Badum 949 -644 -3311 or sbadum (d)city.newport- beach.ca.us SUBJECT: PELICAN HILLS RESORT — EXTENSION OF ROAD CLOSURE OF PELICAN HILL ROAD SOUTH ISSUE: Should the City approve the requested extension to the existing Temporary .Street Closure Permit, to allow for the continued closure of Pelican Hill Road South until the anticipated completion date of September 2008, or until City staff considers the roadway safe to re -open? RECOMMENDATION: The continued roadway closure will eliminate potential safety issues associated with the current poor roadway condition and conflicts with construction traffic; maintain emergency access; continue the segregation of resort construction traffic from residential traffic; speed the completion of the development project which will reduce impacts on adjacent residents; and provide a newly reconstructed roadway at the close of construction. TIC has given the City a revised schedule that indicates the parking garages, and some of the key infrastructure, may be completed by September.2007, which may provide an opportunity to safely re -open the roadway. However, due to the projected levels of ongoing construction traffic that would still be present after September 2007, it may be appropriate for the City to revisit the closure at that time. Therefore, staff recommends the continued closure of Pelican Hills Road South until September 30, 2007, with the provision that the roadway closure permit be reviewed by City Council at that time to determine if the roadway can be safely re- opened to the public. Staff also recommends the following conditions: • Maintain 2417 emergency access through the ,project on Pelican Hills Road South. The roadway cannot be blocked for any reason. • Pelican Hills Resort - Proposedod Closure at Pelican Hill Road South November 14, 2006 Page 2 • Manned entry gates at each end of the closure shall be maintained 2417. • Detours, crossovers, or alternative routes through the roadway construction zone shall be clearly signed and maintained. • All excavation within the roadway shall be backfilled and /or plated at the close of daily construction. • Fire hydrants, with adequate water pressure, shall be maintained within the roadway construction area. • Project construction traffic shall continue to access the project from Pelican Hills Road South and Newport Coast Drive intersection. No construction access shall be allowed from the northerly entrance at Pelican Hill Circle. • The roadway shall be fully reconstructed upon completion of work, as determined by City staff, so that the new roadway would not be damaged by construction traffic. • The City and TIC shall monitor the construction progress and meet regularly to determine when the roadway may be safely re- opened. DISCUSSION: On January 10, 2006, the City Council directed staff to issue a Temporary Street Closure Permit to close Pelican Hill Road South during portions of the construction at the Pelican Hills Resort, subject to the road reopening by September 1, 2006. Staff has received a request, copy attached, from The Irvine Company (TIC) seeking approval of a continued closure of Pelican Hill Road South due to ongoing construction operations and public safety concerns. The request is for the closure to continue until September 2008, or until it is considered safe to re -open. Staff has also received a letter from the Pelican Hill Community Association, copy attached, opposing a further closure of the road. This letter outlined several concems including emergency access and potential emergency evacuations; traffic accident issues at the intersection of Pelican Hills Drive North and Newport Coast Drive; resident inconvenience; and environmental review concerns. A public workshop was held on September 20, 2006 to discuss the request and these specific issues. The primary issue raised at that meeting was emergency access and potential to obstruct emergency evacuations in the event of a wildfire in Buck Gully. Other issues raised and discussed by some of the residents included the inconvenience of the closure and potential conflicts with the County approved EIR for the project. Staff has also received emails and telephone communications from several residents of Pelican Crest and Montecito neighborhoods supporting the closure of the roadway. They feel that the closure allows the project to be completed quicker with reduced dust and noise impacts to their community. They are also concerned with the impacts of night construction safety lighting if the roadway were to remain open to the public during construction. • Pelican Hills Resort - Proposed Rolosure at Pelican Hill Road South November 14, 2006 Page 3 Ememencv Access The current road closure permit was conditioned to provide for 24 -hour emergency access on Pelican Hill Road South. This condition requires that a clear access route must be maintained at all times during construction and after hours. Public Works staff routinely inspects the roadway construction to ensure that this occurs and that all open excavations are filled in or plated during non - construction hours. To date, staff has not observed any violation of the permit conditions. The proposed closure extension was recently discussed with the Fire and Police Departments. The Fire Department reviewed the project location and indicated that the closure would not likely affect primary response times for equipment stationed in Newport Coast or Newport Center, but could delay supplemental units coming from Corona del Mar or Laguna Beach. Police patrols are by beat assignment so units responding to emergency calls can literally be anywhere in the general area of the event. Emergency response times in the Pelican Hill neighborhood could be minimally impacted if the responding police units were in the southern portion of their beat at the time of the call, such as in the area of Coast Highway and Crystal Cove. To address these concerns, TIC has recently posted 24 -hour guards at each end of the roadway closure. With the manned entrances and continued diligence by Public Works inspection staff, unfettered emergency access is available to Police and Fire (and residents in the event of an evacuation) which effectively mitigates all the public safety concerns. Pelican Hills Road North and Newport Coast Drive Intersection Several residents have voiced concerns over additional traffic congestion and accident potential at this intersection due to the closure. The intersection is currently operating at level of service "A° (the highest traffic flow level) during both the peak am and pm traffic flows. City staff has monitored this intersection and have not observed any problems with traffic congestion that would warrant mitigation. Left turn lanes at the intersection have sufficient capacity based upon the current or projected demands. TIC is constructing ten substantial building sites simultaneously to reduce the overall time of construction. The large volume of construction vehicles, material deliveries, and worker vehicles are currently restricted to accessing the site from the Pelican Hills Road South /Newport Coast Drive intersection. This action eliminates any additional resort construction traffic on Pelican Hills Road North. It should be noted that the closure at the northerly end of the project provides the mechanism to prohibit resort construction traffic on Pelican Hills Road North. If the roadway was to be reopened to the public, the City cannot prohibit resort construction access on this portion of the roadway. Construction traffic would legally be entitled to use the Pelican Hills Road North per current State DMV codes. Pelican Hills Resort - Proposeod Closure at Pelican Hill Road South November 14, 2006 Page 4 City staff has reviewed the accident history for the Pelican Hill Road North /Newport Coast Drive intersection and have found no evidence of any accidents that Could be attributed to the closure. A review of