SUBJECT: BACK BAY SCIENCE CENTER— COMPLETION AND ACCEPTANCE
OF CONTRACT NO. 3460 WITH KEWAUNEE, DOW DIVERSIFIED,
AND METROPOLITAN FLOOR COVERINGS
RECOMMENDATIONS:
1. Accept the work performed and completed by Kewaunee, Dow Diversified, and
Metropolitan Floor Coverings.
2. Authorize the City Clerk to file a Notice of Completion for each trade contractor.
3. Authorize the City Clerk to release the Labor and Materials bonds 35 days after
the Notice of Completions have been recorded in accordance with applicable
portions of the Civil Code.
4. Release the Faithful Performance Bonds 1 year after Council acceptance.
DISCUSSION:
On February 28, 2006, the City Council authorized the award of 12 trade contracts for
construction of the Back Bay Science Center. Three more trade contracts were
awarded on August 22, 2006. The total cost of the 15 trade contracts awarded is
$4,735,709.00. The work of one of the trade contractors, Junior Steel Co., was
accepted by the City Council on May 22, 2007
The work of three more trade contractors has been completed to the satisfaction of the
Public Works Department and is recommended for acceptance. Kewaunee furnished
and installed metal casework in the Water Quality Laboratory wing of the Back Bay
Science Center_ (BBSC) project which is the portion of the facility that the County of
Orange Health Care Agency will occupy under a sub -lease with the City. Dow
Diversified furnished and installed casework in the Teaching Laboratory and the storage
wing of the facility; portions of the BBSC that the California Department of Fish and
Game will occupy. Metropolitan Floor Coverings furnished and installed ceramic tile in
the restroom areas and sheet vinyl on the floor of the Water Quality Lab.

A summary of the three trade contract costs is as follows
The increase in the final contract costs over the original bid amounts is less than one
percent (0.64 %) for Kewaunee and 38.34% for Metropolitan. The final contract cost for
Dow Diversified is 7.71 % less than the original bid amount. The Schedule of Values for
Kewaunee did not include a Construction Manager's contingency allowance. The
Schedule of Values for Dow Diversified and Metropolitan Flooring each included a
Construction Manager's contingency allowance of $5,000 which was not used. A
"credit" Change Order in the amount of $5,000 was processed with each of those two
trade contractors.
In additional to Dow's $5,000 contingency credit, a minor section of casework in the
Teaching Laboratory was deleted resulting in a credit of $1,032. The two credits
together total $6,032 and explain why the final contract cost of $72,244 is less than the
original contract award amount of $78,276.
The $5,000 contingency credit for Metropolitan's contract offset a portion of two additive
Change Orders to their original contract award amount of $99,500. One Change Order
in the amount of $795 covered additional ceramic tile on the walls of the shower room
in the Water Quality Laboratory. The majority of the contract cost increase was for
furnishing and installing ceramic tile on the floors of the Water Quality Laboratory
restrooms ($1,950) and furnishing and installing sheet vinyl on the Water Quality
Laboratory floor ($41,200). These items were not included in the original scope of work
for this trade contract, and after some discussions with representatives of the County of
Orange Health Care Agency it was determined that it would be more cost effective to
have the City's trade contractor perform the work instead of one of the County's
vendors. The City Council authorized the amendment of trade contracts to
accommodate this work at its January 23, 2007 meeting. The County has issued
purchase orders to the City providing for reimbursement of the $43,150 total cost for the
additional flooring work.
Environmental Review:
A Mitigated Negative Declaration was prepared and processed to assess the
environmental impact associated with constructing the Back Bay Science Center.
Identified mitigation measures have been included in the project design and
construction. The California Department of Fish and Game was the lead agency for the
environmental review and the documentation was completed in September 2003.

Geotechnical /Survey Services:
No geotechnical or surveying services were required for the work of these three trade
contractors. Similarly, there were no materials testing services needed to support the
work covered by these three trade contractors.

All work was completed prior to June 7, 2007, which was the initial overall project
construction schedule for completion established by the Construction Manager,
Douglas E. Barnhart, Inc. The construction of the Administration Building has resulted
in a revised completion date of September 7, 2007. No work by Kewaunee, Dow, or
Metropolitan is involved in the construction of the Administration Building portion of the
Back Bay Science Center.
