Oberman Regulation of Alcohol Establishments in Over - concentrated areas of Newport Beach - FOR THE PUBLIC RECORD High Confidential I am unable to attend the Study Session of March 10th concerning the above - referenced issue.Therefore, I am submitting my comments for consideration, and to be included as testimony and part of the public record. I applaud the leadership of Mayor ProTem Dixon, and Police Chief Johnson to take action to establish sound Policy to address the issues associated with Overconcentration of ABC establishments, and the related safety and nuisance problems. The issue of public safety and nuisance associated with Alcohol- serving /selling establishments has long been a concern of the Balboa Penninsula community. The continued increase in the Overconcentration of such establishments in the Balboa Penninsula area has arisen as the result of historical City reluctance to adequately regulate : a) the granting of Permits required for.operation; b) the enforcement associated with unsafe and nuisance actions, promulgated both by drunk and disorderly individuals and operators; c) progressive citations and fines associated with Operators, through and including potential abatement actions . These problems are not only repeated Nuisance issues -- -they create fundamental Public Safety risk, not only to adjacent neighborhoods but to the people and the city at large. The problems have been well- documented by the Police Department. Specific comments to staff reports and resident recommendations follow: 1. Consideration to Over - concentration and additional regulations when considering new Use permits, either for new establishments, or for food establishments seeking ABC license and approvals: While other cities manage Over - concentration of ABC uses through their land use planning scheme, Newport thus far has been reluctant to do this, or to enact a moratorium on additional permits. I support the recommendations of Residents Wetherholt,Reiss and Park(" Resident group ") relating to additional scrutiny and approval path for granting of new ABC licenses /permits. I also support the statement that criteria for approval and performance monitoring be clear, and consistently applied , to both new and existing ABC establishments. 2. The establishment of the proposed "Overlay" is a good method for establishing an area of Over - concentration, and to further the adequate allocation of PD and other resources and controls. The City needs to support the Branding shift of the Balboa Penninsula to Recreational resident and visitor- friendly beach destination , and away from the Anything Goes that contributes to people coming to the Balboa Penninsula to do what they would not be encouraged or allowed to do in other locations. 3. The Zero tolerance and enforcement policy should be applied throughout the City, and not just in the proposed Overlay area. ( drunk drivers zooming on PCH or any other roadway is a public safety issue to all). Huntington Beach, Manhattan Beach and many other similar coastal areas have established rigorous regulation, and have promoted same - -- -with NO adverse consequences to the business climate or economy. 4. Operator individual and collective Self - regulation is admirable, and this commitment is one that we would expect as a matter of legitimate business practice. However, this in no way obviates the need for the City to undertake and be responsible and accountable for regulation of its uses, and preservation /protection of public safety and neighborhood integrity. Responsible Operators should not have any issue with the policies that the City sets forth,as compliance would be embedded in their business. 5. The problems associated with Concentration of Alcohol- driven safety hazards and nuisance is not only a 2:00 am one.The drunk and disorderly conduct begins mid - day,particularly on sunny weekends and with holiday, summer seasons. There have been ever - increasing incidents of accidents and injuries along the Penninsula boardwalk, particularly with multiple types of motorized vehicles improperly allowed on the boardwalk Walkway. Joe Reiss Newport Beach Resident Alcohol Review Process for Establishments in Over Concentrated Alcohol Areas in Newport Beach o New ]License Applications o Modifications of ]Existing Alcohol Establishments Presented By: Joe Reiss Brew Wetherhoit Brian Park January 21, 2015 Resident's recommendations for wags to improve the approval process of ABC Licenses and confronting the crime issues related to ABC establishments on the Balboa Peninsula la 1. The Planning Department and Police Department currently complete reports and make recommendations, to the Planning Commission, when a location applies for an ABC License, The Planning Department and Police Department do limited, if any, interviews of residents or business owners who may be impacted by the ABC application, prior to making their recommendation to the Planning Commission. Recommendations for approval by the Planning Department or Police Department should not occur without conducting these interviews. This is critical information that should be considered and put into a report before a recommendation goes before the Planning Commission. Providing this information to Planning Commissioners would help them in their decision making process and residents and business owners would not feel they have to show up at every Planning Commission meeting to have their voice heard. 2. If a recommendation is made either in support or not in support of an ABC application, by the Planning Department or Police Department, the report should show clear and concise reasons for approval or denial. When you read the current reports from the Planning Department and Police Department they lack specific reasons for the approval and denial. In an over concentrated area with high crime the report should clearly articulate the reason for a public need, or the lack there of, of another alcohol establishment in this area and how the decision for approval or denial impacts the community. More specific information is needed by the Planning Department and Police Department to help the Planning Commissioners make good decisions. 3. If a recommendation or denial of an ABC License is made by the Planning Department or Police Department then the Police Chief and Planning Director should sign off on this decision. This is a high crime area that is over concentrated with alcohol establishments, therefore both department heads need to show they support or don't support these decisions and give clear direction to the Planning Commissioners. The City Manager and City Council Member Dixon should also review this application before it goes to the Planning Commission. 