Alford, Senior Planner (949) 644 -3235 Palford@city.newport-beach.ca.us SUBJECT: Formation of an Ad Hoc Committee for negotiating the Newport Center Development Agreement ISSUE Should the City Council form an ad hoc committee for the consideration of a Development Agreement in conjunction with the Newport Center Development Plan? RECOMMENDATION 1. Adopt Resolution 2007 - forming the City Council Newport Center Ad Hoc Development Agreement Committee. 2. Confirm the Mayor's appointments of up to three Council Members to the Committee. DISCUSSION The City will soon receive an application for a Planned Community Development Plan for Newport Center, which will draw from the 450 dwelling units allocated for that area in the General Plan as well as provide for implementation of the General Plan's provision for retail and hotel uses. Policy LU 6.14.8 requires the execution of development agreements for residential and mixed -use projects that use this residential allocation and Ordinance No. 2007 -6 requires a development agreement for projects that include non - residential development in Newport Center. To provide guidance from the City Council on the terms and conditions of such agreement, and to ensure that adequate public benefits will be provided, staff recommends a formation of a short-term ad hoc committee. The committee members would be appointed by the Mayor and could be comprised of up to three Council Members. Environmental Review None required for the formation of an ad hoc committee. Submitted by: David Lepo Planning Director RESOLUTION NO._ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING THE AD HOC COMMITTEE TO NEGOTIATE THE NEWPORT CENTER DEVELOPMENT AGREEMENT WHEREAS, the City will soon receive an application for a Planned Community Development Plan in Newport Center; and WHEREAS, the application will draw from the 450 dwelling units allocated for Newport Center and provide for implementation of the General Plan's provision for retail and hotel uses; and WHEREAS, Policy LU 6.14.8 requires the execution of development agreements for residential and mixed -use projects that use this allocation and Ordinance No. 2007 -6 requires a development agreement for projects that include non - residential development in Newport Center. NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1. Establishment An Ad Hoc Committee is hereby established for the purpose of negotiating the Newport Center Planned Community Development Agreement. Section 2. Duties of the Committee The Committee shall have the following duties: A. Work with City staff and designated representatives of applicant on possible terms and conditions of the Development Agreement. B. Recommend to the City Council action on potential terms and conditions of the Development Agreement. Section 3. Composition of the Committee The Committee shall consist of City Council Members appointed by, and serving at the pleasure of the Mayor. Section 4. Duration of the Committee The Committee shall expire at such time as the Committee completes its negotiations with the applicant and its recommendations on potential courses of action are transmitted to the City Council for consideration.
