Water Main-ContractCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 6 September 11, 2007 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Public Works Department Andy Tran 949 -644 -3315 or atran @city.newport - beach.ca.us SUBJECT: IRVINE AVENUE AND DOVER DRIVE 24" WATER MAIN - CONTRACT NO. 3708 — APPROVAL OF AMENDMENT NO. 1 'TO ON -CALL PROFESSIONAL SERVICES AGREEMENT WITH ARROYO GEOTECHNICAL FOR SUPPLEMENTAL MATERIALS TESTING AND GEOTECHNICAL SERVICES RECOMMENDATION: Approve Amendment No. 1 to On -Call Professional Services Agreement (PSA) with Arroyo Geotechnical for supplemental materials testing and geotechnical services specifically for the Irvine Avenue and Dover Drive 24" Water Main contract. DISCUSSION: The Irvine Avenue and Dover Drive 24" Water Main contract was awarded to Vadnais Corporation on June 13, 2006. As part of the contract, $50,000 was established for materials testing and geotechnical services. An On -Call Professional Services Agreement with Arroyo Geotechnical was approved by the City Council at its June 27, 2006 meeting. Currently, the contract is 75% complete. During construction, several unforeseen utilities and excessive groundwater conditions were encountered causing delays. In order to continue with the materials testing and geotechnical services for this project, Arroyo Geotechnical is requesting an additional $31,980. In accordance with the On- Call PSA with Arroyo. Geotechnical, costs in excess of $50,000 require City Council approval. Staff is recommending the approval of Amendment No. 1 to the On -Call PSA with Arroyo Geotechnical specifically for the completion of materials testing and geotechnical services on the Irvine Avenue and Dover Drive 24" Water Main contract. This exemption covers the maintenance and alteration of existing public facilities with negligible expansion of facilities in areas that are not environmentally sensitive. On June 27, 2006, CITY and CONSULTANT entered into an On -Call Professional Services Agreement, hereinafter referred to as "Agreement', to provide on -call professional services for the various Capital Improvement Program projects, hereinafter referred to as "Project ". This Agreement is scheduled to expire on June 30, 2008. B. City desires to enter into this Amendment No. 1 to reflect additional services not included in the Agreement. C. City desires to compensate Consultant for additional professional services needed for the Irvine Avenue and Dover Drive 24" Water Main contract. D. City and Consultant mutually desire to amend Agreement specifically for the Irvine Avenue and Dover Drive 24" Water Main, Contract No. 3708, hereinafter referred to as "Amendment No. 1 ", as provided here below. NOW, THEREFORE, the parties hereto agree as follows: 1. Consultant shall be compensated for services performed pursuant to this Amendment No. 1 according to "Exhibit A" dated August 29, 2007, attached hereto. 2. Total additional compensation to Consultant for services performed pursuant to this Amendment No. 1 for all work performed in accordance with this Amendment, including all reimburseable items and subconsultant fees, shall not exceed Thirty One Thousand Nine Hundred and Eighty Dollars ($31,980.00). 3. Except as expressly modified herein, all other provisions, terms, and covenants set forth in Agreement shall remain unchanged and shall be in full force and effect.