the accident files (2003 -2006) and traffic volumes show that the calculated accident rates for this intersection on Newport Coast Drive are consistent with the accident rates at similar intersections on MacArthur Boulevard and Jamboree Road. Resident Travel Inconvenience With the extension of the closure, residents would have to continue to use Pelican Hill Road North to reach Newport Coast Drive, as can be seen on the attached vicinity map. Calculations show that the time it takes for a resident to travel from Pelican Hill Circle to the Newport Coast Drive /Pelican Hill Road South intersection is the same regardless of whether the driver takes Pelican Hill Road South or Pelican Hill Road North. This is based on a construction speed limit of 25 mph for Pelican Hill Road South versus the posted speed limit of 50 mph for Pelican Hill Road North and 60mph for Newport Coast Drive. With the travel time roughly equivalent, it would not be prudent to mix residential traffic with construction traffic unnecessarily. Another factor that needs to be considered is the present condition of the roadway surface. As part of the current construction work, Contractors are Continuing with the construction of the bridge over the roadway near the Newport Coast Drive intersection. During earlier grading operations, the Contractors moved approximately a quarter million cubic yards of soil from one side of the road to the other. The project work that has occurred to date has considerably damaged the roadway surface on Pelican Hill Road South. Additionally, there is ongoing work within the roadway to install electrical, telephone, and cable service; realigned storm drains, install two signalized intersections, and construct several driveway entrances. The present condition of the roadway, and the ongoing construction work, would make traveling on Pelican Hill Road South unsafe for the public. At the conclusion of the project and /or when the heavy construction is Completed, TIC will be reconstructing the street including curbs. medians, repaving and re- landscaping. The reconstruction will be one of the last efforts in order to protect the final product from heavy construction traffic. As stated above, TIC is constructing ten substantial building sites simultaneously to reduce the overall time of construction. However, that action causes large volumes of Construction vehicles, material deliveries, and worker vehicles to be present on Pelican Hills Road South, which would further impede safe and expeditious passage through the construction zone if the roadway was open to the public. Environmental Documentation Concerns The Pelican Hill Community Association letter raised concerns over the closure and environmental documentation for the project. Here, the only issue being analyzed is whether the proposed closure of the roadway is a project for purposes of CEQA, • Pelican Hills Resort — Proposed R losure at Pelican Hill Road South November 14, 2006 Page,5 because all other environmental issues were fully analyzed in the Pelican Hill Resort Supplemental Environmental Impact Report. The closure of a roadway would not constitute a project under CEQA because, among other things, there is no potential for a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. In any event, even if the road closure were deemed a project for purposes of CEQA, in this_ case the project would be considered categorically exempt under 14 California Code of Regulations §§ 15301, 15302. 153061(b)(3). Construction Project Proposed Extension of Road Closure — Pelican Hill Road South Dear Mr. Badum: This letter is submitted by way of formal request to continue the temporary closure of Pelican Hill Road South due to ongoing construction operations and related public safety concerns. As you know, the request to temporarily close the road was granted by the City until September of this year. The closure of Pelican Hill Road South thus far has enabled the Company to complete mass grading operations in the most expeditious manner possible and has, moreover, allowed us to do so without risk to public safety. It has also enabled us to obviate the need for any project - related traffic access from the north of Pelican Hill Road — something about which you will recall we received several formal complaints in the early stages of this project. Owing to various permit issues and delays in the granting of agency approvals, the proposed `street improvement' work in and around Pelican Hill Road South is taking longer than originally anticipated and will not be complete until April of 2007. In addition, the Company is currently gearing up to start work on all `vertical' components of construction which, as you know, straddles Pelican Hill Road South. The project is of considerable size and complexity and demands that several general contractors work simultaneously on all. components in order to achieve our opening date and minimize the period of disruption and construction operations. Due to the highly constrained nature of the site, we expect that both sides of both the northbound and southbound lanes of Pelican Hill Road South will be utilized for parking. In addition, we. must, of course, afford access for construction plant and machinery, and site deliveries. The attached exhibits summarize the various conditions of Pelican Hill Road and the key construction access points required for the duration of the construction project. Lane closure will be necessary as shown in order to complete construction of the bridge. Additionally, all proposed construction access and crossover points would need to be signaled and flagged. Finally, the entire street would be a designated construction zone and therefore require speed restriction. The combination of the above impacts serve to create not only a significant risk to public safety, but also a massive inconvenience to those using this route, to the extent that it would be far more expeditious for the public to continue to use the current Newport Coast Drive alternative. In summary, we submit that the continued closure of Pelican Hill Road South provides: • A safer construction site and dramatically decreased risk of public accident • Zero project - related construction traffic along Pelican Hill Road North • Reduced public frustration due to street diversions and wait times • A more expeditious construction schedule Finally, the continuation of the closure of Pelican Hill Road South is consistent with applicable environmental restrictions. Specifically, Mitigation Measure MM -3 of Final EIR 524 prohibits encroachment of staging areas into the public right -of -way. The measure was intended to prevent encroachments into the public right-of-way that interfere with simultaneous use by the public. However, if the closure of Pelican Hill Road South is extended, it will not be open for public use during construction, and the intent of the measure will be met. Moreover, the Irvine Company's contractors will not be using the public right -of -way for a construction staging area; rather, the continuation of the road closure would be intended to protect the safety of the public and the construction crews. We respectfully request the City's consideration of a continued closure of Pelican Hill Road South until our anticipated completion date of September, 2008 or until it is considered safe to re- open. Meantime, and subject to your consideration of our request, we plan to engage in dialogue with the affected HOAs in the vicinity ahead of the City Council hearing. We are keen to discuss further the most appropriate forum for that discussion, and, indeed, the list of invitees. Thank you for your consideration of the above. The continuing closure represents an intolerable safety hazard which puts .the residents and their property at risk. The possibility that a real estate developer can monopolize a public roadway for a period of potentially three years or more is both