Webb, Public Works Director- (949) 644 -3330, dawebb @newportbeachca.gov John Kappeler, Senior Engineer (949) 644 -3218 Resolution Endorsing the City's Grant Application for the Arches Storm Drain Dry Weather Diversion Project State Water Resources Control Board ( SWRCB) staff indicates that the City is likely to be awarded a grant to install two dry- weather diversions on storm drains that drain into Lower Newport Bay at the Arches (PCH near Newport Boulevard, to the east). A condition of the grant award is for City Council to adopt a resolution endorsing the City's grant proposal. RECOMMENDATION: Adopt Resolution No. 2015 -21, A Resolution of the City Council of the City of Newport Beach Authorizing Entering into an Agreement with the State of California and Designating a Representative to Sign the Agreement, and any Amendments Thereto for the Arches Storm Drain Dry- Weather Diversion Project, and endorsing the submittal of the City's grant application to the SWRCB for Arches Dry- Weather Diversion Project. FUNDING REQUIREMENTS: There is no funding requirement associated with this resolution. The total anticipated cost for preparation of construction documents, constructing the project and administering the grant contract is $1,160,000. The anticipated grant award is $890,000 with a match requirement of $270,000 from General Fund. These costs will be included in the proposed FY 2015/16 CIP budget. DISCUSSION: The last remaining long -term posting for fecal indicator bacterial (FIB) exceedances in Newport Bay appears to be directly associated with flows from the Arches Drain. The Arches Drain outlet is located at the west end of the Turning Basin close to the Newport Boulevard Bridge. This drain gets its name from its proximity to the Arches gas station, roadside diner and market that opened in 1925 at the intersection of Coast Highway at Old Newport Boulevard. M The outlet of the Arches Drain site has been continuously posted for FIB exceedances since 1999. Numerical modeling conducted in 2005 indicated bacteria loads from the Arches Drain are transported by tides southerly along the Balboa Peninsula, and is a likely cause of FIB exceedances at beaches from 9th Street to 19th Street, as well as beaches within the Newport Island Channels that include Channel Place Park and beaches in Balboa Cove which are used by swimmers and beach goers. While FIB is just an indicator of potential health risk, a preliminary microbial source tracking study has found human fecal contamination in the Arches' runoff. The Arches Drain outlet is the outlet for two large storm drains that receive runoff from the tributary hillside areas. One storm drain (the West Drain) collects runoff from Hoag Hospital and areas upstream (magenta area shown in Figure 1); the other storm drain (the East Drain) runs along Old Newport Boulevard and into Costa Mesa upstream of 15th Street (light blue area). In 2006, Public Works constructed a treatment bioswale in the open channel adjacent to Newport Boulevard just south of 15th Street. When installed, this bioswale did reduce bacteria concentration by 75 percent but bacterial concentrations still exceeded FIB standards at the storm drain outlet in the bay. In 2013, the Public Works department also constructed storm drain trash interceptors upstream. The proposed diversion project will divert all dry weather flows in the East Drain. The second diversion will divert all dry weather flows from the West Drain that runs through Hoag Hospital. Monitoring at the outlet will be performed after construction and compared to the pre- construction monitoring data. If exceedances are still found, staff will have data to likely show that these bacteria are from natural sources, e.g. biofilm growth in the storm drain pipe, and petition for a natural source exclusion. City Staff prepared a conceptual plan to divert dry weather flows from these two subwatersheds to the sanitary sewer. The proposal was submitted to State Water Resources Control Board ( SWRCB) last October for grant funding under the Clean Beaches Initiative. It now appears the SWRCB will provide grant funding for the proposed diversions. One of the conditions for receiving the grant award requires a City Council approved resolution stating that City Council authorizes the: 1. City of Newport Beach to enter into an Agreement with the State of California for the Arches Storm Drain Dry- Weather Diversions Project ( "Project "); 2. City Manager or designee, to sign the Agreement and any amendments; and 3. City of Newport Beach to fund the operation and maintenance for the Arches Storm Drain Dry- Weather Diversions Project for a minimum period of 20 years after completion of the Project. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). WHEREAS, the State Water Resource Control Board Clean Beaches Initiative Grant Program has announced availability of funds for grants; WHEREAS, said grants are intended to help reduce loading of fecal indicator bacteria to beaches; WHEREAS, the City of Newport Beach has concluded the project proposed for funding would be environmentally beneficial ; and WHEREAS, the City of Newport Beach considers the prospects of receiving a grant to be likely. NOW THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1: The City Council authorizes the City of Newport Beach to enter into an Agreement with the State of California for the Newport Beach Arches Drainage Bacteria Reduction Program. Section 2: The City Council authorizes City Manager or designee, to sign the Agreement, and any amendments thereto. Section 3: The City Council authorizes the City of Newport Beach to fund the operation and maintenance for the Newport Beach Arches Drainage Bacteria Reduction Program for a minimum period of 20 years after completion of the project. Section 4: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution. ADOPTED this 24 day of March, 2015.
