RECOMMENDATION: Authorize the Mayor to send a letter to the Chairman of the SJHTC Board requesting that future toll rates at the Newport Coast Drive ramp increase at the same rate as the rates for the Aliso Creek ramp. BACKGROUND: On May 8th, both Transportation Agency Boards will receive and consider the recommendations in the "Final Traffic and Revenue Report, Transportation Corridor System, Including the San Joaquin Hills, Foothill and Eastern Transportation Corridors" dated April 10, 2008, prepared by Stantec Consulting Inc. The TCA board members were given a copy of the report to review in advance of it being presented to the representative Boards. On March 31, 2008, Council Member Webb submitted the attached letter to TCA CEO Tom Margro. The letter was discussed by the TCA Joint Financial Options Finance Committee on April 10th. It was the consensus of the meeting, with Webb being the only dissenter, that the report's recommended future toll rates were appropriate and should not be adjusted. As stated in the letter, the proposed toll rate at Newport Coast Drive Ramp increases by a much greater percentage than at any other location along the corridor. The proposal is for a 25 cent increase every two years. The 2008 rate of $1.50 increases to $4.25 by 2031. The tolled distance of road used is 1.8 miles. San Joaquin Hilts Transportation Corridor (SJHTC) Toll Rate Study Comments April 22, 2008 Page 2 By comparison, at the southerly end of the corridor the Aliso Creek Ramp has a proposed rate increase of 25 cents in 7 years and then every five years after that. The 2008 rate of $1.25 increases to $2.50 by 2031. The tolled distance of road used is 2.2 miles. It is Council Member Webb's position, since both of these locations are roughly the same distance from each end of the toll road, they should pay approximately the same toll for the use of the toll road. The future ramp volumes are projected to be about the same, so if the proposed rates for Newport Coast Drive go down by the same amount Aliso Creek rates go up, there is no loss of revenue. If the rates are adopted as proposed, the Newport Coast Drive Ramp users will pay about $66 million more than Aliso Creek Ramp users between now and 2031 for traveling roughly the same distance on the toll road. Henn Steven Rosansky Don Webb Dear Tom, CITY OF NEWPORT BEACH OFFICE OF THE CITY COUNCIL March 31, 2008 Toni Margro, CEO Transportation Corridor Agencies 125 Pacifica, Suite 100 Irvine, CA 92618 Subject: Santee Traffic and Revenue Report I have completed my review of the Stantec Final Traffic and Revenue Report and find that the issue I raised at the last board meeting and that I brought up during at least two Joint Financial Options Ad Hoc Committee meetings has not been addressed. It appears to me that the Newport Coast Drive (NCD) Toll Plaza future rates are too high when you consider the distance traveled on the tolled portion of the SJHTC and compare the rate to the southern end of the corridor for an equal distance traveled. The 2031 NCD rate of $4.25 is 2.83 times the 2007 rate. No other ramp increases by this percentage. The report says on page VI -2 "The toll schedule results in average toll rates that will roughly double at all toll plazas between 2008 to 2031." The NCD rate is almost tripled. The attached Exhibit I utilizes the information in the Stantec Report Table VI -1 to show a Toll Increase Comparison. For the years shown, either NCD (3 of 5) or Bonita Canyon (2 of 5) have the highest period percentage increases. In 2031, the La Paz ramp has the highest cost per tolled miles traveled at $2.74 /mile, followed by NCD at $2.43 /mile and Bonita Canyon $1.65 /mile. While Aliso Creek and .El Toro are $1.18 /mile and $1.19 /111ile respectively. Page VI -3 in the report indicates the average cost - per -mile for interchange -to- interchange trips for 2030 is 127 cents. NCD is 1.9 times this amount and Aliso Creek is 0.93 this amount for a 0.4 mile longer trip and the.same projected volume. For the years listed, NCD is from 54% to 91% higher than the average and Bonita Canyon is f om 21 % to 79% higher than the average. Why? The annotated Figure VI -7 shows the distances from or to a toll plaza from closest free ramp. For the NCD ramp the tolled distance traveled averages 1.8 miles. For the Aliso Creek ramp the tolled distance traveled averages 2.2 miles, yet the 2031 toll is $1.75 less than the $4.25 NCD toll. The tolled distance traveled for the El Toro ramp averages 3.8 miles which is 2 miles longer than the NCD distance yet the 2031 toll is only $0.25 greater than the NCD toll. I am particularly concerned because as rates increase, more traffic will use Coast Highway through Corona del Mar and on to MacArthur Boulevard. The Santec Report Table III -6 shows that the 2000 NCD ramp toll increase caused a 22% reduction in those using the ramp. Mainline toll increases show up to a 10% increase in traffic using the NCD ramp. These are significant numbers of trips that are diverted onto Newport Beach's arterial system. Between the Pacific Ocean and the Corridor, Coast Highway is the only parallel route. A reduction of trips on the Corridor means an increase of trips on Coast Highway, Newport Coast Drive is supposed to divert traffic from Corona del Mar, but if the rates for this ramp are too high, as they appear to be, this diversion will not occur. Attached Figure 111 -13 shows that for the last two years the NCD