Harkless, City Clerk 949 - 644 -3005, Iharkless @city.newport - beach.ca.us SUBJECT: COUNCIL VACANCY IN DISTRICT 7 RECOMMENDATION: It is recommended that the Council: Interview the District 7 applicants according to the parameters approved on January 24, 2006 (copy attached); and at the conclusion of the interview process select a District 7 Council Member. The City Clerk will administer the oath of office and the successful applicant will assume office immediately. The following is a complete list of applicants for the District 7 Council position (applications attached): Curry, Keith Jones, Nancy Otting, Dolores Peotter, Scott Wampole, Daniel If the Council fails to appoint, it is recommended that Council adopt Resolution No. 2006 -_ calling a Special Municipal Election for June 6, 2006 and Resolution No. 2006- Requesting the Board of Supervisors of the County of Orange to Consolidate a Special Municipal Election to be Held on Tuesday, June 6, 2006, with the Primary Election to be Held on the Same Date Pursuant to Section 10403 of the Elections Code. DISCUSSION: Background: At the January 24, 2006 City Council meeting the Council declared the District 7 Council seat to be vacant after the resignation of Council Member John Heffernan. At that time the Council established the parameters for the interview /appointment process and set February 7, 2006 as the date to conduct the interviews and make the appointment. Council Vacancy in District 7 February 7, 2006 Page 2 Even though the term of office does not expire until 2008, consistent with Section 403 of the City Charter, at the next general municipal election following the vacancy (November 2006), a Council Member shall be elected from the district in which the vacancy exists to serve for the remainder of the unexpired term. Pursuant to Section 403 of the City Charter, in the event the Council fails to appoint a successor within thirty (30) days after such office shall have been so declared vacant, an election shall be held to fill the vacancy from the proper district (by February 10, 2006). The next scheduled election is the Statewide Primary election to be held on Tuesday, June 6, 2006. If the Council fails to appoint a new member to District 7 at this meeting the timeframe for calling an election to be held on June 6, 2006 to fill the seat is very tight. The Notice of Election has to be published prior to February 13th and the filing period for candidates is from February 13, 2006 to March 10, 2006. I have contacted the Orange County Registrar of Voters office to determine the cost to consolidate with the Statewide Primary to be held on June 6, 2006. Since there will be a limited number of entities with items on the ballot, the cost to consolidate with this election will basically be the same as if it were a stand -alone election. The cost for a stand -alone election or a consolidated election is $3.00 - $4.00 per registered voter. Based on 60,358 registered voters (as of 1/20/06) the cost for a consolidated or special election would be $181,074 - $241,432. If the Council fails to appoint and a special election is held to fill the vacant seat, the successful candidate will serve the balance of the unexpired term (November 2008). Based on the short time frame, I have prepared the resolutions calling the election for June 6, 2006 and requesting consolidation with the County (copies attached). Date and time of interviews: Tuesday, February 7, 2006 — 7:00 p.m. City Council Chambers 2. Length of interviews: Approximately 25 minutes, with each candidate being offered a 5 minute introduction and a 2 minute closing statement. 3. Order of candidate interviews: Randomly selected, names drawn from a hat. 4. Candidate location: Candidates will be kept together in the Council conference room, will be called into the Chambers for their individual interviews, and will return to the conference room after each interview has been concluded. Candidates will be allowed in the Chambers after the last candidate has been interviewed. 5. Questions: Each Council Member will be allowed to ask each candidate questions deemed pertinent to the selection process. 6. Public Input: The public will be allowed to comment on the candidates and the selection at the conclusion of all the interviews. 7. Selection: Discussion of the candidates will take place after the last interview has been conducted. The selection of the District 7 Council Member will follow the discussion. 8. Each member of the Council will cast one vote. In order to be appointed, the nominee must receive at least four votes. If there is a tie vote, ballots will be distributed to the Council Members to vote for the tying candidates only. In the event that no one receives four votes, applicants receiving zero votes on any vote taken will be dropped. The Council will cast votes from the list of the remaining applicants. For my entire professional career, I have been focused on helping government solve problems, accomplish goals and manage resources better. For nearly 19 years, I have been a financial advisor to state and local governments. I have designed funding programs for transportation projects, education facilities, clean water programs and park and recreation facilities across America. Most recently, I advised on the Orange County Bankruptcy Refunding Bonds that will save taxpayers of our County in excess of $100 million in debt service