DISCUSSION The Planning Department has been contacted by T- Mobile regarding a potential wireless telecommunications facility at Mariners Park. Council Policy L -23 (The Siting of Wireless Telecommunications Equipment on City -Owned Land) designates parks as locations acceptable for the placement of wireless devices. Because the facility would be located on City-owned property, the carrier must obtain authorization from the City prior to submitting an application for a telecom permit. The proposed project was presented to the Media & Communications Committee in February, 2007, for their comments and direction. Staff was directed to bring the proposed project forward to a Study Session for City Council's consideration. Proiect Description As part of the improvements to Mariners Park, the Recreation and Senior Services Department expressed an interest to include a tower element that would provide score boards and message boards for the various sports activities that take place at the park. The preliminary conceptual design provided by T- Mobile shows a clock tower structure located next to the baseball field centered behind home plate. The tower would be designed to accommodate score boards and message boards, as well as the co- location of a second carrier. This particular design depicts a 49- foot -tall clock tower within which the antennas and support equipment cabinets would be concealed from view. The base of the clock tower would measure approximately 10 feet by 10 feet. The lower 12 feet of the tower is proposed to be fully- enclosed to provide a secure enclosure for the equipment cabinets and ceiling - mounted air conditioning units. A total of six panel antennas are proposed to be concealed from view and mounted within the area of the clock face at a height of 46 feet above grade. Proposed Wireless Telecommunications Facility at Mariners Park October 23, 2007 Page 2 T- Mobile states the height of the tower is necessary to accommodate a second carrier due to separation requirements between the different carriers' antennas. According to technical information provided by T- Mobile, a minimum separation of 5 feet between antennas would be necessary. This would place a second carrier's antennas at approximately 36 feet above grade. Based on meetings with representatives from different carriers, staff believes this height would be acceptable. However, at this time, a second carrier has not been identified. Therefore, unless a second carrier commits to the project, the proposed height of the clock tower would not be justifiable. The height limit for this property is 32 feet. Any tower element in excess of 32 feet in height would require the approval of a use permit to exceed the height limit prior to T- Mobile applying for a telecom permit. In order to grant approval of a use permit to exceed the height limit, there are speck findings that must be made by the Planning Commission or City Council, pursuant to Section 20.65.055 of the Newport Beach Municipal Code. There may not be facts to support findings required for use permit approval. In addition to a telecom permit, the carrier would be required to enter into a license agreement with the City, which would authorize the carrier to use the City -owned property under certain conditions. The license agreement would also establish the site rent, rent increases, the term, bonding and insurance, co- location requirements, restrictions on transfers and other obligations. If City Council authorizes T- Mobile to submit an application, the City would benefit from the addition of score boards and message boards for the sports activities at Mariners Park and from rents derived from the license agreement with one or more carriers. Council and resident input is desired at this time on this proposal. Notification of the Council's consideration of this proposal was sent to residences at 1800 -2112 Dover Drive and at 1801 -1927 Mariners Drive, along with the Mariners Community Association on Tuesday, October 16, 2007.
