In the morning it is plain to see what kind of party they have had because there is amble beer, soft drinks, food, and condoms. The popular place to leave this garbage is at the curb or in the landscape nearby. It is a disgusting sight. If you would limit or restrict parking on Ocean Blvd; it would be commendable. The City of Newport Beach closes The Beach between the hours of 10:00 p.m. and 6:00 a.m. every day of the year. This Policy serves the community by deterring illegal night -time activity (e.g. substance abuse), reducing the noise level at night, reducing over- night trash accumulation and reducing the difficulty of police surveillance during night hours. 2. The BPPA contends that "Permit Parking Only" on The Peninsula, during the Beach Closure hours, would serve to enforce the purposes for which the City adopted the Policy, above - stated. 3. The BPPA contends that the safety and tranquility of the neighborhood would be enhanced, with minimal burden to the City or to the general public, given "Permit Parking Only" on The Peninsula during the hours 10:30 p.m. to 6:00 a.m., daily. This Letter documents our complaints with the Newport Beach Police regarding numerous incidents of criminal activity around our home in Corona del Mar. There are several deficiencies in the police protection in our area. We have had numerous incidents in the past several years in which we have had to call the police. These are highlighted below: 1. Last week, just outside our front door, my car was severely vandalized and the whole street covered with graffiti. 2. Several months ago, a group of 6 gang members were shining flashlights into my home at 2:00 a.m. I was home with my young daughter and scared to death. 3. A homeless person spent the night on my patio this past winter. 4. A couple engaging in sexual activity just outside my front door in broad daylight. 5. Numerous door - knocking and doorbell ringing at midnight or later asking to utilize the restroom, phone, etc. 6. A group of individuals camping/ sleeping and cooking on our grass at midnight. 7. Numerous parties, road rage, etc. after the beach is closed. 8. Countless persons sleeping in their cars, loitering and going to the bathroom in the street the next morning. 9. Garbage, dirty diapers, beer and alcohol bottles, etc. left in the street and sidewalks. The point is, our neighborhood is not safe anymore and we need to increase the security and police patrol at night, especially after the beach is closed. In addition, I strongly recommend 'no parking' signs be posted and enforced during the late night hours to prevent this activity from getting even more out of hand. We can use permits/stickers for local residents. I am asking for your help and suggestions for improvements that can be made in this area. One of the beauties of this area is the ability to walk safely without fear after sunset. This is changing with the number of visitors to our area after sunset and into the night that are not following the rules of our beaches and parks. Many nights groups of individuals are on the beach and in the water making lots of noise after IOpm when the beaches are supposed to be closed and this goes on until 2 or 3 am in the morning. Fires are being set in areas where fires are prohibited (not in the firepits). The smoke and sparks are dangers to our homes, our families, and our property. There has been vandalism to property on Ocean Boulevard that cannot be tolerated. Early in the mornings you can find people sleeping at Inspiration Point park area. This is not a safe environment and is a deterrent to our neighborhood and city. We have a beautiful city that we are happy to share with everyone, but they must abide by the laws and the laws must be enforced. Please keep our city safe by insuring that we are safe and secure in and around our homes at all times, especially at night. The couple was having sex on the patio. When approached they said we live here. When I said no you don't, I know the resident, they got up and ran. This is outrageous! Corona del Mar is being overrun and frankly we fear for our safety — in our own yards! McNamee 3329 Ocean Boulevard Corona del Mar, CA 92623 After thirty years of residency in this uniquely wonderful beach community, it has become necessary for my wife and I to request that the city improve the police protection for the homeowners of the Corona Del Mar area. In the last two years, the use of the beach has increased to such a point that there are now many more beach -goers who ignore the laws regarding the closure times, and who disregard the perimeters of private property in the vicinity. For the first time, we have had graffiti painted on our facilities and had fires burning in the sand on our property late at night. I have awakened to see people in sleeping bags on the beach, obviously undisturbed the entire night. Only two weeks ago, a very large camping tent, occupied by a large family, was allowed to remain on the beach for two nights and nearly three days before police investigated and forced their removal, (and then only after calls to the police by homeowners.) While the family was there, they used the nearby bushes for a latrine in full view of the occupants of houses on the bluff. If the area had been patrolled even once