unprecedented and an affront to the residents of Newport Coast who paid for the construction of this road without any financial contribution by The Irvine Company. On January 6, 2006, the City Council granted a Temporary Street Closure Permit over the strenuous objection of the community for a period of approximately seven months. The Irvine Company assured the Council that during the seven month period it would complete its grading and construction of the bridge and reopen the road by September 1, 2006. This date has now passed and the road remains closed to the public. Obviously the Council was misled and now The Irvine Company, without justification or an explanation regarding its seven month representation, now seeks to further burden the residents with a closure of an additional two to three years. This request should be denied because it seeks to place the financial interests of a developer above those of the more than 7,000 residents of the Newport Coast who paid 100% of the cost of building the road. The Irvine Company, at the City Council hearing, claimed that the road closure was necessary because of the need to move a high volume of earth across the roadway which would involve thousands of road crossings by heavy equipment. That has now been completed. The only other justification offered was the need to divert traffic while the falsework for the bridge was erected, and again when it was time to be removed. This alone does not justify a further closure. The bridge has not been worked on for months and once The Irvine Company gets around to removing the falsework, it would only require a closure of two to three days and certainly not for two or three years. In addition to the inconvenience of not being able to access Newport Coast Drive and Pacific Coast Highway from the southern portion of the road, the road closure creates additional traffic and congestion to the north where residents must deal with traffic going to and from the Montecito and Pelican Crest communities, and in the case of Pelican Crest, there is and will be considerable construction traffic for several more years. In addition, construction of the Vista Del Lago project on Pelican Hill Road North creates further congestion and hazards. We urge you to consider these facts: 1. Pelican Hill Road is a public roadway. It was paid for by the residents in Newport Coast through their Assessment District taxes and they will continue to pay for several more years. It is unfair to the taxpayers here to allow the roadway to be closed for the private benefit and gain of The Irvine Company. 2. The Pelican Hill community is located in a Very High Fire Hazard Severity Zone, requiring that our homes have interior sprinkler. systems installed, that our streets have fire lanes and that our slopes have Fuel Modification Zones. The Laguna Beach fire traveled all the way to Newport Coast and burned the slopes and landscaping in our neighboring community immediately across Newport Coast Drive. If a similar fire occurred here, the 400 residents from the neighborhoods here would be scrambling in a panic to evacuate the area from a single access point along a two -lane road. We demand to see the Fire Department's endorsement of this plan and any official studies that support it because it would be completely inconsistent with all of the Department's historical efforts to promote fire safety here. 3. The Pelican Hill DrivefNewport Coast Drive intersection has been the site of several traffic accidents this year alone, and a cement mixer overturned there a couple of years ago. Any increase in traffic beyond what is already considered excessive would be unbearable. Even if The Irvine Company attempts to restrict resort construction traffic to Pelican Hill Road South, there is no guarantee that it will take place. Some portion of traffic coming from north County and beyond will use this fast and closest access point. Our community has already experienced a similar situation at Newport Coast Elementary School, where despite numerous complaints from families and school officials to restrict construction traffic along Ridge Park Road, it has continued to threaten children going to and from the school and a cement mixer overturned there too. 4. The Irvine Company promised the County, when applying for its construction permit for the resort, to "Minimize obstruction of through - traffic lanes", and "When feasible, construction should be planned so that lane closures and on existing streets are kept to a minimum ", that "construction traffic will not impede existing traffic conditions ", "construction access will be coordinated with the respective contractors for other projects within the Irvine Coasf'.and that "Staging areas will be located within the project boundaries and shall not encroach onto the public right -of- way". Additionally, The Irvine Company represented to the City Council that the road closure would be "temporary" and only require a seven month period of time, perhaps as a way to sell the idea to the Council using an incremental but untruthful approach. Had the residents been forthrightly informed that the initial closure of seven months was a pretext for an additional two to three year closure, they would have been up in arms. Under these circumstances, The Irvine Company should be made to live up to its word. 5. Environmental Review was not required by the City for the seven month closure based upon a finding of minimal impact. Some residents have consulted a CEQA attorney and there exists reason to believe that an Environmental Impact Report should be required for a closing of a public roadway for a two to three year period. In fording the initial road closure exempt it was based in part on the fact that the construction which necessitated the road closure was related to already existing facilities. H owever, s uch a finding appears d isingenuous at b est t o t he residents. The grading and bridge construction is directly related to the relocation of the golf course clubhouse so that a timeshare resort can be built. The timeshare resort is not an "existing facility". At a minimum, an Environment Impact Report should be obtained by TIC to study and the life and traffic and safety impacts. Should a residencetch fire, while the closure would nodelay fire response from the Newport Coast fire station, secondary response from other Newport Beach units or Laguna Beach would be delayed. We request that the City Council consider all of the foregoing, including the existing congestion and road hazard conditions present on Pelican Hill Road North. Pelican Hill Road South is a public road that all of the residents here pay for in taxes and we have the right to expect.that it remains open for everyone's use. We strongly urge you t o oppose The Irvine C ompany's request for the extension o f the road closure permit. I have been very involved in working with the Irvine Company on matters that affect us relating to the Pelican Hills Resort. I strongly support the Irvine Company's request for the continued closure of South Pelican Hill Road until the project is completed. Homeowners like us prefer that this project be completed in as expeditious manner as practical. Continued closure of the road will assist in that goal. I am a resident of Pelican Crest and our home looks directly over the Upper and Lower Villas that are currently under construction as part of TIC'S Pelican Hill Resort. My husband and I believe that the road should remain closed primarily for safety reasons. We believe that opening the road would open our community to a number safety /fire issues. We believe that the City of Newport Beach should not be liable for any incident that may occur due to construction and the publics' use of Pelican Hill Road South. That opening of the road would delay the project and actually increase traffic on Pelican Hill Road North, by opening it up to the 2000 plus workers who would