costs. I have also led consulting engagements designed to identify public /private funding partnerships, implement service delivery enhancements and develop new legislative strategies for the provision of essential government services. In a 30 -year career, I have worked at the city, county and federal levels, including five years in the Reagan Administration, as Special Assistant to the Administrator of the Federal Transit Administration, prior to my current position. I currently serve as President of our trade association, The National Association of Independent Public Finance Advisors, where I am leading the effort to enact tougher securities rules to prevent conflicts of interest when investment banking firms serve as financial advisors. Serving on the City Council would allow me to cap my career by giving back to the city I love, using the skills and knowledge I have garnered over my entire life. Newport Beach is a special place. The quality of life we as citizens enjoy is unrivaled in California. Preserving this quality of life however, requires a diligent, informed and proactive City Council. Our beaches, harbor and bay are vital resources that must be protected and held in trust for future generations. I view service on the Council as entailing a stewardship role for these natural resources. With the potential reauthorization of Measure M, will come the opportunity to address the critical traffic issues in Newport Beach, and I am committed to ensure that Newport Beach receives its fair share of any new revenues. Quality of life comes from a strong and vibrant local economy. I believe the role of the Council is to ensure the continued economic health of our City, in an environmentally sensitive and proactive way. Rising pension costs are a looming problem for all California municipalities. I believe my expertise in municipal finance can assist Newport Beach's taxpayers should employee pensions become a financial burden. Newport Beach has some of the best public employees in the nation, and we must have a long term plan to ensure both economic health of the City and the ability to attract top caliber talent to City employment. Curry is a Managing Director of Public Financial Management and manages the firm's Newport Beach office. Since 1987, Mr. Curry has assisted state and local governments in the issuance of over $11 billion in various types of debt instruments. Among his clients are the Cities of Anaheim, Coronado, Oceanside, Rosemead and Poway, where he has assisted with Certificate of Participation, TRANS, Marks Roos, Mello Roos, Assessment District, Redevelopment, lease financings and significant debt restructuring. He was advisor to the County of Marin, where he developed a AA rated COP credit structure for the new countyjail facility, (the highest rated county COP in California) and the 1997, $500 million Anaheim / Disney Economic Development Financing. This transaction was named "1997 Deal of the Year" by the Bond Buyer. In 2005, he was the advisor to Orange County California in the refunding and restructuring of the County's bankruptcy debt, saving the County more than $100 million. He was the advisor to the Arizona School Facilities Board for their $900 million lease/purchase capital construction program; the Wyoming state treasurer's office for the development of a new statewide school capital construction program; the Massachusetts Department of Highways for innovative design build finance projects; and the Colorado Regional Transit District for financial planning and debt implementation. Mr. Curry has also served as an advisor for major infrastructure and public private development projects for the states of California, Arizona, Washington, Minnesota, Massachusetts, Oregon, New Mexico and South Carolina. As Director of PFM's transportation practice, Mr. Curry has developed and implemented financing strategies for the transportation agencies in Los Angeles, Orange, Ventura, San Diego, San Bernardino, Contra Costa, San Joaquin and Sacramento counties. He has also been an advisor in the development and financing of rail projects in Portland, Phoenix, Dallas, San Diego, Denver and Sacramento. In the area of credit ratings, Mr. Curry has assisted several agencies to either respond to difficult credit situations, obtain high ratings on new security structures or obtain rating upgrades. Among the clients he has assisted are the Cities of Anaheim, Rosemead and Oceanside, the San Diego Metropolitan Transit Development Board, the Los Angeles MTA and the Port of Los Angeles. Mr. Curry was formerly the western states director of public private initiatives and policy advisor to the Administrator of the Federal Transit Administration. He has also served as a Deputy to a member of the Los Angeles County Board of Supervisors and worked in the City Manager's office of Long Beach, California. He has served as a member of the board of directors of the Intermodal Transportation Institute at the University of Denver. Because my grandparents came to Newport Beach in 1921, I spent much of my childhood here, and in 1965 my husband and our children moved to Newport; therefore I feel a deep connection with the community as a whole. I would like to help develop a stronger bond with the residents of Newport Coast and the rest of the City. We contribute financially, and some contribute time and talents, but there is potential for even greater participation to enhance the future of Newport Beach. From 1986 to 19911 served on the Board of the Friends of the Library. In 19911 was appointed as a member of the Library Board of Trustees and served until 1995, during the time of the construction of the Central Library. 