HomeMy WebLinkAbout12 - Restroom Cleaning AgreementCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 122 May 23, 2006 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: General Services Department Mark Harmon, Director, 949 - 644 -3055 mharmon @city.newport- beach.ca.us SUBJECT: Amendment to the Restroom Cleaning Agreement with A -1 Spinelli Enterprises ISSUES: Should the General Services Department amend the contract with A -1 Spinelli for the weekend cleaning of public restrooms? RECOMMENDATION: Approve the contract amendment for weekend restroom cleaning through October 31, 2006 at a new price of $3,508 per month. DISCUSSION: The City Council approved a contract with A -1 Spinelli Enterprises for the Saturday and Sunday cleaning of beach and park restrooms in February of 2001. The contract was an annual contract, with the ability to be automatically renewed on an annual basis four times. Prior to that time, restrooms had been cleaned by City forces seven days per week, utilizing regular staff Monday through Friday and part - time employees on Saturday and Sunday. Due to difficulties in retaining employees willing to work two weekend days each week of the year, staff decided to utilize a contractor to provide these services. This arrangement has worked well, and the contractor continues to perform at a high level. In March of this year, A -1 Spinelli Enterprises requested an increase in compensation from $3,290 to $3,508 per month due to additional costs related to increases in the cost of fuel, insurance (worker's compensation and liability), and miscellaneous items. When staff reviewed the agreement to examine any provision for increases, we discovered the agreement had expired on February 27 of this year. Amendment to the Restroom Cleaning Agreement with A -1 Spinelli Enterprises May 23 2006 Page 2 Staff entered into a discussion with the City Attorney's Office, and since A -1 Spinelli is already on -board and performing well, it was decided to seek an amendment to their existing contract with the requested rate increase for a short period, and in the interim seek bids for the service with the intent of returning to Council for approval of a new contract later this year. Consequently, attached is a draft agreement for approval for the weekend maintenance of public restrooms through October 31, 2006 at the revised price of $3,508 per month. FUNDING: Adequate funding is available in the Operations Support Division budget for this service. ENVIRONMENTAL REVIEW: This action requires no environmental review, as it is not a project pursuant to CEQA. ONE TO CONTRACTOR AGREEMENT WITH A -1 SPINELLI ENTERPRISES FOR MAINTENANCE OF BEACH AND PARK RESTROOMS THIS AMENDMENT NO. ONE TO CONTRACTOR AGREEMENT, entered into this 1st day of May, 2006, by and between the CITY OF NEWPORT BEACH, a municipal corporation, (hereinafter referred to as ( "City ") and A -1 SPINELLI ENTERPRISES, whose address is 370 S. Lilac Court, Anaheim Hills, California, 92808 ( "Contractor "), and is made with reference to the following: RECITALS A. On February 21, 2001, CITY and Contractor entered into a Contractor Agreement, hereinafter referred to as "Agreement', for maintenance of beach and park restrooms, hereinafter referred to as "Project'. This Agreement expired February 27, 2006, after four (4) one (1) year extensions. B. Since February 21, 2006, Contractor has continued to provide services to the City and has been compensated for said services at the rate of $3,508 per month. C. City desires to enter into this Amendment No. One to reflect additional costs and services not included in the Agreement or prior Amendments and to extend the term of the Agreement to October 31, 2006. D. City desires to compensate Contractor for additional professional services needed for Project. E. City and Contractor mutually desire to amend Agreement, hereinafter referred to as Amendment No. One, as provided here below. NOW, THEREFORE, the parties hereto agree as follows: 1. Contractor shall be compensated for costs and services performed pursuant to this Amendment No. One for maintenance of beach and park restrooms described in the Agreement. 2. Contractor acknowledges that Contractor has been fully compensated for all services provided to the City from February 27, 2006 to May 1, 2006. 3. Total additional compensation to Contractor for services performed pursuant to this Amendment No. One for all work performed in accordance with this Amendment from May 1, 2006 through October 31, 1 2006, including all reimburseable items and subcontractor fees, shall not exceed $3,508 per month and shall not exceed a total of Twenty One Thousand Forty -Eight Dollars and 00/100 ($21,048.00). 4. The term of the Agreement shall be extended October 31, 2006. 5. Except as expressly modified herein, all other provisions, terms, and covenants set forth in Agreement shall remain unchanged and shall be in full force and effect.
