INITIATED BY: City of Newport Beach • ISSUE Should the City Council initiate a General Plan Amendment and Zone Change to establish a General Plan and pre- Zoning Designation of Government, Educational and Institutional (GEIF) for property located at 107 Industrial Way, currently in the City of Costa Mesa? RECOMMENDATION Staff recommends the City Council adopt Resolution No. 2006 -_ initiating the General Plan Amendment and Zone Code Amendment. DISCUSSION Site Description The .42 acre parcel is currently located in the City of Costa Mesa and is owned by the City of Newport Beach. The property is located adjacent to the Newport Beach City Limit, at the southerly corner of the intersection of Superior Avenue and Industrial Way. Newport Beach's General Services Department Corporation Yard is located on an adjacent parcel in Newport Beach and the Corporation Yard General Services' vehicle • fueling station is located on the subject property. General Services Corporate Yard GPA and ZC February 28, 2006 Page 2 Background • • On February 14, 2006, the Council adopted Resolution No. 2006 -15, applying to the Orange County LAFCO to reorganize three areas adjacent to the City, one of which is the subject property. Since the parcel is within the Costa Mesa city limits, reorganization entails detachment of the parcel from the City of Costa Mesa and annexation of it into the City of Newport Beach. The purpose of the reorganization is to facilitate Newport • Beach's administration of the parcel and fueling station, especially in the event the • General Services Corporate Yard GPA and ZC February 28, 2006 Page 3 fueling station is changed or modified to include a compressed natural gas (CNG) fueling station for City vehicles. General Plan Amendment and Zone Change The purpose of the proposed General Plan Amendment and Zone Code Amendment is to establish a General Plan Designation and Zoning Designation for the property prior to its annexation into the City of Newport Beach. Staffs recommendation is that a General Plan and Zoning Designation of Government, Educational, and Institutional Facilities (GEIF) be established for the parcel. This designation is consistent with the current use of the parcel and would allow the future addition of a CNG fueling facility to the site. Surrounding Land Uses The land uses surrounding the subject property are: Northerly: Light Industrial Uses (Per Costa Mesa General Plan) Southerly: Newport Beach General Services' Corporation Yard Westerly: Light Industrial Uses (Per Costa Mesa General Plan) Easterly: Light Industrial Uses (Per Costa Mesa General Plan) • The Vicinity map on page 2 depicts the land use designations of the properties in Newport Beach near the parcel. Environmental Review Requests to initiate General Plan and Zoning Amendments are considered feasibility or planning studies by staff, and are statutorily exempt pursuant to Section 15262 of the Implementing Guidelines for the California Environmental Quality Act. Public Notice Public notice is not required to initiate a General Plan or Zone Code amendment. Should the request be approved by the City Council, the subsequent application will require a noticed public hearing by the City Council. THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH HEREBY FINDS, RESOLVES AND ORDERS AS FOLLOWS: WHEREAS, the property at 127 Industrial Way is currently located within the Costa Mesa City Limits but is owned by the City of Newport Beach and is part of the Newport Beach General Services Department's Corporation Yard. WHEREAS, to facilitate current and future use and administration of the site, the • City intends to pursue detachment of the parcel from the City of Costa Mesa and annexation of the property into the City of Newport Beach. WHEREAS, the proposed General Plan Amendment and Zone Code Amendment will establish a General Plan Designation and Zoning Designation for the property prior to its detachment and annexation into the City of Newport Beach WHEREAS, to ensure consistency with current and future operation of the site, the City intends to establish a General Plan and Zoning Designation of Government, Educational and Institutional Facilities (GEIF) for the subject property. WHEREAS, City Council Policy K -1 establishes that amendments to the General Plan that are not part of a development application shall be initiated by the City Council. • I U City of Newport Beach City Council Resolution No. Paqe 2 of 2 WHEREAS, Section 20.94.020 of the Newport Beach Municipal Code establishes that amendments to the Zoning Code shall be initiated by the City Council. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby initiates a General Plan Amendment (GPA 2006 -002) to establish a pre- annexation General Plan land use Government, Educational and Institutional Facilities (GEIF) for the subject property. Additionally, the City Council hereby initiates Code Amendment No. 2006 -003 to establish a zoning designation of Government, Educational and Institutional Facilities (GEIF) for the subject property.