use the road to get to a from the project on a daily basis once vertical construction commences. As I understand it now, all workers are required to enter from Newport Coast Road. Finally, if the road was re- opened, construction would be 24!7/365 until complete! Meaning that to allow public access, the road would have to be safe for vehicle/bike /pedestrian traffic at all times... so, according to what I heard at tonight's meeting, temporary "BLINKING LIGHTS" would have to be installed to keep the area safe for the public during the evening hours. This Board has been elected by more than 4,000 residents from 1,638 homes in the Newport Coast. Among the topics raised at this meeting was the pending request from The Irvine Company to the city, to extend the closure of Pelican Hill Road South between the Newport Coast Drive and the Pelican Hill Gate (South Entrance) for construction purposes. While the Board appreciates the significant progress made on the project to date, they are adamantly opposed to any further closure of Pelican Hill Road South. The community has been patient while the road has been closed the past 8 months, believing that it would reopen in September, as was stated by the Irvine Company at the February City Council meeting when the closure permit was approved. Now, just as the road should be reopening the residents are told that The Irvine Company is seeking further closure for an additional period of 2 years or more. A 2 -year closure or even a 2 -month closure is unacceptable to the community that we represent. Our residents paid for 100% of the cost of this road and allowing it to be closed for a private developer to use as its private road and to stockpile materials and park vechicles is unconscionable and represents the illegal taking of our property without compensation. We are certain that at no time in the history of the City of Newport Beach has a developer been allowed to confiscate a public road for 8 months or longer to develop a for profit project that has no public purpose. The intersection of Newport Coast Drive and Pelican Hill North has been the site of several accidents as you may already be aware. These accidents have closed this intersection leaving no access to the communities beyond this intersection creating a serious threat to public safety. Should an accident occur, similar to the incident that occurred between a construction vehicle (cement truck) and a private vehicle, the response time for police and/or fire service vehicles to any of the 407 homes in the area could have devastating results. This would also hold true for a natural.disaster such as fire or earthquake. The closure of this road already eliminates one of two possible evacuation routes for these residents. Although we have beetold by Public Works that if a natural disaster occurred the Fire Department would have the ability to open the road, even that would take some response time, with no certainty that in the event of a City wide emergency, the response would be rapid or that the road would be drivable and not blocked or obstructed. Certainly, the Council can understand the importance of having this road reopened as soon as possible. Given a choice between public life and safety on one hand and developer inconvenience on the other hand, we are hopeful that our elected officials would have little difficulty in refusing a further road closure. In addition to the threat to public safety, the members of Pelican Hill, Pelican Crest and Montecito Coast have already been subject to significant traffic delays due to the eight -month closure of this road. To extend the closure of this road to accommodate the unnecessary construction requests of a developer over the safety concerns of an entire community is unacceptable. While only Councilman Curry attended the Study Session on this matter at Council Chambers on September 20`h, he will be able to verify that more than 50 residents turned out and were openly hostile to the idea of further closure, with only one resident expressing support. Importantly, this meeting was attended by the Irvine Companies Project Manager who, in response to direct questions, clearly stated that the construction could be completed without additional road closure, but that it might involve resident inconvenience with traffic stops, lane diversions, and nighttime lighting. The residents who attended the Study Session voiced the clear opinion that they are prepared to live with properly managed inconvenience in lieu of a further closure of the road. Therefore, the Board respectfully requests that the City deny The Irvine Company's request to extend the closure of this necessary arterial road. Finally, the Board requests that the developer be instructed to immediately open this road to the members of the community, who pay the taxes for this road. This document is a general guideline pertaining to the creation and maintenance of fire department access roadways, access walkways to and around buildings, and hydrant quantity and placement as required by the 2001 California Fire and Building Codes (CFC and CBC) and as amended by local ordinance. This guideline includes requirements for: • Plan Submittal • Fire Access Roadways • Fire Lane Identification • Fire Lane Violations • Premises Identification • Fire Lane Obstructions • Access for Residential Development • Alternative Engineered Fire Access Systems • Very High Fire Hazard Severity Zone (VHFHSZ) and Special Fire Protection Area (SFPA) Requirements • Hydrant quantity, spacing, and placement • Water availability and fire flow • Access to structures • Access walkways These guidelines apply to new, remodeled, reconstructed, or relocated residential or commercial structures and developments to which emergency response may be necessary. The information contained in this document is intended to assist the applicant in attaining compliance and to ensure that privately owned roadways necessary for emergency response purposes will be available for use at all times. Some of the issues discussed within this document may be covered in more detail through other OCFA guidelines, as referenced. Areas of particular importance and requirements that are commonly overlooked on fire master plan submittals have been identified with a black arrow in the left margin. The following definitions are provided to facilitate the consistent application of this guideline: 0 Orange County Fire Authority Page 2 of 43 Fire Master Plans for Commercial & Residential Development Guideline B -09 March 7, 2006 Access Walkways - An approved walking surface leading from fire access roadways to exterior doors and other required openings in structures. Bollards - Permanent or removable poles that are placed across a roadway for the purpose of restricting vehicular access to a portion of a site or to protect a piece of equipment from potential vehicular damage. Fire Access Roadways - The means for emergency apparatus to access a facility or structure for emergency purposes. Roadways must extend to within 150 feet of all portions of the exterior of the first floor of any structure and must meet specified criteria for width, pavement characteristics, roadway gradient, taming radius, etc. Fire access roadways are also referred to as fire lanes. Fire Lane Identification — Specific requirements that allow fire access roadways to be readily recognized so that they will remain unobstructed and available for emergency use at all times. Gates and Barriers - Devices that restrict pedestrian and vehicle ingress and egress to and from a facility. Gate and Barrier Locks - Devices that are installed on gates and barriers to secure a property or facility. Premises Identification - The visual means used to readily identify a property or facility.. It is also the numbering system that is placed on structures for the purpose of identification of separate buildings within a single facility. Rescue Windows - Openings