Title 17 Reorganization; Council Policy H =1 & Harbor Design Criteria Update City of Newport Beach City Council Meeting January 8, 2008 IIcv H -1 Both of these documents are in need of reorganization for the following reasons: 1. To assist the Planning Department in development of the City's Local Coastal Program (LCP) implementation Plan which consists of zoning ordinances, zoning district maps etc... • Reorganize Title 17 into a logical format that more closely follows the zoning code's organizational style 2. To be consistent with the Council's priority of aligning City Codes, regulations and policies into the General Plan 3. Advised by the City Attorney to incorporate most of Council Policy H -1 into Title 17 to make these policies more enforceable Overall Result To make minor revisions and to update the terms, definitions and outdated sections to eliminate or reduce ambiguity as well as to add clarity. BAYWARD LOCATION OF PIERS AND FLOATS* A. U.S. Bulkhead Sta. No. 107 to No. 109. Piers will be permitted to extend out to the U.S. Pierhead Line. B. U.S. Bulkhead Sta. No. 109 to No. 110. Piers may be permitted to extend 16 feet channelward of the U.S. Pierhead Line. C. U.S. Bulkhead Sta. No. 110 to No. 112. Piers will be permitted to extend out to the U.S. Pierhead Line... Harbor Design Criteria • Independent of the Title 17 and H -1 reorganization efforts, the Harbor Design Criteria has been updated to reflect current standards and codes for construction • Plan checkers at Harbor Resources and Building have been reviewing documents that haven't been updated since 1973 • In 2003, City Council approved a contract with URS. Cash and Associates to completely overhaul and rewrite the standards, figures and drawings with significant input from the Building Department and Public Works • The Harbor Design Criteria is presented for approval at the same time as Title 17 and H -1 since these documents are closely interrelated • Combined, these documents provide the tools necessary to effectively manage the Harbor activities • Reviewed and approved by the Harbor Commission in 2006 BOW Sprit Pin. The following departments were involved in preparation and review of these documents: *City Manager's Office *City Attorney *Planning • Public Works • Revenue • Building • Fire • Harbor Resources • Code Enforcement In addition, the documents were reviewed by a Harbor Commission subcommittee which included concerned citizen assistance. The Harbor Commission provided formal approval of the Title 17 document at their September 13, 2006 public meeting. Environmental Review: The City Council's approval of this item is categorically exempt from CEQA under the General Rule Exemption (Section 15061 of the CEQA Guidelines. Public Notice: This agenda item has been noticed according to the Ralph M Brown Act (72 hours in advance of the public meetings at which the City Council considers the item). The agenda was posted at City Hall and on the City's website.