by the police on either night, the tent would have been quite evident, so I can only assume that there was no patrol of the beach at all. While the city is doing a fine job of beautifying and improving the beach area, as well as the whole city, the most essential function and reason for incorporation is the protection of city residents and their property. I live with my son and he parrs his car on the street in front of our house as there is not enough room in our garage for both cars at this time. On or about March 250, 2006, as I went out to get the morning paper, I was SHOCKED to see that my son's car had been vandalized sometime in the night. The vandals has taken a very blunt object and smashed his rear windshield (he's driving my a 2001 Yukon GMC) in an apparent robbery attempt. There was glass everywhere and the windshield was terribly deformed and destroyed. A police report was Sled at that time. As we were meeting with the police, a woman walked by and indicated that the EXACT SAME THING had happened to her vehicle a few weeks prior to this incident; she had some valuables stolen from her car at that time. I believe she stated that she lives on Begonia and she also filed a police report. Needless to say, aside from being enwfionally shaken, the financial cost me was $600 to repair (the vandalism did not meet my deductible) and, since my son drives to Orange for college, I had to arrange transportation for him for 3 weeks while waiting for the replacement windshield. I have only lived in this area for 2 % years and feel very vulnerable at this time. I would very much support action on the part of the city to make this incredibly beautiful neighborhood a MUCH SAFER place to reside. Dear Chief McDonell, As a resident of this neighborhood over the past ten years, I have noted the increasing problems we are faced with regarding the concerns mentioned above. Although my home is not located on Ocean Blvd., I am faced with my street, Seaview Avenue, turning into a perpetual "drag strip" between the hours of 10 p.m. and approx. 1 a.m. all during the summer months. This problem actually starts this coming Memorial Day Weekend and continues until shortly after Labor Day. I have witnessed a number of potentially serious accidents, and genuinely fear for anyone of my neighbors that were attempting to walk our streets at that hour. It is also very disturbing to have beachgoers dumping their cooler ice and misc. trash, including beer bottles and cans, on my little front lawn and in my planters each night for me to clean up. in the morning. This happens assuming they have not chosen to pass out in their cars in front of the house and wait until morning to drive home. I have had property stolen from my courtyard on several occasions and have even come home to food wrappers and cupsicans thrown all over the patio as if they plopped down for a late evening snack and just forgot to clean up after themselves. Last summer I witnessed a woman, with her friend, sit down across the street and urinate right on the sidewalk. It was really disgusting. They then staggered down the street and passed out on someone else's lawn. This situation just seems to be getting worse each year. I believe it would significantly improve matters if there was no parking allowed after the 10:00 closure of the beach, unless it was by permits and /or stickers issued to the residents. At the very least, we are in dire need of increased police patrol at night, especially after the beach closes in order to insure the safety and well being of every one of our residents. Weekends and weekdays. Also, this red zone is used as a loading zone for as many as ten cars, double parked, to load and unload beach equipment, blocking the street and backing up traffic. This is not only a traffic hazard, it is very dangerous. No police patrol has been there to control this. When the police were called on July 22nd, it took them 35 minutes to get to Lookout Point on Ocean Boulevard. • Week of July 16-22 — We more told by a Newport Beach police sergeant and a patrol officer that on two separate nights the police arrested gang bangers with guns on Big Corona beach. They were taken to jail. That Saturday night they were executing another operation (a third) to try and catch more of these criminals. • Saturday, July 22 — After 10:45 pm many beer bottles were smashed against a residence wall and thrown in the street covering an area of 30 feet or more with sharp pieces of glass on the sidewalk and in the street This is a COMMON occurrence. The residents usually have to dean it up themselves. However, we fall short of picking up the dirty women's underwear and dirty condoms we frequently find in our yards. • The narks on Ocean Boulevard. as posted, dose at 11 am. The week of July 10 -16 as neighbors were walking their dog at 12:15 at night, they passed by Lookout Point Park to see a woman performing oral sex on a man. Again, no police patrol! • Throughout the summer, huge tents have been erected on Lookout Point Park. These are camping tents, not awnings. One of them measured 20 feet wide and ten feet high. They erect them early in the morning and take them down at dark, thereby blocking everybody's view. • There are countless illegal bonfires burning directly below the