This may result in higher levels of crime activity and cause impacts to the area's quality of life when compared to other communities in the City. The City Council has different options available for addressing these concerns. RECOMMENDATION: Direct staff to proceed with the following approaches for addressing concerns associated with businesses that serve alcoholic beverages on Balboa Peninsula: Part 1 - Maintain existing City regulations and work with restaurant and bar owners /managers on a voluntary basis to improve management/operations; Part 2 - Hold quarterly meetings with Mayor Pro Tern Dixon, interested residents, representatives from the restaurant and bar committee, and Police and Community Development staff; and Part 3- If budget resources are available, increase Police presence at key times and seasons on the Balboa Peninsula. FUNDING REQUIREMENTS: Part 1 - Maintain Existing City Regulations and Work with Restaurant and Bar Owners/Managers on a Voluntary Basis to Improve Management/Operations: This option will require staff time to attend monthly meetings and can be accommodated within existing department budgets. Part 2 - Hold Quarterly Meetings with Mayor Pro Tern Dixon, Interested Residents, Representatives from the Restaurant and Bar Committee, and Police and Community Development staff. This option will require staff time to organize and attend the quarterly meetings and can be accommodated within existing 18 -1 department budgets Part 3 - Increase Police presence on Balboa Peninsula: This option includes the addition of four new positions (one Police Sergeant and three Police Officers) to be dedicated to Balboa Peninsula. The corresponding cost estimate is $565,000 for salaries and benefits (an annual operating cost), plus an additional $7,700 in uniform and equipment costs. At the March 10, 2015 City Council Study Session, Council reviewed statistics for Balboa Peninsula including the number of Alcoholic Beverage Control (ABC) licenses, crime trends, and quality of life issues. There are presently 100 restaurants, bars, lounges, and nightclubs on Balboa Peninsula that serve alcoholic beverages (Attachment CC 1), of which 26 are open past 11 PM. The Police Department statistics identified Balboa Peninsula as the single busiest area in 2014, and the busiest time for Police calls was Saturday nights from 10 -11 PM. An overview of the City's current regulations for businesses that serve alcoholic beverages was also presented, including the Operator License requirement which Council adopted in 2011. It was noted that there are four approved /active Operator Licenses for businesses on Balboa Peninsula. A copy of the presentations from the study session are included in Attachments CC 2 and CC 3. Staff presented different options for Council consideration in respect to regulations. The options were: Option 1A- Maintain Existing City Regulations and Work with Restaurant and Bar Owners /Managers on a Voluntary Basis to Improve Management/Operations: • Form a Balboa Peninsula Restaurant and Bar Committee. This committee would be established by the business owners. • Mayor Pro Tern Dixon and Staff from Police and Community Development Department could attend the meetings as invitees. • Meet Monthly to Discuss Common Issues and Solutions. • Develop Best Practices for Management and Operation. • Staff to Provide Status Report to City Council in six months. • Zoning Administrator to Refer all Use Permit Applications to the Planning Commission for review and action. This option can be accomplished within existing department budgets and can be implemented immediately. Option 1B- Hold Quarterly Meetings with Mayor Pro Tern Dixon, Interested Residents, Representatives from the Restaurant and Bar Committee, and Police and Community Development staff. • City staff will conduct the meetings, which will be open to the public. • Review recent Police Department activities. • Report on the Restaurant and Bar Committee activities. • Report on pending Use Permit applications. This option can also be accomplished within existing department budgets and can be implemented immediately. 18 -2 Option 2- Create an Overlay District for Balboa Peninsula applicable to Restaurants and Bars that serve Alcoholic Beverages. Potential district components may include: • Require all New Businesses to obtain a Conditional Use Permit that is reviewed and approved by the Planning Commission. • Require a Conditional Use Permit for any change in operations for an Existing Business. • Add new operational standards; particularly for businesses open past 11 PM (in conjunction with a Conditional Use Permit). • Establish economic incentives for restaurant and bar owners such as fee waivers, fagade improvement grant program, and parking relief- as examples. The amendments to the Municipal Code would take approximately four to six months to complete and can be accomplished within existing department budgets. The proposed economic incentive program may take six to nine months to complete; the overall budget needs will not be known until such time the precise incentives are identified. For example, the Balboa Village Fagade Improvement Program is proposed to be funded at $220,000. This option is not recommended at this time. Option 3- Increased Police Services Although not discussed in detail at the Council study session, increased Police services on Balboa Peninsula are an important component in addressing the identified public safety and quality of life concerns. Conclusion Addressing the crime trends and quality of life issues that exist on Balboa Peninsula requires a multi - pronged approach. Several business owners and managers have already expressed their intent to form a committee to address the concerns on a voluntary basis and to work with City representatives. Therefore, staff recommends proceeding forward with Options 1a and 1b, as well as Council consideration of Option 3 should budget resources be available. ENVIRONMENTAL REVIEW: The proposed action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Section 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
