SUBJECT: ADOPT A RESOLUTION ESTABLISHING A NO PARKING — TOW
AWAY ZONE (EXCLUDING BUSES) ADJACENT TO 1601 16T" STREET
RECOMMENDATION:
1. Adopt a Resolution allowing removal of vehicles, excluding buses, adjacent to
the Environmental Nature Center (ENC) located at 1601 16 Street between the
hours of 8:30 a.m. and 2:30 p.m., Monday through Friday.
2. Rescind Resolution 2007 -040.
DISCUSSION:
On June 12, 2007, the City Council approved Resolution 2007 -040, which established
parking restrictions adjacent to the ENC to provide for a bus parking zone while the site
is under construction. Currently, vehicle parking (excluding buses) is restricted between
the hours of 8:30 a.m. and 2:30 p.m., Monday through Friday adjacent to the ENC
property at 1601 16th Street.
The existing no parking zone is approximately 100 feet in length to the east of the
driveway and designates parking for two bus as shown on the attached location map.
Traffic signs have been posted indicating that the area is a "No Parking - Buses
Exempt' zone. According to ENC staff, the posted parking restrictions are continually
disregarded and vehicles continue to park within the restricted area. In order to
maintain an open parking area for the buses, staff recommends approval of a new
Resolution allowing for the posting of "No Parking — Tow Away — Bus Stop" signs. The
new signs will enable the Police Department to provide stricter enforcement and
improve the parking situation for the ENC.

Environmental Review:
Staff determined that the project is exempt from the California Environmental Quality Act
(CEQA) pursuant to Section 15378 of the Guidelines. The action is not considered to be
a project as defined by CEQA.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ESTABLISHING NO PARKING — TOW
AWAY (EXCLUDING BUSES) ADJACENT TO 1601 167H
STREET BETWEEN 8:30 A.M. AND 2:30 P.M., MONDAY
THROUGH FRIDAY
WHEREAS, Section 12.40.190 of the Newport Beach Municipal Code
provides, among other things, that when authorized signs are in place giving notice,
standing or parking of vehicles will be subject to removal thereof as the City Council shall
designate by Resolution;. and
WHEREAS, it is necessary to restrict the parking of vehicles, excluding
busses, as follows:
1. South side of 16th Street — from 20 feet east of the driveway at
1601 16th Street, easterly, to 120 feet for approximately
100 feet in length.
NOW, THEREFORE, be it resolved by the City Council of the City of
Newport Beach that the parking of vehicles, excluding buses, shall be restricted and
subject to removal between 8:30 a.m. and 2:30 p.m. Monday through Friday, on the street
segment herein designated.
