CALL MEETING TO ORDER II. APPROVAL OF MINUTES MINUTES OF APRIL 16, 2015 III. PUBLIC HEARING ITEM(S) ITEM NO. 1. Ritual Yoga Facility Minor Use Permit (PA2015-042) 100 W. Coast Highway, Unit R-103 Summary: A minor use permit to allow a yoga facility within a 3,916-square-foot vacant commercial space located within the Mariner's Pointe shopping center. The facility includes a yoga studio, retail sales, locker rooms, a reception and a lobby with prepackaged beverages. Recommended Action: 1. Conduct a public hearing; and 2. Adopt Draft Zoning Administrator Resolution No. _ approving Minor Use Permit No. U P2015-010. CEQA Compliance: The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). ITEM NO. 2. Annual Review of Development Agreement for Hoag Memorial Hospital Presbyterian (PA2009-064) 1 Hoag Drive Summary: Pursuant to Section 15.45.080 of the Municipal Code and Section 65865.1 of the California Government Code, the City is conducting a review of the amended Development Agreement between The City and Hoag Hospital. The City and Hoag Hospital entered into a Development Agreement in 1994, which was amended in 2008, for the purpose of ensuring the orderly expansion of Hoag Hospital. The review will examine Hoag's good faith compliance with the provisions of the Development Agreement, the Planned Community Development Plan District Regulations and applicable environmental mitigation measures. Hoag Hospital is located at 1 Hoag Drive, which is south of Hospital Road, west of Newport Boulevard, north of Coast Highway and generally south and east of two residential communities (Villa Balboa and Versailles). Recommended Action: 1. Conduct a public hearing; 1 Zoning Administrator- April 30, 2015 2. Find the annual review is exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15321, Class 21 (Enforcement Actions by Regulatory Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3; 3. Receive and file the Annual Report of Development Agreement for Hoag Memorial Hospital Presbyterian (Attachment No. ZA 2); and 4. Find that the applicant has demonstrated good faith compliance with the terms of Development Agreement No. 5. CEQA Compliance: This project is exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15321 (Enforcement Actions by Regulatory Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. This section exempts actions by regulatory agencies to enforce or revoke a lease, permit, license, certificate, or other entitlement for use issued, adopted, or prescribed by the regulatory agency or enforcement of a law, general rule, standard, or objective, administered or adopted by the regulatory agency. ITEM NO. 3. Annual Review of Development Agreement for Uptown Newport (PA2014-039) 4311-4321 Jamboree Road Summary: Pursuant to Section 15.45.080 of the Municipal Code and Section 65865.1 of the California Government Code, the City is conducting a review of Development Agreement No. DA2012- 003 for the Uptown Newport project. The Development Agreement was executed in 2013, and it ensures the orderly construction of the Uptown Newport Planned Community, a 25- acre, mixed-use residential project consisting of 1,244 residential units, two one-acre public parks and 11,500 square feet of retail uses. The Zoning Administrator will review Uptown Newport's good faith compliance with the provisions of the Development Agreement. Recommended Action: 1. Conduct a public hearing; and 2. Find the annual review is exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15321, Class 21 (Enforcement Actions by Regulatory Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3; 3. Receive and file the Annual Report of Development Agreement for Uptown Newport Planned Community (Attachment No. ZA 2); and 4. Find that the applicant has demonstrated good faith compliance with the terms of Development Agreement No. DA2012-003. Annual Review of Development Agreement for Pacific View Memorial Park (PA2009- 024) 3500 Pacific View Drive Summary: Pursuant to Section 15.45.080 of the Municipal Code and Section 65865.1 of the California Government Code, the City is conducting a review of Development Agreement No. 7 (DA2006-001) for Pacific View Memorial Park. The Development Agreement was executed in 2 Zoning Administrator- April 30, 2015 1995 and amended in 2007, and ensures the orderly construction of the cemetery. The Zoning Administrator will review Pacific View Memorial Park's good faith compliance with the provisions of the Development Agreement. Recommended Action: 1. Conduct a public hearing; and 2. Find the annual review is exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15321, Class 21 (Enforcement Actions by Regulatory Agencies) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3; 3. Receive and file the Annual Report of the Development Agreement for Pacific View Memorial Park (Attachment No. ZA 2); and 4. Find that the applicant has demonstrated good faith compliance with the terms of Development Agreement No. 7. IV. PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on non-agenda items generally considered to be within the subject matter jurisdiction of the Committee. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Committee has the discretion to extend or shorten the speakers'time limit on non-agenda items, provided the time limit adjustment is applied equally to all speakers. ADJOURNMENT This hearing is subject to the Ralph M.Brown Act.Among other things,the Brown Act requires that the Zoning Administrator agenda be posted at least seventy-two(72)hours in advance of each regular hearing and that the public be allowed to comment on agenda items before the Zoning Administrator and items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator.The Zoning Administrator may limit public comments to a reasonable amount of time,generally three(3)minutes per person. It is the intention of the City of Newport Beach to comply with the Americans with Disabilities Act("ADA")in all respects.
