HomeMy WebLinkAboutSS2 - Update on ABC Licenses - PowerPoint (Staff - CDD)March 10, 2015 Balboa Peninsula Item No. SS2 City Council Study Session -March 10, 2015 e�r77 7LL*=w — � r .i -. _ N� z 6r �Y Balboa Peninsula Zoning Current Zoning Requirements City has comprehensive Zoning Regulations All businesses that serve alcoholic beverages require a Use Permit- approved by either the Zoning Administrator or Planning Commission Numerous operational standards are required to be included as conditions of approval (NBMCSection 20.48.090) Additional review criteria are identified for Late -Hour Operations related to noise control, lighting, traffic, trash, and neighborhood compatibility Operator's License Requirement Adopted in 2011 (NBMC Chapter 5.25) Applicable to all New Restaurants open past 11 PM, Bars, Lounges, and Nightclubs , and Businesses with Entertainment and /or Dancing Applicable to Existing Businesses when certain thresholds are met (change in operations and /or increase in occupancy) Citywide- there are currently: 14 Approved /Active Licenses (4 in Balboa Peninsula;7 in Newport Center) 4 Pending Applications Businesses with ABC Licenses Alcoholic Beverage Control License Type On -Sale (67) On -Sale Boat (22) Off-Sale(11) Total 100 Businesses Late Hours -Upper Peninsula � Z � m (19) Restaurants and Bars �? Open After 11 PM Late Hours - Balboa Village O ekVI) gq(g� O n n 06 M n (7) Restaurants and Bars wE Open After 11 PM �� OPTIONS Option 1A- Maintain Existing City Regulations and Work with Restaurant and Bar Owners /Managers on a Voluntary Basis to Improve Management /Operations: • Form a Balboa Peninsula Restaurant and Bar Committee • Include Mayor Pro Tem Dixon and Staff from Police and Community Development Department Meet Monthly to Discuss Common Issues and Solutions • Develop Best Practices for Management and Operation Staff to Provide Status Report to City Council in 6 months Zoning Administrator to Refer all Use Permit Applications to the Planning Commission for review and action OPTIONS Option 18- Hold Quarterly Meetings with Mayor Pro Tem Dixon, Interested Residents, Representatives from the Restaurant and ear Committee, and Police and Community Development staff Review recent Police Department activities Report on the Restaurant and Bar Committee activities Report on pending Use Permit applications OPTIONS Option 2- Create an Overlay District for Balboa Peninsula applicable to Restaurants and Bars that serve Alcoholic Beverages.
