Accept the work. 2. Authorize the City Clerk to file a Notice of Completion. 3. Authorize the City Clerk to release the Labor and Materials bond 35 days after the Notice of Completion has been recorded in accordance with applicable portions of the Civil Code. 4. Release the Faithful Performance Bond 1 year after Council acceptance. DISCUSSION: On November 9, 2004, the City Council authorized the award of the NCES Loop Road Landscape and Irrigation contract to FYR Landscaping, Inc. dba Pierre Sprinkler and Landscape. This contract was an adjunct of the on -going cooperative effort between the City of Newport Beach and Newport Mesa Unified School District to relieve traffic congestion at Newport Coast Elementary School. The initial phase, construction of the Newport Coast Elementary School Loop Road, Contract No. 3684, was recently completed. Due to the proximity of the new loop road to existing residences, the City and the School District made a commitment to soften the appearance of the new asphalt roadway by planting trees and ground cover along the roadway perimeter. The project also provided the replacement of existing landscape and irrigation improvements, which were impacted by construction of the loop road. The contract has now been completed to the satisfaction of the Public Works Department. A summary of the contract cost is as follows: SUBJECT. NEWPORT COAST ELEMENTARY SCHOOL LOOP ROAD LANDSCAPE AND IRRIGATION — COMPLETION AND ACCEPTANCE OF CONTRACT NO. 3731 June 28, 2005 Page 2 Original bid amount: $145,460.00 Actual amount of bid items constructed: 142,303.00 Total amount of change orders: 9,984.56 Final contract cost: $152,287.56 The decrease in the amount of actual bid items constructed under the original bid amount resulted from reduction of part of the irrigation main quantity that had already been installed in a previous contract. The final overall construction cost including Change Orders was 4.7 percent over the original bid amount. Two Change Orders totaling $9,984.56 provided for the additional installation of landscape at the lower end of the loop road, turf replacement and hydroseeding in the playground area, a battery operated controller and miscellaneous items. Environmental Review: The project was determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15313 (Minor Additions to Schools) of the CEQA Implementing Guidelines, and a Notice of Exemption was filed with the County Recorder's Office on May 10, 2004. Funding Availability: Funds for the project were expended from the following accounts: Account Description Contributions Fund Account Number 7251- C5100745 Amount $152,287.56 The original contract completion date was February 9, 2005. Due to the excessive rainy season, the additional work, and the landscape maintenance period, the completion date was revised to June 7, 2005. All work was completed by the revised completion date.
