Webb, Public Works Director— (949) 644 -3330, dawebb @newportbeachca.gov David Keely, Senior Civil Engineer (949) 644 -3349, dkeely(a-)newportbeachca.gov Reimbursement Agreement to DJM Capital Partners, Inc. for Reconstruction of a City Water Main on Via Oporto Staff is requesting to enter into a reimbursement agreement with DJM Capital Partners, Inc. (Owner) for a portion of the total cost to reconstruct a City water main on Via Oporto as part of the Lido Marina Village Renovation project. RECOMMENDATION: a) Direct Staff to enter into a Reimbursement Agreement, as approved to form by the City Attorney, in an amount not to exceed $150,000.00 with DJM Capital Partners, Inc. for the reconstruction of a portion of the City's water main along Via Oporto adjacent to the Lido Marina Village Renovation project which is beyond the required scope of the project. The payment of said water main reconstruction cost will be from the Water Enterprise Fund. b) Authorize the City Manager and City Clerk to execute the necessary Reimbursement Agreement with DJM Capital Partners, Inc. and the City Manager to approve and make any related reimbursement payments for said water main reconstruction work. FUNDING REQUIREMENTS: Funding is available in the Water Enterprise Fund to fund the reimbursement amount not to exceed $150,000.00 for the reconstruction of a 6 -inch water main, valves and services. DISCUSSION: The owner of Lido Marina Village is undertaking a large renovation project, upgrading storefronts providing new pedestrian walkways, seating areas, landscaping and reconstructing portions of Via Oporto along the project frontage. The water main along Via Oporto, Between Central Avenue and Via Lido is approximately 725 feet long. As part of the Lido Marina Village Renovation Project, the developer is required to relocate approximately 325 feet of the existing 6 -inch cast iron water main within a 4 foot wide utility easement adjacent to Via Oporto. Due to the age of the existing 6 -inch water main (installed in 1930), staff recommends that the remaining approximately 400 feet of 6 -inch water main be replaced concurrently with required water main relocation work prior to the new street pavement and site improvements being installed by the developer. The developer is working cooperatively with City Staff regarding the design and proposed reconstruction of the water main. The exact reimbursement cost for the work has not been determined at this point, but reimbursement authority shall not exceed $150,000.00 which should be sufficient to cover the design and reconstruction cost of the remaining portion of the water main, valves and water services. Staff believes that as the developer is currently reconstructing portions of Via Oporto as part of their renovation project, it is an opportune time to replace the existing water main along Via Oporto. Staff recommends that the City Council approve staff to enter into a reimbursement agreement with the owner for the reconstruction of the portion of the water main that is not required as part of the renovation project. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act ( "CEQA ") pursuant to Section 15301 (Existing Facilities Class 1) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). Attachments: A. Location Map ATTACHMENT A
