SUBJECT: Rescission of Resolution 99 -4, a prior acceptance of the dedication of
Bayview Landing Parcels A & B.
ISSUE:
Should the City Council rescind Resolution 99 -4, a prior acceptance of the dedication of
Bayview landing Parcels A & B?
RECOMMENDATION:
Adopt a Resolution rescinding Resolution 99 -4.
DISCUSSION:
In January 1999, the City Council adopted Resolution 99 -4 to accept the dedication of
Bayview Landing Parcels A & B. The parcels constituted the portion of the Bayview
Landing property that was to be dedicated as park land through Circulation and Open
Space Agreement (CIOSA) between the City of Newport Beach and The Irvine
Company. The transfer and dedication of the park property has since been completed
through subsequent agreements between The City of Newport Beach and The Irvine
Company superseding the 1999 Resolution, making its rescission necessary.
Environmental Review: The rescission of Resolution 99 -4 is not a project as defined by
CEQA. Any proposal that would meet this definition would be subject to environmental
review.

RESOLUTION NO. 99 -4
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ACCEPTING THE DEDICATION OF BAYVIEW
LANDING PARCEL A AND PARCEL B OF PARCEL MAP 95 -137
(RESUBDIVISION NO. 1041) AS RECORDED IN THE OFFICE OF THE
ORANGE COUNTY RECORDER.
WHEREAS, the City of Newport Beach approved Parcel Map 95 -137 (Resubdivision No.
1041) on December 14, 1998, which established Parcels A, B and C; and
WHEREAS, Parcel A and Parcel B are offered to the City by the Irvine Company as
open space parcels in conformance with the requirements of the "Circulation Improvement and Open
Space Agreement" (CIOSA) executed between the Irvine Company and the City of Newport Beach; and
WHEREAS, the dedication of the open space parcel must be accepted by the City of
Newport Beach before it can be opened to the general public; and
WHEREAS, the open space parcels are legally described as Parcel A and Parcel 8 of
Parcel Map 95 -137.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport
Beach that the dedication of the open space Parcel A and Parcel B of Parcel Map 95 -137 is hereby
accepted in conformance with the requirements and conditions set out in the CIOSA; and
BE IT FURTHER RESOLVED that the Mayor be authorized to execute the Resolution of
Acceptance, to be recorded in the Office of the Recorder of the County of Orange.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH RESCINDING RESOLUTION 99 -4 ACCEPTING THE DEDICATION OF
BAYVIEW LANDING PARCEL A AND PARCEL B OF PARCEL MAP 95 -137
(RESUBDIVISION NO. 1041) AS RECORDED IN THE OFFICE OF THE
ORANGE COUNTY RECORDER.
WHEREAS, by adopting Resolution 99 -4, the City Council initiated the
acceptance of the dedication of the Bayview Landing park parcels on the 25th
day of January, 1999; and
WHEREAS, the City Council has determined that the transfer and dedication of
the park property has since been completed through a subsequent Offer of
Dedication, executed April 2006, between The City of Newport Beach and The
Irvine Company superseding the 1999 Resolution, making its rescission
necessary;
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Newport Beach, that:
Resolution No. 99-4, accepting the dedication of Bayview Landing Parcels A & B
is hereby rescinded.