required in all sleeping rooms located below the fourth story of a building that allow rescue of trapped occupants. Very High Fire Hazard Severity Zones (VHFHSZ) and Special Fire Protection Areas (SFPA) — A designated area in which the type and condition of vegetation, topography, weather, structure density, and other relevant factors potentially increase the possibility of uncontrollable fire. 1. Plan Requirements Plans shall be provided to demonstrate compliance with all codes and other regulations governing water availability for firefighting and emergency access to sites and structures within the jurisdictions served by the OCFA. In addition, changes to existing structures or sites shall be reviewed by the OCFA to ensure that the modifications do not affect water availability or access. A. Submittals — Three plan sets will need to be submitted at the location specified in the OCFA Plan Submittal Routing list. Accompanying sets of documentation for items such Orange County Fire Authority Page 3 of 43 Guideline B -09 Fire Master Plans for Commercial & Residential Development March 7, 2006 as gates, water availability data, paving certification, soil gas assessment (See Guideline C -03), and conditions of approval shall be supplied, as needed. The OCFA plan review And inspection fee, as well as any city administrative fees, is due upon submittal of plans. Refer to the fee schedule on the OCFA website (www.ocfa.org) for the current fire master plan fee. B. Scope — The scope of work shall be clearly indicated on the plan. If the building or site in question was approved previously, include the OCFA Service Request number of that prior approval on the new plans. A copy of the previously approved fire master plan shall be submitted along with new plan sets for any revision. C. Building Data — Information related to the building's location, use, and construction shall be clearly indicated on the plan. hk 1) Include the project's street address (when known) and the tract, tentative tract, parcel OF map number, or County Assessor's parcel number. 2) Indicate the types of occupancies that will be housed in the structure as listed in California Building Code (CBC) Table 3 -A. 3) Indicate the building height on the plans. The height is measured from the lowest point of fire department access adjacent to the structure to the finish floor level of the highest occupiable floor. kk 4) Indicate the construction type of each building. If sprinklers are being used for a one- 1 hour construction equivalency, note this clearly on the plan. Also note the type of PF sprinkler system installed (e.g., NFPA 13, 13 -R, or 13 -D). 5) Allowable area or mixed occupancy calculations shall be provided for all structures over 2,500 square feet. Indicate all building area increases allowed by CBC Chapter 5 �. (e.g., multistory, side yards, sprinklers, height increase) that are being applied. D. Fire Master Plan Notes — Include the OCFA Fire Master Plan Notes on the plan, verbatim. See Attachment 1. E. Water Availability — A completed Water Availability form or equivalent data from a water purveyor or third party shall accompany all fire master plan submittals for projects where a new building is constructed or modification to an existing building increases the floor area of the structure. Water data may be requested by the OCFA for other conditions as necessary to ensure adequate fire protection for a particular site. F. Conditions of Approval — To ensure consistency of the fire master plan with project conditions, include any conditions of approval pertaining to OCFA review of the project on the plans. If the project does not require review and entitlement by the Planning Commission, City Council, Board of Supervisors, or similar body, or the conditional use permit review process is required but has not yet been completed, please state this on the 0 • Orange County Fire Authority Page 4 of 43 Guideline B -09 Fire Master Plans for Commercial & Residential Development March 7, 2006 plan. If you are unsure whether your project requires conditions of approval, please contact your city or County planner. G. Complete Attachment 2, Fire Master Plan Submittal Checklist, and verify that basic project information has been provided and that general access and water requirements have been addressed on the plan. 2. Fire Access Roadways Fire access roadways, sometimes referred to as fire lanes, shall be provided for every facility or building when any portion of an exterior wall of the first story is located more than 150 feet from a public roadway, as measured along an approved route. Extenuating circumstances, increased hazards, and additional fire safety features may affect these requirements. CFC 902.2.1 A. Fire Access Roadway Construction - Fire access roadways must be engineered to support emergency response apparatus. Roadways must be designed to facilitate turning radii of apparatus and meet requirements for gradient, height clearance, and width. Specific criteria pertaining to the design of fire access roadways are detailed below. 1) Fire Access Roads in VHFHSZ and SFPA - To determine if a project is within VHFHSZ or SFPA, contact the OCFA Planning and Development Services Section for information on the delineation of these areas. These hazard zones are typically located at the perimeter of developed areas and are found in the following jurisdictions: Aliso Viejo, Dana Point, Irvine, Mission Viejo, San Clemente, Lake Forest, Rancho Santa Margarita, San Juan Capistrano, Yorba Linda, and the unincorporated areas of Orange County. Special requirements apply, which are detailed elsewhere in this guideline. 2) Fire access roadways shall be designed, constructed, and maintained to support the imposed loads of OCFA fire apparatus with a total weight of 68,000 pounds. Apparatus weight is distributed as 46,000 pounds on tandem rear axles and 22,000 pounds on the front axle. The surface shall be designed, constructed, and maintained to provide all- weather driving capabilities. A letter or statement, wet- stamped and signed by a registered engineer, shall be provided on the plans certifying that any new roadway meets this 68,000 - pound, all- weather requirement. See Attachment 3. 3) Number of Fire Department Access Roads Required: a) One is required if any portion of an exterior wall of the first story of a building is located more than 150 feet from a fire access roadway. That access is to be measured by an approved route around the exterior of the building (see Section 10: Access to Structures). b) More than one road is required if it is determined that access. by a single road may be insufficient due to terrain, location, travel distance, potential fire or life- safety 0 0 Orange County Fire Authority Page 5 of 43 Guideline B -09 Fire Master Plans for Commercial & Residential Development March 7, 2006 hazards, or other factors that could limit access or if vehicle congestion, railways, or weather conditions could impair the single entry point. A minimum of two vehicle access points located to facilitate evacuation and emergency operations is required for any development containing 150 or more residential units. 4) Location of Fire Access Roads - To protect fire apparatus, personnel, and equipment from damage and injury from falling debris, the edge of fire access roadways serving multi -story buildings should be located no closer than 10 to 30 feet from the building, the actual distance being a function of overall building height with consideration given to building construction, presence of openings, and other potential hazards. As distances greater than 40 feet inhibit the use of vehicle- mounted ladders while distances closer than 20 feet do not allow for a proper laddering angle, the edge of fire lanes serving structures four or more stories in height shall be located between 20 and 40 feet from the building. These distances are measured from the face of the building to the top edge of the curb face or rolled curb flowline nearest the structure. 