HomeMy WebLinkAbout23 - Hoag Hospital Ad Hoc CommitteeCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 23 May 23, 2006 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Planning Department James Campbell, Senior Planner 949 - 644 -3210; jampbell@city.newport- beach.ca.us SUBJECT: Establishment of an Ad Hoc Committee for negotiating an amendment to the Hoag Hospital Development Agreement RECOMMENDATIONS 1) Adopt the attached resolution creating an Ad Hoc Committee for negotiating an amendment to the Hoag Hospital Development Agreement to consist of two (2) Council Members; and 2) Confirm the Mayor's appointments of and to the Committee. BACKGROUND In 1994, The City entered into a development agreement with Hoag Memorial Hospital to provide for the orderly development of the planned hospital expansion. The stated purpose of the agreement was to enable Hoag to adapt to the ever changing health care needs of the community by authorizing new and remodeled facilities while providing safeguards to avoid environmental impacts to the extent feasible. Additionally, exactions were imposed to provide general public benefits. At the same time, the City adopted the Hoag Memorial Hospital Presbyterian Planned Community Development Criteria and District Regulations that act as the implementing regulations of the General Plan and the development agreement. Hoag has requested a General Plan Amendment and an amendment to the Planned Community regulations to transfer building area from the lower campus to the upper campus. The request is in response to the changing needs of the health care industry and Hoag's ability to meet that need. Based upon the nature of the requested changes, the project requires an amendment to the approved development agreement. Establishment of an Ad Hoc Committee Hoag Hospital Development Agreement May 23, 2006 Page 2 DISCUSSION Staff is suggesting that an ad hoc committee be established by the Council to negotiate the terms and conditions of the proposed amendment to the existing development agreement. The committee should be comprised of 2 or 3 Council Members although a different composition can be considered. The attached draft resolution establishes the Committee with 2 Council Members. Committee members would be appointed by the Mayor and the duration of the committee will be fairly short as staff hopes to conclude the process within the next 90 days. Environmental Review Establishment of an ad hoc committee is not a project as defined by the California Environmental Quality Act, so no environmental review is required. Public Notice No public notice is required for this consideration. However, this item is on the City Council Agenda, which is posted at City Hall, and is also available on the City's web site. Temple, Pifinning Director RESOLUTION NO. 2006- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING THE AD HOC COMMITTEE TO NEGOTIATE AN AMENDMENT TO THE HOAG HOSPITAL DEVELOPMENT AGREEMENT. WHEREAS, the City of Newport Beach and Hoag Memorial Hospital Presbyterian entered into a Development Agreement in 1994 for the expansion of Hoag Hospital; and WHEREAS, the City of Newport Beach adopted the Hoag Memorial Hospital Presbyterian Planned Community Development Criteria and District Regulations to implement the General Plan and the development agreement; and WHEREAS, Hoag Memorial Hospital is seeking an amendment to their Master Plan to facilitate a transfer building area from the lower campus to the upper campus; and WHEREAS, the proposed amendment of the Hoag Hospital Master Plan requires an amendment of the Land Use Element of the General Plan, an amendment of the Planned Community Development Criteria and District Regulations and an amendment to the approved development agreement; and WHEREAS, the City Council recognizes the need to consider the request of Hoag Hospital in a manner consistent with the original intent and purpose of the Development Agreement. NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: Section 1. Establishment An Ad Hoc Committee is hereby established for the purpose of negotiating an amendment to the Hoag Memorial Hospital Presbyterian Development Agreement. Section 2. Duties of the committee The Committee shall have the following duties: a) Work with City staff and designated representatives of Hoag Memorial Hospital Presbyterian on possible amendments of the terms and conditions of the Hoag Memorial Hospital Presbyterian Development Agreement adopted by Ordinance No. 94 -8. b) Recommend to City Council action on potential amendments of the terms and conditions of the Hoag Memorial Hospital Presbyterian Development Agreement Section 3. Composition of the Committee The Committee shall consist of two (2) City Council Members appointed by, and serving at the pleasure of, the Mayor. Section 4 Duration of Committee The Committee shall expire at such time as the Committee completes its negotiations with Hoag Memorial Hospital Presbyterian and its recommendations on potential courses of action are transmitted to the City Council for consideration.
