SUBJECT: BACK BAY SCIENCE CENTER — AMENDMENT NO. 1 TO
PROFESSIONAL SERVICES AGREEMENT WITH RON YEO, FAIA
RECOMMENDATION:
Approve the attached Amendment No. 1 to the Professional Services Agreement with
Ron Yeo, FAIA, Architect, Inc., for the Back Bay Science Center.
DISCUSSION:
On September 9, 2003, the City entered into a Professional Services Agreement with Ron
Yeo, FAIA, Architect, Inc., for final design, architectural and engineering services, and
construction support for the Back Bay Science Center (BBSC) on Shellmaker Island. The
agreement will expire on June 30, 2005. The City desires to extend the term of the
agreement by two years to June 30, 2007.
The BBSC was originally put out to bid last June. One overpriced bid was submitted after
the deadline for receiving bids, so it was rejected as non - responsive.
In an effort to obtain the interest of quality contractors for a re -bid of the BBSC, Staff has
pre - qualified construction firms to bid this and three upcoming City building projects. Mr.
Yeo is presently revising plans and specifications for the re -bid, which is anticipated to
occur during August. The time extension is needed so that Mr. Yeo can complete the
revisions and provide construction support in the event that a construction contract is
awarded.

TO
PROFESSIONAL SERVICES AGREEMENT
WITH RON YEO, FAIA, ARCHITECT, INC.,
FOR BACK BAY SCIENCE CENTER ON SHELLMAKER ISLAND
THIS AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT, entered into this_ day
of , 20053 by and between the CITY OF NEWPORT BEACH, a municipal
corporation, (hereinafter referred to as "City') and Ron Yeo, FAIA, Architect, Inc., a corporation
whose address is 500 Jasmine Avenue, Corona del Mar, California, 92625 (hereinafter referred to as
"Consultant'), is made with reference to the following:
RECITALS
A. On September 9, 2003, CITY and CONSULTANT entered into a Professional Services
Agreement, hereinafter referred to as "Agreement", for final design, architectural and
engineering services, and construction support for the Back Bay Science Center on
Shellmaker Island, hereinafter referred to as "Project'. This Agreement is scheduled to
expire on June 30, 2005.
B. City desires to enter into this Amendment No. 1 to extend the term of the Agreement to June
30, 2007.
C. City and Consultant mutually desire to amend Agreement, hereinafter referred to as
"Amendment No. 1," as provided here below.
NOW, THEREFORE, the parties hereto agree as follows:
1. The term of the Agreement shall be extended to June 30, 2007.
2. Except as expressly modified herein, all other provisions, terms, and covenants set
forth in Agreement shall remain unchanged and shall be in full force and effect.
IN WITNESS WHEREOF, the parties hereto have executed this Amendment No. 1 on the date first
above written.