5) Width of Fire Access Roads - The minimum width of a fire access roadway is 20 feet (28 feet in VHFHSZ or SFPA). If a center median is included, the required width k kk shall be provided on both sides o the median. The width, o ire department access roads is measured from top face of e curb to top face of the curb on streets with curbs and gutters, and from flowline to flowline on streets with rolled curbs. Flowline is the lowest continuous elevation on a rolled street curb. 6) Parking Restrictions - No parking is permitted on streets narrower than 28 feet in 7 width. Parking on one side is permitted on a roadway that is at least ZZ5 leer but less than 36 feet in width. Parking on two sides is permitted on a roadway 36 feet or more in width. See Attachment 4. Note: Minimum street widths for allowed parking may be more restrictive in some cities. Check with the local Planning Department for specific requirements. a) In VHFHSZ or SFPA, the minimum width of public and private streets shall not be less than 28 feet. Parking is allowed on one side of streets that are at least 28 but less than 36 feet in width. Exception: Private streets and driveways serving no more than three dwelling units and not exceeding 150 feet in length may be 24 feet in width. No parking is allowed on 24 foot wide roadways. 7) Vertical Clearance - Fire access roads shall have an unobstructed vertical clearance of not less than 13 feet 6 inches. If trees are located adjacent to the fire access roadway, place a note on the plans stating that all vegetation overhanging the fire access roadway shall be maintained to provide a clear height of 13 feet 6 inches at all times. See Attachments 5 and 6. 8) Fire Access Road Grade - The grade for access roads shall not exceed 10% or 5.7 degrees (7% or 4 degrees in Irvine unless otherwise approved by the City Engineer). The grade may be increased to a maximum of 15% or 8.5 degrees for approved r 0 Orange County Fire Authority Page 6 of 43 Guideline B -09 Fire Master Plans for Commercial & Residential Development March 7, 2006 lengths of access roadways, when all structures served by the access road are protected by automatic fire sprinkler systems. 9) Inside and Outside Turning Radii - The inside turning radius for an access road shall be 17 feet or greater. The outside turning radius for an access road shall be 38 feet or greater. As fire apparatus are unable to negotiate tight "S" curves, a 56 -foot straight leg must be provided between these types of compound turns or the radii and/or road width must be increased accordingly. See Attachment 26. Note: to accommodate the OCFA's largest fire apparatus an inside and outside turning radius of 20 and 42 feet, respectively, is recommended and requested. 10) Dead -end Access Roadways - Dead -end roadways in excess of 150 feet shall be designed and constructed with approved turnarounds or hammerheads. Turnarounds shall meet the turning radius requirements identified above. The minimum cul -de- sac radius is 38 feet with no parking allowed. The maximum length of a cul -de -sac without mid -way turnarounds or other mitigating features is 800 feet. See Attachment 7. Note: to accommodate the OCFA's largest fire apparatus, an outside turning radius of 42 feet or larger is recommended and requested. 11) Bridges - When a bridge is required as part of an access road, it shall be a minimum of 20' in width and designed and constructed to accommodate a total weight of 68,000 pounds. Apparatus weight is distributed as 46,000 pounds on tandem rear axles and 22,000 pounds on the front axle. 12) Temporary Fire Access Roads - Temporary access roads and hydrants may be permitted for single family residential model construction with the following conditions: a) Plans for temporary access shall be submitted to the OCFA Planning and Development Services Section. Plans shall be drawn to scale and show permanent (existing) roadways, proposed roadway locations, location of models, space dedicated to storage of construction materials, and parking for work crews and construction vehicles. The plans shall clearly state that they have been submitted for temporary access and hydrants. b) Plans shall be stamped and signed by a licensed civil engineer stating that the temporary access road can support 68,000 pounds of vehicle weight in all- weather conditions. The road base material shall be over soil, compacted to at least 90 %. c) Provide a parking plan for the construction site detailing how the fire lane no parking regulations will be enforced. Include a clause in the letter stating that "the job -site superintendent is responsible for informing the work crews of parking requirements and that the entire job -site is subject to shutdown by the OCFA inspector if parking is in violation of fire lane posting." The letter shall be written on company letterhead and bluelined onto the plan. Orange County Fire Authority Page 7 of 43 Guideline B -09 Fite Master Plans for Commercial & Residential Development March 7, 2006 d) Aboveground invasion lines are acceptable for water supply. Provide detail drawings detailing how the line will be secured in place and protected from vehicular damage. ii. An invasion line may be run underground if the depth of bury can support the 68,000 -pound weight of a fire apparatus. iii. The temporary water line must provide the required fire flow; calculations are required. iv. The pipe shall be listed for fire service. v. Fire hydrants shall consist of a minimum 6" barrel with one 2 -1/2" outlet and a 4" outlet. Note this on the plan. e) The approved plan for temporary access and water supply shall be available at the construction site prior to bringing combustible building materials on -site. f) All other access and water requirements shall apply (e.g., width, approach clearance, premises identification, locks, gates, barriers, etc.). g) An inspection by OCFA personnel is required to verify adherence to the approved plan. 3. Fire Access Roadway Identification Fire lane identification will be required when it is necessary to restrict parking of vehicles in order to maintain the required width of fire access roadways for emergency vehicle use. Unlawful use of fire lanes will be enforced by the local law enforcement agency in accordance with the California Vehicle Code (CVC). CFC 901.4 A. Sign and Curb Marking Options - Areas designated as a fire lane require an acceptable method of marking that shall be approved prior to installation. Examples of dimensions and acceptable options for signage and markings are found in Attachments 8 through 12. The following methods are acceptable means of identifying designated fire lanes for 1 public and private streets. Choose EITHER option A OR option B below. Acceptable signage and/or marking requirements for streets in each jurisdiction must be verified on Attachment 13. A - Specific areas designated by the OCFA as fire lanes must be marked with red curbs in accordance with the requirements specified in Attachment 8. In addition, where the number of entrances into the area marked with fire lanes is limited, all such vehicle entrances to the designated area shall be posted with approved Fire Lane Entrance Signs. See Attachments 9 and 10. This option is preferred by the OCFA. 0 Orange County Fire Authority Page 8 of 43 Fire Master Plans for Commercial & Residential Development 0 Guideline B -09 March 7, 2006 B -"Fire Lane —No Parking" signs shall be posted immediately adjacent to each designated fire lane and at intervals not to exceed 50 feet. In addition, where the number of entrances into the area marked with fire lanes is limited, all such vehicle entrances to the designated area shall be posted with approved Fire Lane Entrance Signs. See Attachments 9 through 12. Note: All alternative signs must be approved through the OCFA Alternate Methods and Materials process (see OCFA Guideline A -01) and by the city /County traffic engineer and/or police agency, as applicable. 