informed of such legal action and his responsibility for the payment of all costs incurred by the Association should the Association be successful in such legal action. 5. In the case of repeat offenders, the complaining homeowner shall contact the Association's Management Company who will give a thirty (30) day written notice to the non - complying homeowner describing and requesting the required trimming. If the noncompliance continues beyond the thirty (30) days, commencing with the date of such written communication, the complaining homeowner shall notify the Tree View Committee c/o the Association's Management Company in writing of such noncompliance, together with copies of all correspondence. Within ten (10) days of such notification and verification of such noncompliance, the Tree View Committee shall recommend to the Board that immediate legal action be instituted and that the non - complying homeowner be informed of such legal action and his responsibility for the payment of all costs incurred by the Association should the Association be successful in such legal action. The Board of Directors of the Harbor View Hills South Homeowners Association encourages all homeowners to keep the trees, bushes, shrubs and plants trimmed to a level as indicated in the governing documents and to work with their neighbors in the resolving view issues when they arise. While it is not the desire of the Board of Directors to initiate legal action against any member of the Association, the Board will take such action if any member fails to keep their property in compliance with the Association's governing documents. Ehretz Z+, 2112 ice: vi L_NLAaHEN PAGE 01 /0i CAMEO COMMUNITY ASSOCIATION May 23, 2005 Mayor Bromberg and Council Members City of Newport Beach: It is my understanding that you will be considering a request from the Harbor View Hills South homeowners' association at your meeting on the 240 of May 2005, to approve a reforestation plan submitted by that homeowners' association. This reforestation plan was recently rejected by the Parks, Beaches and Recreation Commission. I am writing to you to express the support of the Cameo Association for this request by Harbor View Hills South. Cameo is just winding up the first phase of our reforestation involving over 100 trees and will prove forward with a second phase of reforestation in another year. We are able to do this because the City Council approved changes to the City G -1 Tree Policy over a year ago after numerous hearings by the PB &R ad hoc commission and debate before the City Council. it now appears that some members of the PB &R Commission have decided to add some of their own criteria to the G -1 Policy without going through the formal process of amending the existing policy. As near as I can tell, Harbor View Hills South submitted all the required documents, completed all the required notifications of homeowners and received a recommendation of approval for their plan from General Services staff. The minutes from the PS &R Commission meeting indicate that Commissioners Skoro and Tobin voted against the reforestation submittal for reasons clearly outside the scope of the G•1 Policy. it is not appropriate that homeowner associations with hundreds of members willing to spend their own funds to beautify their communities be stopped in their tracks by two individuals who are either not aware of the City regulations or choose to ignore them. Cameo is holding our annual homeowners' meeting, dinner and Board Member election on Tuesday evening this event prevents me or a Board Member from attending the City Council meeting to speak in support of the request from Harbor View Hills, South.
