Webb, Public Works Director- (949) 644 -3330, dawebb @newportbeachca.gov PREPARED BY: Fong Tse, Assistant City Engineer PHONE: (949) 644 -3321 TITLE: Multiple Buildings Painting Project —Award of Contract C -6013 (CAP15 -0047) ABSTRACT: Staff has received acceptable bids for the Multiple Buildings Painting Project and is requesting City Council's approval to award the contract to Tony Painting, Inc. of Garden Grove, California. RECOMMENDATION: a) Approve the project specifications and drawings; b) Declare the apparent low bidder ENL Service, Inc. as non - responsive; c) Award Contract No. 6013 to Tony Painting, Inc. for the total bid price of $191,500.00, and authorize the Mayor and City Clerk to execute the Contract; and d) Establish an amount of $19,000.00 (10 %) to cover the cost of unforeseen work not included in the original contract. FUNDING REQUIREMENTS: Sufficient funding is available in the Facilities Maintenance Project Account No. 7480- C1001000 as follows: Account Description Facilities Maintenance Account Number 7480- C1001000 Proposed uses are as follows: Vendor Purpose Tony Painting, Inc. Construction Contingency Amount $ 210,500.00 Total: $ 210,500.00 Amount $ 191,500.00 $ 19,000.00 Total: $ 210,500.00 12 -1 DISCUSSION: In 2013, the City contracted with AMEC Environmental & Infrastructure, Inc. (AMEC) to inventory, inspect, assess, rate, prioritize, cost, and generate an electronic database known as the Facilities Maintenance Master Plan (FMMP) for the City's eighty -eight (88) buildings. AMEC inspected and tabulated a total of 499,594 square feet of floor space, excluding the newly opened Civic Center. The inspections included all of the buildings' major components such as Mechanical, Electrical, Flooring, Interior Finishes, Plumbing, Structural, Fire Protection, Stairs, Site Improvements, Exterior Finishes, Roofing, and Exterior Enclosures. The FMMP then assigned a Condition Index (CI) to each of the building components to reflect their condition at the time of inspection. The Cl ranges between "0" and "100 ", with "100" being the highest possible score. The overall CI for the inspected City facilities was 73 ". It is a good practice to maintain the Cl above "85 ". Public Works staff has assembled a more orderly and proactive maintenance approach using this FMMP. Rather than improving one building at a time, it was determined to be more cost effective to address the deficiencies by Trade to take advantage of the economies of scale. Of the different building components that need attention, the FMMP identified Interior Finishes, Exterior Finishes, Flooring, and Back -Up Generators as the areas that should be addressed first as they are on an accelerated deterioration path. Accordingly, staff prepared the contract documents for the twenty (20) buildings that need paint work within the next three years. These buildings are: 1. Newport Pier Restrooms (72 McFadden Place) 4. 58th Street Restrooms (58th Street at Seashore Drive) 5. Orange Street Restrooms (Orange Street at Seashore Drive) 6. Channel Place Park Restrooms (Channel Place at River Avenue) 7. Eastbluff Park Restrooms (Vista Del Oro at Hacienda) 8. Bob Henry Park Restrooms (Dover Drive at Castaways Lane) 9. Buck Gully Restrooms (Little Corona Beach below Ocean Blvd / Poppy Avenue) 10. Irvine Terrace Park Restrooms (Seadrift Drive) 11. Corona Del Mar State Beach Restrooms (Corona Del Mar State Beach) 12. Port Westbourne Place Restrooms (Port Westbourne PI at Port Bartmouth PI) 13. Port Carney Place Restrooms (Port Carney Place at Port Bishop Place) 14. (ENL), the apparent low bidder at the time of bid opening submitted the attached Letter requesting to withdraw its bid from the Project. Upon discussions with staff, ENL disclosed that their staff made a clerical error and did not include all of the costs required to complete the work specified for the Restroom Buildings. Staff subsequently independently confirmed ENL's assertion and feels that it is in the City's best interest to declare ENL's bid as non - responsive and dismiss ENL from the Project. Staff then contacted the second low bidder, Tony Painting, Inc., (Tony Painting) to determine their interest on this Project. Tony Painting confirmed that they are interested in entering into a contract with the City and that their bid as submitted is inclusive of all costs. Tony Painting's total bid amount is approximately 45% below the $350,000.00 Engineer's Estimate. The public agencies staff contacted for references confirmed that Tony Painting also underbid their projects. Tony Painting possesses a "C -33" Painting and Decorating California State Contractor License. The project specifications require either a Building "B" or a "C -33 ". A check of Tony Painting's references indicated satisfactory completion of similar building painting projects for other public agencies. Pursuant to the Contract Specifications, Tony Painting is (1) required by the California Labor Code to pay prevailing wage rates, (2) allotted 125 working days to complete the Project with a stipulation that all required restroom work along the coast shall be completed before the Memorial Day holiday or a $1,000 per calendar day liquidated damages assessment will be applied, and (3) required to provide two (2) ADA compliant portable restrooms when a public restroom is closed for the work. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this project exempt from the California Environmental Quality Act ( "CEQX) pursuant to Section 15301 (minor alteration of existing public facilities with negligible expansion) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
