Brown, City Clerk PHONE: (949) 644 -3005 TITLE: Appointment by Mayor of Ad Hoc Appointments Committee to Review Applications and Make Recommendations to the Full Council for the Board and Commission Vacancies ABSTRACT: The annual vacancies on City Boards and Commissions will occur on June 30, 2015. Additionally, an unscheduled vacancy on the Planning Commission will occur on June 30, 2015, and an unscheduled vacancy occurred on the Building and Fire Board of Appeals on March 2, 2015. The process to fill the vacancies shall be followed in accordance to City Council Policy A -2 (Board and Commission Appointments) and consistent with the Maddy Act. RECOMMENDATION: a) Confirm Mayor Ed Selich's appointment of Mayor Ed Selich, Mayor Pro Tern Diane Dixon, and Council Member Tony Petros to serve on the Ad Hoc Appointments Committee to review applications and make recommendations to the full Citv Council for the Board and Commission vacancies: and b) Direct the City Clerk to post and publish a Vacancy Notice requesting that applications be submitted by 4:00 p.m. on Wednesday, May 13, 2015; schedule confirmation of nominees to be made on June 9, 2015; and make appointments on June 23, 2015. FUNDING REQUIREMENTS: No fiscal impact. DISCUSSION: On June 30, 2015, the following vacancies will occur on City Boards and Commissions: Board of Library Trustees (two seats) - Seats held by Eleanor Palk (eligible for reappointment) and Jill Johnson - Tucker (eligible for reappointment). 10 -1 Building and Fire Board of Appeals (one seat) - Seat held by James Anderson (eligible for reappointment). City Arts Commission (one seat) - Seat held by Arlene Greer (eligible for reappointment). Civil Service Board (Civil Service Board nominee) (one seat) - Seat held by Hugh Logan [Civil Service Board nominee] (not eligible for reappointment). Harbor Commission (one seat) - Seat held by Brad Avery (eligible for reappointment). Parks. Beaches and Recreation Commission (two seats) - Seats held by Roy Englebrecht (eligible for reappointment) and Laird Hayes (eligible for reappointment). Planning Commission (three seats) - Seats held by Kory Kramer (eligible for reappointment), Jay Myers (eligible for reappointment), and Larry Tucker (resigned from the Commission effective June 30, 2015). Additionally, Ron Yeo resigned from the Building and Fire Board of Appeals effective March 2, 2015. In order to provide the public ample time to apply for the vacancies, the Notice of Vacancies and Special Notice of Unscheduled Vacancy for the Planning Commission position was published on Saturday, February 14, 2015. The Notice of Vacancies was also published on Saturday, February 28, 2015, to clarify the ending term date for the unscheduled vacancy on the Planning Commission. The Special Notice of Unscheduled Vacancy for the Building and Fire Board of Appeals position was published on Saturday, March 14, 2015. Consistent with City Council Policy A -2, all of the vacancies will be re- advertised on Saturday, May 2, 2015, and applications will be accepted until 4:00 p.m. on Wednesday, May 13, 2015. Following the interview process, the nominations will be scheduled for confirmation by the full City Council on Tuesday, June 9, 2015, and final appointments will be made on Tuesday, June 23, 2015. All new terms will be effective on July 1, 2015, with an expiration date of June 30, 2019, except for the unscheduled vacancies on the Planning Commission (Larry Tucker's seat) and Building and Fire Board of Appeals (Ron Yeo's seat). The two seats will expire on June 30, 2016, and will be eligible to reapply for their respective seats in order to serve for a full four -year term. City Council Policy A -2 also establishes the procedures for making appointments to the various Boards and Commissions. Pursuant to City Council Policy A -2, the Ad Hoc Committee's duties are as follows: A. Review all the applications for positions to the City Boards and Commissions; B. Conduct any necessary interviews with individual applicants; and C. At least two (2) weeks prior to the date of appointment, recommend to the full City Council at a regular public meeting, two (2) or more candidates for each Board or Commission vacancy. Members of the City Council may wish to interview the recommended candidates further prior to final selection by the City Council. By requiring two (2) or more candidates for each vacancy, it is the intent of the City Council that at least two (2) separate individuals should be considered for each vacancy (i.e., if there are two (2) vacancies, at least four (4) separate individuals will be considered). Pursuant to Charter Section 710 (Civil Service Board), the four remaining Civil Service Board members shall provide the City Council with a list of three persons nominated by a majority of the Board. The names and applications of the three nominees shall be presented to the City Council at the June 9, 2015 City Council meeting. Once the final appointments are made by the City Council, the Ad Hoc Appointments Committee will be dissolved. 10 -2 ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
