SUBJECT: BUDGET AMENDMENT #BA- AND AUTHORIZATION TO
PURCHASE 1.88 ACRES OF LAND AT SUPERIOR AND PCH
(CALTRANS PARCEL DD #40766- 01-02; SUNSET RIDGE PARK)
RECOMMENDATIONS:
1. Authorize the Mayor to execute a Purchase and Sale Agreement for parcel DD
#40766 -01 -02 provided that the Agreement is substantially similar to the attached
• Term Sheet.
2. Approve a Budget Amendment in the amount of $175,000 from the
Unappropriated Park In Lieu Reserves, 010 -3767, to account number 7021 -
05100515.
DISCUSSION:
Folllowing the passage of Senate Bill 124 (Johnson, 2001), the City has worked with
Caltrans and California State Parks to attempt to secure two parcels near Superior and
PCH for the Sunset Ridge Park project. After extensive talks during 2005 involving
State Senator John Campbell, the state Department of General Services, Caltrans, and
the City, we have tentatively agreed at a staff level to secure both parcels of land with
the City being the fee simple owner of the two parcels, rather than just leasing the large
parcel from State Parks and operating it as a locally- operated unit of the State Park
system.
The tentative agreement includes the purchase of the small (1.88 acre) parcel at a price
of $175,000 (see attached map). In December 2004, the local Caltrans staff and the
City Council agreed to a sale price of $49,400 for this property — but that agreement
was hampered by the California Transportation Commission's Airspace Advisory
Committee's (AAC) negative recommendation on that sale. Staff believes that the CTC
• will agree to the $175,000 price, provided that the attached Term Sheet is adhered to.

Environmental Review: •
The sale of surplus government property is categorically exempt under Section 15312 of
CEQA.
Funding Availability:
Upon approval of the recommended Budget Amendment, sufficient funds will be
available in the following account for the project:

California Department of Transportation
(Small Sunset Ridge Parcel)
(August 31, 2005)
1. Caltrans ( "Caltrans ") agrees to expeditiously sell the following parcel ( "Property ") in
the Coastal Zone to the City of Newport Beach ( "City "):
• Director's Deed #040766- 01 -02, consisting of 81,817 square feet or 1.88 acres,
including easements.
2. The price for the Property shall be $175,000 and shall be paid in a lump sum upon
execution of the Sale Agreement.
3. The City shall use the Property for park, open space, or facilities supportive of a park
use. The City may not sell or transfer the Property for any use other than a park,
open space, or park- supportive uses.
6. The Sale Agreement shall be subject to the approval of the Director of Caltrans, the
California Transportation Commission, and the City Council of the City of Newport
• Beach. The Director shall use his best efforts to advocate for the Agreement before
the CTC on the Department's behalf.
7. The parties shall use their best efforts to complete the sale of the Property by
September 30, 2005.
8. Title to the Property shall transfer to the City upon execution of the Sale Agreement
and payment of $175,000.