'Those 4 years, in particular, gave me some insight into the workings of our City government. I moved to Newport Coast in June of 1995, and became disqualified to apply for reappointment for a second term. This past year I have been serving as the Vice Chair of the Heritage Committee for the Centennial. It has been very satisfying to reconnect with City activities and people. I am a working member of the Environmental Quality Affairs Committee, EQAC, and currently serve as the Vice Chair. Newport Beach is the best place in the world to live and it would be an honor and a privilege to serve as the Councilperson for District 7. It is because of my passion for the community that I ran in the November 2004 election and received 17,108 votes. My opponent, former Mayor and Councilmember John Heffernan, the incumbent, received 20,233 votes and won by only 3,125 votes. As you are aware in his letter of resignation to the Council he endorsed me as his choice to fill his seat. It is because of these 17,000 voters that I am hopeful you will appoint me to be the next Council member for District 7. I have been attending City Council meetings for over a decade. Some of the Councilmembers that I remember being on the Council at one of the first meetings I ever participated in were Jean Watt, Evelyn Hart, Clarence Turner, Phil Sansone, John Cox, Jan Debay and John Hedges. 1 also remember Planning Commission Meetings where now Councilmember Ridgeway was a member on the Planning Commission. It is important for me to say that I feel that I am especially qualified for the position to represent District 7 because I have been participating in our City government for so very long, and I feel that I can "hit the ground running ". Besides City Council Meetings, I have attended GPUC meetings, GPAC meetings, Planning Commission Meetings, EDC meetings, Civil Service Board meetings, Newport Coast Advisory Committee meetings, Santa Ana Heights PAC meetings, as well as the County Santa Ana Heights meetings and the county annexation meetings. I have been an active member of the Community and as a result of my hard work and dedication I have gained not only knowledge, but also the trust and respect of many in our City. Of utmost importance to me is Emergency Preparedness, the containment of JWA, our Harbor and Bay, fiscal conservatism, Public Participation and being a voice of the residents. I aspire to bring the residents back into our government and make them feel welcome and "thank " them for their interest and participation no matter what point of view they may have. I firmly believe in property rights and as a businessperson understand the importance of our businesses and the need to support them. At our NRG meetings we discussed how much $$ could be saved leasing space on Superior, saving millions-and if the City wants to own the building, then buy it! It would be ready and instead of spending money on construction costs, spend it on technology. BUT, your point is correct on services. If our city is not running with efficiency at the current location, what will change the efficiency of the services at a new location? Also, if we just simply do this there is alot of money that will not pass through hands. Our town is a town of a "deserving attitude "..that too is as much a problem. When employees bark at having mobile units not "looking" the part of Newport Beach, while our children have been educated for years now in mobile units due to overcrowding, where is the "deserved" here? Personally I'm sickened by all of this. Our whole city is going to the "deserving" on a slow boat to "stupid choices ". It is a constant battle to keep common sense central in decisions-common sense loses out so often to the "deserving attitude ", the "we have the money so spend it attitude ". What about some idea of saving? I don't know the answer, but I do know that a large percentage of our population expects that someone else will do the job. People have bigger, better, more amazing ideas, with the ability to tell anyone in earshot how to do things, but when it comes down to it..very few are there to do the job unless their is something in it for there -which brings me to another l leaves his position, makes a simple statement that makes sense..have Delores Offing step in. She has been there through the years, always willing to help, always available for a cause, checking facts against words, trying to information to the forefront, but let's drag all this out and throw into the hat people who just stepped out of the ess to now come forward. Some of these running have enough $ backing them to win without merit. Where were people when we were voting for John and Delores? What is now in it for them? Why? Could it be our city hall ruction and someone concerned about losing some $, or support with Delores in office ?? Logically, Dolores would e right choice, even John agrees..Here we go again. Let's get the initiative for spending passed, make everyone accountable for the accounting, get our offices running more efficiently and if a move to a new location needed..head up Superior and call it a day.
