HomeMy WebLinkAbout03 - Vehicle Code Enforcement in One Ford RoadCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. s June 14, 2005 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Public Works Department Antony Brine, P.E. 949 -644 -3311 tbrine@c4.newport-beach.ca.us SUBJECT: VEHICLE CODE ENFORCEMENT WITHIN ONE FORD ROAD RECOMMENDATION: Introduce Ordinance authorizing application of California Vehicle Code to Private Roads in the One Ford Road Community, and pass to second reading on June 28, 2005. DISCUSSION: As part of the approval of the One Ford Road development, a Condition of Approval was included which requires that "the California Vehicle Code (CVC) be enforced on the private streets and drives" within the community. This action will add a new Section to the Municipal Code to formalize the application of provisions of the CVC to the private streets in One Ford Road. A letter was sent to the One Ford Road Community Association notifying them of the proposed action. Environmental Review: The proposed action is not defined as a project under the California Environmental Quality Act (CEQA) because it involves general policy and procedure- making activities not associated with a project or a physical change in the environment (Section 15378 of the CEQA Guidelines). Badum Works Director Attachments: Ordinance Letter to One Ford Road Community Association ORDINANCE NO. 2005- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING CHAPTER 12.66 OF THE NEWPORT BEACH MUNICIPAL CODE TO APPLY PROVISIONS OF THE CALIFORNIA VEHICLE CODE TO PRIVATE ROADS IN THE ONE FORD ROAD DEVELOPMENT The City Council of the City of Newport Beach does hereby ordain as follows: SECTION 1: Section 12.66.096 of the Newport Beach Municipal Code is to read as follows: 12.66.096 Application of Vehicle Code to Private Roads in the One Ford Road Development. The provisions of the California Vehicle Code shall apply to the following private streets in the One Ford Road Development in the City of Newport Beach: Southern Hills Drive Turnberry Drive Oyster Bay Drive Long Bay Drive Country Club Road Oak Tree Drive Vintage Drive Ironwood Drive Old Course Drive Crooked Stick Drive Sawgrass Drive Spanish Bay Drive Jupiter Hills Drive Honors Drive Thunderbird Drive Troon Drive Turtle Bay Drive Edgewood Drive Single Tree Drive Gleneagles Drive Colonial Drive Maidstone Drive SECTION 2: The City Clerk shall cause the same to be published once in the official newspaper of the City, and it shall be effective thirty (30) days after its adoption. Irvine, CA 92606 Attention: Sheri Conner Subject: California Vehicle Code (CVC) Enforcement in One Ford Road Dear A/Is. Conner; As part of the approval of the One Ford Road development, a Condition of Approval was included which requires that "the California Vehicle Code (CVC) be enforced on the private streets and drives" within the community. The City is planning to prepare an ordinance, for City Council approval, which will officially revise the Municipal Code to include CVC enforcement within One Ford Road. Vehicle Code enforcement by the Police Department will include, but not be limited to: STOP sign violations, speed limit violations, and No Parking signs/red curb enforcement. The current schedule is to submit the ordinance as an Agenda Item at the June 14, 2005 City Council meeting. The ordinance would then be adopted on June 23, 2005, and the CVC enforcement shall be effective thirty (30) days later. A field review of the community indicated that there are approximately ten (10) "No Parting" signs missing on various streets. The streets where these signs are missing include: Southern Hills Drive, Troon Drive, Thunderbird Drive, Maidstone Drive, Jupiter Hills Drive, and Gleneagles Drive. The One Ford Road Community Association is responsible for maintaining all of the improvements c onstructed p er the o riginal T Tact improvement plans. The missing signs need to be replaced by the Association no later than July 28, 2005. If necessary, the City can provide a copy of the Tract improvement plans and highlight the locations of the missing signs.
