Badum 949 - 644 -3311 orsbadum @city.newport - beach.ca.us SUBJECT: BACK BAY SCIENCE CENTER — COMPLETION AND ACCEPTANCE OF CONTRACT NO., 3460 WITH J.G. TATE FIRE PROTECTION, STANDARD DRYWALL, INC., U.P. LANDSCAPING, CONTROL AIR, AND CONTINENTAL PLUMBING RECOMMENDATIONS: 1. Accept the work performed and completed by J.G. Tate Fire Protection, Standard Drywall, U.P. Landscaping, Control Air, and Continental Plumbing. 2. Authorize the City Clerk to file a Notice of Completion for each trade contractor. 3. Authorize the City Clerk to release the Labor and Materials bonds 35 days after the Notice of Completions have been recorded in accordance with applicable portions of the Civil Code. 4. Release the Faithful Performance Bonds 1 year after Council acceptance. DISCUSSION: On February 28, 2006, the City Council authorized the award of 12 trade contracts for construction of the Back Bay Science Center. Three more trade contracts were awarded on August 22, 2006. The total cost of the 15 trade contracts awarded is $4,735,709.00. The work of four of the trade contractors has been previously accepted by the City Council (Junior Steel Co. on May 22, 2007, and Kewaunee, Dow Diversified, and Metropolitan Floor Coverings on June 12, 2007.) The work of five more trade contractors has been completed to the satisfaction of the Public Works Department and is recommended for acceptance._ J.G. Tate Fire Protection (J.G. Tate) furnished and installed the interior fire protection sprinkler systems. Standard Drywall, Inc. (SDI) furnished and installed interior wall sheeting, windows, doors, suspended ceilings, and interior painting. U.P. Landscaping furnished and installed the site irrigation system (plant materials are being handled separately). Back Bay Science Center - Completion and Acceptance of Contract No. 3460 with J.G. Landscaping, Control Air, and Continental Plumbing September 11, 2007 Page 2 Control Air furnished and installed the heating, ventilation, and air conditioning (HVAC) systems. Continental Plumbing, Inc. (Continental) furnished and installed all interior building plumbing as well as site water, sewer, and storm drains. Funding for costs associated with the Administration Building will be provided by The State Department of Fish and Game. The City Council authorized adding the Administration Building Construction on January 23, 2007. A tabulation of the contract change orders for the five trade contractors is included with this report as Exhibit 1. The increased cost for materials as compared to the earlier initial bids is evident in some of the change order amounts. Environmental Review: A Mitigated Negative Declaration was prepared and processed to assess the environmental impact associated with constructing the Back Bay Science Center. Identified mitigation measures have been included in the project design and construction. The California Department of Fish and Game was the lead agency for the environmental review and the documentation was completed in September 2003. Public Notice: Not Applicable. Geotechnical /Survey Services: Compaction testing of trench backfill was provided by Bagahi Engineering, Inc., the project geotechnical engineering firm. Construction staking and alignment verification for underground pipelines and structures was provided by Walden & Associates, the project civil engineering firm. Landscaping, Control Air, and Continental Plumbing September 11, 2007 Page 3 Funding Availability: Funds for the project were expended from the following account: Account Description Back Bay Science Center Account Number 7457- CO310600 Total Amount $1,591,806.00 $1,591,806.00 The work of these five trade contractors was completed in a timely manner and consistent with the overall project construction schedules established by the Construction Manager, Douglas E. Barnhart, Inc. The completion date for the scope of work covered by the initial contracts was June 7, 2007. The change order work added to the contracts for construction of the Administration Building extended the completion date to September 7, 2007. The work of the other six trade contractors will be ready for acceptance as soon as "punch list" items are complete. Staff anticipates recommending acceptance of their work at the next City Council meeting on September 25, 2007. A small portion of the site parking and driveway pavement is being deferred until removal of the modular units currently occupied by the county Water Quality Laboratory. Credits for the uncompleted work have been negotiated with the three trade contractors affected. Informal contracts will be administered to complete the site work when the area is accessible.