homes on the bluff on Ocean Boulevard. They are dangerously dose to the homes. The fumes from these fires billow directly up into the homes. Many of the residents are concerned as to the affects of this smoke to their health and to the health of their children and grandchildren. Some residents believe they are already suffering the affects of the constant smoke from the beach. Meter times = 30 minute maximums to 12 hour max. �o Annual Permits "Blue Pole' Permit ($100 /year - 3,200 sold annually). Master Permit ($625 /year -- 750 sold annually). o Prohibitions against parking during street sweeping periods. Duration typically four hours. Not all of NB has street sweeping parking restrictions. • Parkinq Control Alternatives Used Citywide o Parking Lots Balboa Lot - 614 spaces (hourly, 24 hours). CDM - 572 spaces ($8 or $10 per visit). o Residential Preferential Parking Programs: Newport Island ( "Zone 1 ") • Established in 1981. • $10 /ea, valid May 15 -Sept 15. • Limit 3 per household. Newport Harbor HS (`Zone 2 ") $10 /ea, allows parking around specific streets without having to move cars every 2 hours. Neighborhood is not in Coastal Zone. Planning & Public Access Issues Robin Clauson City Attorney Patrick Alford Senior Planner What the General Plan Says Circulation Element: Parking availability is limited in the coastal portions of Newport Beach, especially during the peak summer months (CE page 7 -10). Goals and Policies: Use in -lieu fees and other funds to develop public shared parking facilities in areas with inadequate parking supply. Priority shall be given to spending fees in areas that will benefit those who contributed the fees (CE 7.1.3). Recreation Element: The public's right to access recreational features such as the Pacific Ocean beaches, Lower Newport Bay, and Upper Newport Bay are important (R page 8 -9). Goals and Policies: Provide adequate public access to the shoreline, beach, coastal parks, trails, and bay, acquire additional public access points to these areas and provide parking, where possible (R 9.1). What the Local Coastal Program (LCP) Says o Preferential parking districts are permitted to protect the public health, safety, and general welfare (Section 3.1.6 of Land Use Plan of LCP)... But only when other alternatives don't exist; and Only when there is no direct impact to coastal public access; but Impacts to Public Access can be mitigated. A Coastal Development Permit (CDP) is required to establish new, or modify existing, preferential parking districts (Policy 3.1.6 -2). (City's LCP will not be certified until Coastal Commission approves City's Implementation Plan [IP], the other half of the LCP). What the LCP Says (continued) o Use preferential parking permit fees to fund programs to mitigate impacts to coastal access 3.1.6 -3. o Where appropriate, establish a graduated preferential parking permit fee schedule where progressively higher fees are required for each permit for households with multiple permits 3.1.6 -4. o Limit the number of preferential parking permits issued per household to reduce potential adverse impacts to public access 3.1.6 -5. What we can expect to hear from the Coastal Commission o Any preferential parking program must be consistent with our LCP. o City must show CCC analyzed /studied the to a parking program not to be viable. how City has fully issue, looked at alternatives and found the alternatives CCC will likely require a detailed parking survey (survey done in Summer) to determine who's affected. o May direct City to mitigate impacts. If impacts are minimal, that's simple. If not, possible mitigations: Longer hours at CDM beach and parking lot. Establish offsite parking lots and shuttle service. CCC may see this as an opportunity to opening up beach access where access today is limited. • Parking and Public Access o Coastal Commission's Public Access Action plan states: Because the Coastal Act prioritizes public access over private residential use and because the streets are public, the Commission has commonly denied or modified these programs to protect general public access to the coast. What Other Cities have Tried to Do o Carmel (2002). Proposed night -time (sunset to 5:30 a.m.) resident -only parking along Scenic Road to address public intoxication problems. Carmel initially applied for a CDP, then withdrew it, but kept the parking program. Under threat of enforcement by Coastal, City suspended program. Coastal said that "the ability for a "midnight walk" or "late night stargazing" was substantially dependent on Scenic Road's parking spaces. Carmel re- proposed a 10:30 p.m. to 5:00 a.m. resident -only parking program in city's LCP, submitted police data accordingly. Coastal modified and approved with a midnight to 5:00 a.m. parking program. • What Other Cities have Tried to Do o Coronado (2006). Issued own CDP (City has a certified LCP) for a 9 p.m to 6 a.m. curfew at city's Bayview Park after residents complained about parties, vandalism, public intoxication. Coastal called the City's action up. Coastal said that city's crime evidence was insufficient to justify park closure. Coastal said park had a value in providing evening views of San Diego and fireworks. Coastal approved a modified CDP for 11 p.m. to 5 a.m. curfew. • Enforcement Issues Capt.