4. Fire Lane Parking Violations The California Vehicle Code (CVC) specifies rules of the road for stopping, standing, and parking in fire lanes or near fire hydrants. A. Section 22500.1 states that no person shall stop, park, or leave standing any vehicle whether attended or unatten e , to anv location designated as a Ire ane v the are nuutt,uty except wnen necessary to avota conntct win otner trarrtc or to compttance with the direction of a peace officer or official traffic control device. Vehicles illegally parked in a fire lane may be towed per CVC 22953(b). B. There shall be no parking of any vehicles other than fire department vehicles within 15 feet of either side of a fire hydrant in accordance with CVC 22514(c). Such vehicles may be towed per CVC 22651(e). C. CVC 22658(a) permits the owner or person in lawful possession of any private property, subsequent to notifying local law enforcement, to cause the removal of a vehicle parked on such property to the nearest public garage, if. 1) A sign is displayed in plain view at all entrances to the property specifying: a) The ordinance prohibiting public parking, and b) A notation indicating that vehicles will be removed at the owner's expense, and c) The telephone number of the local traffic law enforcement agency, or 2) The lot or parcel upon which the vehicle is parked has a single- family dwelling. 5. Premises Identification Three possible configurations of buildings or units within a building may exist and are identified as follows: freestanding buildings, multi -unit buildings, or multi - building clusters. Common to all configurations are the following requirements: Orange County Fire Authority page 9 of 43 Guideline B -09 Fire Master plans for Commercial & Residential Development March 7, 2006 A. Approved numbers or addresses shall be placed on the front elevation of all new or existing buildings in such a position that is plainly visible and legible from the street or road on which the property is addressed. CFC 901.4.4, as amended. B. The numbers shall contrast with their background. C. The numbers shall be a minimum of 4 inches or more in height for residential structures and 6 inches or more for commercial structures with a one -inch stroke or as required by local ordinance, whichever is more restrictive. Building setbacks, elevation, and landscaping can affect these minimum size requirements. D. Numbers for new buildings shall be internally or externally illuminated to be visible at night. Obstructions to Vehicle Access Existing or proposed gates and barriers crossing fire access roadways must be shown on the plans. Information such as the location, type (swinging, sliding), dimensions, operator (manual, electric), and emergency release during a power failure for electric gates must also be provided. Clearly identify this information on the manufacturer's specification sheets and include the spec sheets with your plan submittal for projects with electric gates. The fire master plan must include the following information: A. Electrically Operated Gates and Barriers - The gate control shall be operable by a Knox emergency override key switch. In the event of a power failure, the gate shall be automatically transferred to a fail -safe mode allowing the gate to be pushed open without the use of special knowledge or equipment, including battery back -up. The type of operator (mechanism) and method of emergency release during a power failure shall be shown on the plans; the manufacturer's specification sheet showing this information should be blue -lined directly onto the plan. B. Letters shall be red on white background and a minimum of three inches high with a '/2 inch width. See Attachment 14. C. Clear Width - Openings for egress and ingress of vehicles shall not be less than 13 clear wiam. 1 he vertical clearance shall not landscaping and/or trees. See Attachment 6. D. Turning Radii - The minimum inside turning radius is 17 feet with an outside radius of 38 feet for both the exterior and the interior approach to the gate. To accommodate the OCFA's largest fire apparatus, 20 feet and 42 feet or larger for inside and outside turning radii, respectively, is recommended and requested where possible. See Attachment 15. E. Setbacks from the Street - Gates and barriers shall be located a minimum of 46 feet (for existing developments) and 56 feet (for new developments) from any major street. A private driveway serving only one single - family residence is exempt from this requirement. If existing conditions prevent installation of the minimum setback, documentation supporting an acceptable alternative shall be provided. The alternative solution must facilitate emergency ingress without endangering emergency response personnel, emergency apparatus, and the general public. The alternative shall be subject to review and approval. See Attachment 15. Note: The required setback from the street may vary from city to city. Check with the local Planning Department for specific requirements. F. Setbacks from First Interior Turn - A 27 -foot minimum unobstructed setback is required from a gate to the first turn to allow emergency apparatus clearance. See Attachment 15. G. Gate and Barrier Locks - Gate or barrier locks shall be reviewed and approved prior to their installation on any new and/or existing access gate or barrier. Manually operated gates and barriers shall have OCFA approved padlocks or Knox key boxes. The information must include the location of the key switch for electrically operated gates. Applicants must indicate the following information on the plans: 1) Approved type of locking/unlocking device ( "Knox" key switch with dust cover, "Knox" padlock, or "Knox" weather resistant lock box, for use with a Knox submaster key). Authorization/order forms may be obtained through the OCFA Planning and Development Services Section at 714 -573 -6100. 2) Location of the "Knox" key switch for both manual and transmitter- operated gates. The key switch shall be placed 48" above the roadway surface at the right side of the access gate within two feet of the edge of the roadway. The key switch shall be readily visible and unobstructed. The "Knox" box must be placed in a conspicuous location and clearly labeled "FIRE DEPT." "They were definitely upset about the whole concept," Edmonston said. In a letter to the city, the Pelican Hill Community Association says the inconvenience could be a safety hazard if a major fire erupts. Edmonston says the road can be quickly opened in such a case. Exiting the north end of Pelican Hill Road adds only a mile or so to Coast Highway -bound commutes, Irvine Co. officials say. Opening lanes means motorists would share the road with construction equipment. "We just think it's simplest and safest" to continue.the closure, Irvine Co. spokeswoman Jennifer Hieger said. As you may he aware, on November 14 the Newport Beach City Council will consider a request from The Irvine Company to extend the temporary closure of South Pelican Hill Road to September 2008. As with other projects, The Irvine Company is striving to minimize the inconveniences that result from construction activity. In this instance, however, our concerns for the safety of the public and construction personnel, outweigh our desire to keep the road open to traffic. We believe the continued temporary closure of the south entrance to Pelican Hill Road is the safest. most responsible course. Please allow me to explain why. Rough grading is complete, underground utilities are being placed and construction is starling to commence. In early December you will see a dramatic increase in construction activity at the Pelican Hill Resort project area that will continue through September 2008 as we attempt to complete the project as quickly as possible. This complex and massive project, on