Webb, Public Works Director- (949) 644 -3330, dawebb@newportbeachca.gov Ben Davis, Civil Engineer (949) 644 -3317 Corona del Mar Pocket Park —Award of Contract No. 6042 (CAP14 -0026) Staff has received construction bids for the Corona del Mar Pocket Park project and is requesting City Council's approval to award the construction contract to Clean Cut Landscape of Clovis, California. RECOMMENDATION: a) Approve the project plans and specifications; b) Award Contract No. 6042 to Clean Cut Landscape for the total bid amount of $78,670.10, and authorize the Mayor and City Clerk to execute the contract; c) Establish a contingency of $12,000 (approximately 15% of Total Bid) to cover the cost of unforeseen work not included in the original contract; and d) Approve Budget Amendment No. 15BA -040 transferring /reappropriating project savings in the amounts of $20,600 from 7012- C2502006 and $4,400 from 7015- C1002044 to Account No. 7015- C4002011 to cover a portion of the construction cost, geotechnical and material testing services, construction contingency and incidentals. FUNDING REQUIREMENTS: With the approval of the recommended budget amendment to transfer /reappropriate project savings from recently completed capital projects, there will be sufficient funding for the award of this contract. The following funds will be expensed: Account Description Account Number Amount General Fund 7015- C4002011 $ 95,000.00 Total: $ 95,000.00 NE Staff recommends establishing approximately fifteen (15) percent for contingency purposes for unforeseen conditions associated with construction. Proposed fund uses are as follows: Vendor Purpose Amount Clean Cut Landscape Construction Contract $ 78,670.10 Clean Cut Landscape Construction Contingency $ 12,000.00 American Geotechnical Geotechnical and Material Testing $ 3,125.00 Various Printing and Incidentals $ 1,204.90 Total: $ 95,000.00 As to ongoing maintenance, we estimate that the park will require about $5,000 in annual costs to keep up. DISCUSSION: This project involves constructing a new 1,300 square foot pocket park located on the east side of East Coast Highway between Jasmine Avenue and Larkspur Avenue adjacent to Hobie Surf Shop. The proposed improvements will aesthetically enhance the area and provide a place for patrons to enjoy the scenery along Coast Highway. Park features include terraced, drought tolerant landscaping, an irrigation system, low block retaining walls, bench seating and walkway, and up- lights for the existing adjacent wall mural. A rendering of the proposed improvements is provided as Attachment C. A photo of the existing site condition is also provided as Attachment D. The land for this new pocket park was generously donated to the City of Newport Beach by the Cox family who is the owner of the adjacent Hobie Surf Shop property. Upon completion of construction, the City will provide the necessary maintenance for the new pocket park. Maintenance of this park is estimated to cost approximately $5,000 per year. At 10:00 a.m. on March 3, 2015, the City Clerk opened and read the following bids for this project: Bids for this project were received electronically via PlanetBids. The low bid amount is 1.7% lower than the Engineer's Estimate of $80,000. The low bidder, Clean Cut Landscape, possesses a California state contractor's license classification "A" and "C -27" as required by the project specifications. The contractor is registered with the California Department of Industrial Relations as required by California law to work and bid on public contracts. A check of the contractor's references indicates satisfactory completion of similar projects for other public agencies. The work necessary for the completion of this contract consists of mobilization, traffic control, construction notification, site grading, and construction of steel and masonry retaining walls, site furnishings, lighting, and landscaping and irrigation improvements. Pursuant to the Contract Specifications, the contractor will have 70 consecutive working days to complete the work. M ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act ( "CEQA ") pursuant to Section 15304 (new landscaping including replacement of conventional landscaping with water efficient landscaping) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: This agenda item has also been publicly noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