4. New locations with operators who do not have experience operating a food establishment should not be able to obtain an ABC license until they have been in business for at least two years. This way they will show they are able to operate a successful food establishment before we give them an ABC license. Only a small number of food establishments are successful and we are left with a location that is approved for another alcohol establishment if they fail. This is a reasonable request in an over concentrated area. 5. Food establishments that sell alcohol should have a set time to close. Recently, Sancho's Tacos and Sessions were told they need to close by 9pm. Is that the standard? We should be consistent in this decision. We should come up with consistent standards we apply to each of these food establishments. 6. The Code Enforcement officer, for the Planning Department, and the Vice Officer, for the Police Department, need to work the hours the ABC establishments are most active. Both officers now work 8 -5pm, Monday through Friday. They should work the night hours and certainly on Thursday, Friday and Saturday night checking location for ABC and Code violations. This proactive enforcement is long overdue in the City and has caused a tremendous amount of litigation in the past because of the lack of enforcement. 7. The Police Department needs a larger uniform presence in the Balboa peninsula area with officers dedicated to dealing with the nuisance crime problems. A plan needs to be put in place to deal with the intoxicated individuals who cause disturbances, urination, public drunkenness, sexual acts in public and vandalism. Officers have not been able to accomplish this in the past due to a lack of resources. Every Thursday, Friday and Saturday night a paddy wagon should be deployed to arrest offenders. Having a zero tolerance of nuisance crimes will be deterrent for individuals to get drunk in Newport Beach. 8. The Police Department needs to track all arrests of individuals that are related to alcohol violations to determine where individuals came from when they were drinking. This will stop the alcohol establishments from saying they did not come from my bar and allow the Police Department and Code Enforcement to focus on the bad operators. 9. The Police Department needs to work closer with Alcohol Beverage Control to encourage them to do more undercover and decoy programs, of the ABC establishments on the peninsula, to deter the over serving of alcohol. This has gone unchecked by ABC for some time and is the root of most nuisance crimes on the peninsula. 10. City Council Members and Planning Commissioners need to go on ride alongs with the Police Department on Thursday, Friday and Saturday nights. This is the only way you can get a true picture of the problems our City faces with regards to alcohol on the peninsula. Background Certain areas in the City of Newport Beach have both an over concentration of alcohol establishments and high crime rates. District 15 on the Balboa Peninsula is an example of one of these areas. District 15 which is the most concentrated area for retail alcohol establishments in Newport Beach (1 ABC license for every 42 residents). Additionally, this District had a total of 610 reported crimes as compared to a City wide reporting district average of 108 reported crimes 465% above the City wide District average. Orange County averages one ABC license for every 836 residents. These statistics indicate that there is a strong correlation between the over - concentration of ABC establishments and police related activity. There are other Districts with similar issues; however, no other District is impacted with comparable concentrations of alcohol establishments and crime rates as District 15. The over concentration of alcohol establishments and the high crime, in this area, has a negative impact on the community and is a strain of resources for the City of Newport Beach. Over the last several years the City of Newport Beach and other cities have struggled to find a fair and equitable way to decide whether or not to add additional alcohol establishments to these over concentrated areas. Out of frustration, some cities have implemented a moratorium on adding new alcohol establishments to these areas. This is a drastic measure that prevents good businesses that would not have a negative impact on a community from opening because of the moratorium. Other cities have approved or denied applications on an ad hoc basis without any consistency in the approval process. This method causes confusion not only for the applicant, but also for the community. A clear review process is needed that ensures that any new alcohol establishment or change in the conditions of any existing alcohol establishment does not negatively impact areas already over concentrated with alcohol establishments. Recommendation When businesses located in Districts that have a high concentration of alcohol establishments and are high in crime apply to serve alcohol or, if they already serve alcohol, apply for a change in their existing use, the City of Newport Beach will implement an additional review process. Once approved, these applications have a life -long impact on the community that can extend beyond the life of the original business that applied to serve alcohol or for the change of use. Therefore, careful consideration of these applications should occur when these decisions are made by City staff and the community. The Planning Department and the Police Department must conduct a thorough investigation of how the applied -for use will impact the community and the District. Both the Planning Department and Police Department must provide a detailed staff report at the conclusion of their review that clearly explains and justifies the public need for another alcohol establishment or change in use in an area already over concentrated with alcohol establishments and high crime rates. The staff report must clearly describe any and all impacts the establishment will have on the community and the City. As part of the investigation and staff report, the Planning Department and Police Department should include not only interviews with the applicant but also residents, business owners, neighborhood associations, and staff from other City departments (e.g., the Fire Department, Traffic Engineering, Parking Division, Code Enforcement, etc.). Although the Planning Department and Police Department perform some level of review, the reports they currently prepare rarely show evidence that they have engaged the community, local businesses, or even other City departments. The reports that are currently prepared generally rely on the public to send a letter to City staff after a public notice goes out about the application. At this point, however, the Planning Department, Police Department, and other City staff have often prepared their full recommendation for approval or denial. Because of the life -long implications of these applications, City staff should be more proactive in obtaining information from sources that will be directly impacted by the application. Planning Director/Police Chief Review The staff reports completed by the Planning Department and Police Department must be reviewed by the Planning Director and Police