both sides of South Pelican Hill Road, will require the efforts of more than 1,500 personnel onsite, who must enter, park and then exit the site in their vehicles each workday. In addition, a great deal of ongoing activity will result from large load deliveries of building materials. The City of Newport Beach Fire Marshall has toured the project area and recommends the continued temporary closure of South Pelican Hill Road, saying that opening the road during construction, while it is still being utilized by large trucks and heavy equipment, would be hazardous to the public. The hvine Company has implemented the Fire Marshall's recommendations to ensure that nothing precludes the use of South Pelican Hill Road should an emergency situation occur. For the duration of the temporary road closure, all emergency vehicles will have easy access to the road — night and day. As a result of these actions, including hiring security personnel (now on -site 24 hours a day, seven days a week with guards at each of the gates until the City deems the road safe for public travel), the Fire Marshall has concluded that the temporary closure of South Pelican Hill Road will not impact its use in the event of an emergency. We believe the temporary road closure will benefit your community during construction, because: • It ensures a significantly safer route of travel for residents. The City appears ready to deny its taxpayers the road they bought and paid for rather than taking the residents' needs into account.. The City would allow TIC to use the public road entirely for its private purposes, rather than insisting that TIC maintain the public thoroughfare and provide alternative access within its huge site for its private construction vehicles and workers. The City stands ready to keep the road closed for another year, and perhaps much longer, without requiring any TIC performance deadlines. The City's willingness to permit TIC to dictate how and when the public has access to the public mad under the current proposal is entirely unacceptable to the residents. The residents want to know that the mad will be reopened as soon as possible under the circumstances; ie: that TIC be required to repair and maintain the road during the construction process, that the mad be passable at all times for emergency vehicles and public access be permitted as soon as possible. Certainly TIC's website shows their intent to begin opening portions of the Resort to the public during 2007 (see TIC's pelicanhillatnewportcoast.com). If any part of the Resort is open to the public, certainly the mad must be open to the public. The residents are requesting the mad be opened for public use immediately. If the City is unwilling to open the road immediately, at the very least the City needs to monitor the TIC development on a monthly basis and establish a reasonable time table to open the road as soon as possible. Establishing performance dates by which development deadlines will be met are necessary to avoid the closure dragging on for two more years. If TIC fails to complete performance deadlines, the mad should then be opened within 30 days of a missed deadline. It is in all the parties' best interests to get the road opened as soon as possible, but without specific requirements and deadlines, TIC has little impetus to get its construction traffic off the road. Richard Demir ian e g h Introduction City of Newport Beach -- - *On January 10, 2006, City Council directed staff to issue a Temporary Road Closure Permit for Pelican Hills Road South until September 2006. *The permit allowed the closure of Pelican Hills Road South from Newport Coast Drive to Pelican Hills Circle providing that emergency access be maintained and that all construction traffic be required to enter from the southerly gate on Newport Coast Drive. • The Irvine Company has requested an extension of the road closure of Pelican Hill Road South until their anticipated completion date of September 2008 or until it is considered safe to reopen. �{RWi4i City of Newport Beach Road Closure Concerns Fire Department and Police Department have both reviewed the project location and have indicated that the closure will not affect primary response times providing: *The project would be required to provide manned entry gates at each end of the roadway with access maintained 24/7. • Detours, crossovers, alternative routes are clearly signed and maintained. • Excavation within the roadway be backfilled and /or plated at the close of daily construction • Fire hydrants, with adequate water pressure, shall be maintained within the roadway construction area. ,�vMr ,+ City of Newport Beach Pelican Hills Road North /Newport Coast Drive •Residents would continue to use Pelican Hill Road North. *Based on a construction zone speed limit of 25 mph and the existing posted speed limits, the travel time from Pelican Hill Circle to the Newport Coast Drive @ Pelican Hill Road South intersection is equal using both routes. *Additional delays thru the construction zone would be common due to lane closures and construction traffic entering and exiting the various construction sites. *The present damaged condition of the roadway surface is poor and the ongoing roadway and utility construction work would make traveling on Pelican Hill Road South unsafe. • The Pelican Hill Community Association letter raised concerns over the closure and environmental documentation for the project. Here, the only issue being analyzed is whether the proposed closure of the roadway is a project for purposes of CEQA, because all other environmental issues were fully analyzed in the Pelican Hill Resort Supplemental Environmental Impact Report. The closure of a roadway would not constitute a project under CEQA because, among other things, there is no potential for a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. In any event, even if the road closure were deemed a project for purposes of CEQA, in this case the project would be considered categorically exempt under 14 California Code of Regulations §§ 15301, 15302. 153061(b)(3). Without the closure, the city is limited to prohibiting overweight vehicles only such as concrete trucks. All other construction vehicles such as small to medium construction and delivery vehicles, service trucks, and workers commuting to the site would be allowed by law. -- •The closure will enable a shorter construction duration that reduces impacts on neighboring properties (noise, dust, lighting, & visual impacts). *The Irvine Company will be required to reconstruct the roadway including paving, new curbs, sidewalk and landscaping. Requiring this work near the end of the project will preserve the new public improvements from construction damage. *There are no congestion problems at Pelican Hill Road North /Newport Coast Intersection due to the closure. However, Public Works agrees that the intersection should be reviewed for potential safety improvements that are unrelated to the closure issue. Staff Recommends the approval of an extension until Sept. 2007 with the provision that the closure will be reviewed by City Council with the following conditions: -Maintain 24/7 emergency access on Pelican Hill Road South with manned entry gates. -Detours, crossovers, or alternative routes shall be clearly signed and maintained. •AII excavation within the roadway shall be backfilled and /or plated at the close of daily construction. -Fire hydrants be maintained with adequate water pressure. -Project construction traffic will continue to access the project from the Pelican Hill Road South and Newport Coast Drive intersection. No construction access from Pelican Hill Road North. •AII public roadway improvements shall be reconstructed near the close of the project and protected from damage by construction traffic. -The City and TIC shall monitor the construction progress and meet regularly to determine when the roadway may be safely reopened.