Chief. Since, the application comes from an operator in an area that has an over concentration of alcohol establishments and has a high crime rate, both of these Department Heads should be required to review and approve their respective staff recommendations. This ensures all of the work completed by their staff is thorough and complete and the Department Head is aware of the potential impact this application will have in the District. This procedural step also ensures that the application has been thoroughly vetted by each Department and that the respective Department Head supports the recommendation. The potential for increasing the workload on the Planning Director and Police Chief, is outweighed by the potential negative impact adding a new alcohol establishment or changing the 5 use of an existing alcohol establishment will have on City resources in areas already over concentrated with alcohol establishments and high crime rates. City Manager Review Once an application has been reviewed by the Planning Director and Police Chief it should be forwarded to the City Manager for review. The City Manager has the global perspective of the City and is aware of the reasons that would support or not support adding another alcohol establishment or changing the use of an existing alcohol establishment in an area that is already impacted by an over concentration of alcohol establishments and high crime. As the City's top employee, it is important for the City Manager to ensure that City staff has properly vetted all applications, implemented all review safeguards, and has acted consistently. The City Manager is also in the best position to determine whether additional City agencies (e.g., the Fire Department, Traffic Engineering, Code Enforcement or others) should be consulted and how best to weigh competing recommendations from multiple agencies. The City Manger's perspective is also an important source of guidance for the Planning Commission and City Council when they have to make decisions on approving applications. City Council Member Review Once the City Manager has completed his /her review, the application and the staff reports must be forwarded to the City Council Member of the District from which the business is located. The City Council Member would then have an opportunity to review the application and meet with the City Manager to determine if any additional review is needed. The City Council Member would not be involved in making a recommendation on the application, but simply to determine the sufficiency of the review. Planning Commission Meeting After completing the above review process and after all relevant staff reports have been prepared, the application would then be forwarded to the Planning Commission as they currently are today. This gives the community an opportunity to review and comment on the application. City Council Appeal Process The City Council appeal process remains the same as it is today. l7 Conclusion The decision to grant an application for a new alcohol establishment or to change the use of an existing alcohol establishment has a life -long impact on a community. Once approved, the applied -for use runs with the land. Approvals can be handed from the most well - intentioned operators to reckless operators. When the City decides to make these life -long decisions, it should be required to carefully weigh and consider how these applications will impact existing residents, businesses, property values, crime rates, etc. For Districts that have an over concentration of alcohol establishments and high crime rates, the impact of these applications is far more acute. Requiring additional review of these applications is a reasonable method to ensure that the applied -for use does not exacerbate already high crime rates, further stress City resources, and negatively impact the community. This recommendation does not require the creation of new bureaucratic agencies nor does it threaten to have City -wide impact. Instead, this recommendation is narrowly tailored to use existing resources to address only those applications to serve alcohol or to change an existing use for an alcohol establishment in Districts with an over concentration of alcohol establishments and high crime. These are Districts with recognized problems. Were I there, I would really read that this issue is not just pertinent to the peninsula, but the entire city of Newport Beach and nearby communities. The excessive distribution and consumption of alcohol on the peninsula impacts our community's access to the emergency room of Hope hospital. It is common to see in the late evening numerous alcohol related admissions to the emergency room. This includes acute alcohol intoxication, and resulting health effects. This also includes numerous trips and falls related to intoxication with various types of head and other injuries brought in to the emergency room, as well as from multiple fist fights related to alcohol use. These admissions can crowd our emergency room and not infrequently this crowding can cause temporary closure requiring ambulances to take patients with acute health conditions like heart attacks, strokes, acute pneumonia, etc. to more distant hospitals... the delay in care can contribute to untoward outcomes. We are gathering some statistics regarding the above. Therefore, I would suggest all residents of Newport Beach are affected by the overconcentration of dispensaries and resulting overuse of alcohol in the Peninsula region. I am in agreement with the residents proposal regarding the establishment of consistent standards and protocols for applications of ABC licenses. On the Peninsula we are over concentrated and under served per our own Police Department and need your help to bring more officers to this area and keep them here. I would also suggest we ask our Police Chief Jay Johnson to look into how Pasadena's addresses the restaurant/bar impacts in Old Town. They have a Special Units Department that handles that area at night and it seems to be very affective. None of us are against business, we are pro — business but at the same time we feel we are entitled to the same peace and safety our other Newport neighborhoods enjoy. This community has worked hard for the last 10 years to make the Peninsula a more safe and pro family area with the help of our former Council, the City Manager and our PD. We collectively have taken the "War Zone" out of the 4th of July on the Peninsula and converted this Holiday to a far more "Family Friendly" experience. Because of the private /public cooperation between residents, businesses, the Council, the Parks and Rec. Department and our PD we have changed a nightmare holiday while saving the City hundreds of thousands of dollars. Thank you to Diane Dixon for leading the charge on this issue and working so closely with the residents. I would hope we can continue to count on the rest of the Council for the support of our efforts to promote a better quality of life for every resident in our community.