tolled ramp volumes are the highest on the corridor. Exhibit 3 shows future ramp projections indicate this will be the case until 2030. The rates today are only $0.25 higher than Aliso Creek. That difference increases to $1.75 by 2031 and appears to cause a 20% reduction in the NCD ramp volume. Again I ask, please adjust the rates so that those using the northerly end of the SJHTC are paying equal to, or at least close to, the rates per mile of toll road used as those on the southerly end. I suggest that the Bonita Canyon (0.8 tolled miles used) and the La Paz (1 tolled mile used) have the same rate. The Newport Coast Drive (1.8 tolled miles used) and the Aliso Creek (2.2 tolled miles used) should also be the same rate. There is a very easy bypass around the NCD ramp. In the northbound direction it is 0.1 mile longer and adds about 2 1/2 minutes to a trip. In the southbound direction it is 0.5 miles longer and adds about 2 minutes to a trip. See Exhibit 2, Time Runs for the NCD Bypass. If the recommended disproportionately high toll rates are implemented, we could educate our drivers with the following sign which by 2031 would read: Use Bypass Save $3.00 Lose 3 Minutes In this letter, I have focused on the 2031 toll rates as an example. The inequities for the northerly end of the SJ.HTC are there in all of the toll assignments. If an equitable adjustment can't be made on the proposed rate structure, please provide a copy of this letter with attachments to the Board, so that a public discussion of this issue can be had. Don Webb CITY OF NEWPORT BEACH OFFICE OF THE MAYOR May 7, 2008 Tom Margro, CEO and Board Members Transportation Corridor Agencies 125 Pacifica, Suite 100 Irvine, CA 92618 Subject: Santec Traffic and Revenue Report Dear Mr. Margro and Members of the Board of Directors: The Newport Beach City Council has reviewed the Stantec Final Traffic and Revenue Report and is concerned about the apparent lack of fiscal equity involved in a recommendation of the toll rate for a certain sector of the toll road. It appears to our City Council that the Newport Coast Drive (NCD) Toll Plaza future proposed rates are priced too high when considering the distance traveled on the tolled portion of the SJHTC, when compared to the rates recommended towards the southern end of the corridor for an equal distance traveled. The 2031 NCD rate of $4.25 is 2.83 times the 2007 rate. No other ramp increases by such a large percentage. The report states on page VI -2 "The toll schedule results in average toll -ates that will roughly double at all toll plazas between 2008 to 2031." Yet, the NCD rate is almost tripled. Why? The attached Exhibit 1 utilizes the information in the Stantec Report Table VI -1 to show a Toll Increase Comparison. For the years shown, either NCD (3 of 5) or Bonita Canyon (2 of 5) have the highest period percentage increases. In 2031, the La Paz ramp has the highest cost per tolled miles traveled at $2.74 /mile, followed by NCD at S2.43 /mile and Bonita Canyon 51.65 /mile, while Aliso Creek and El Toro are $1.18 /mile and $1.19 /mile respectively. Page VI -3 in the report indicates the average cost - per -mile for interchange -to- interchange trips for 2030 is 127 cents. NCD is 1.9 times this amount and Aliso Creek is 0.93 this amount for a 0.4 mile longer trip with the same projected volume. We do not understand the thinking behind this discrepancy. Can you explain it on an equity basis to us? The annotated Figure VI-7 shows the distances from or to a toll plaza from the closest free ramp. For the NCD ramp the tolled distance traveled averages 1.8 miles. For the Aliso Creek ramp the tolled distance traveled averages 2.2 miles, yet the 2031 toll is $1.75 less than the $4.25 NCD toll. The tolled distance traveled for the El Toro ramp averages 3.8 miles which is 2 miles longer than the NCD distance yet the 2031 toll is only $0.25 greater than the NCD toll. The recommended toll rates put a disproportionate share of the rate increase on the northern end of the SJHTC. Our City Council is particularly concerned because as rates increase, more traffic will use Coast Highway through Corona del Mar and on to MacArthur Boulevard. This is not acceptable to our community. The Santec Report Table III -6 shows that the 2000 NCD ramp toll increase caused a 22% reduction in those using the ramp. Mainline toll increases show up to a 10% increase in traffic using the NCD ramp. These are significant numbers of trips that are diverted onto Newport Beach's arterial system. Between the Pacific Ocean and the Corridor, Coast Highway is the only parallel route. A reduction of trips on the Corridor means an increase of trips on Coast Highway. Newport Coast Drive is intended to divert traffic from Corona del Mar, but if the rates for this ramp are too high, as they appear to us to be, this diversion will not occur. Attached Figure III -13 shows that for the last two years the NCD tolled ramp volumes are the highest on the corridor. Exhibit 3 reflecting future ramp projections indicates this will be the case until 2030. The rates today are only $0.25 higher than Aliso Creek. This difference increases to $1.75 by 2031 and appears to cause a 20% reduction in the NCD ramp volume. Our City Council is requesting the rates be adjusted so those using the northerly end of the S]HTC are paying equal to, or at least close to, the rates per mile of toll road used as those on the southerly end. We suggest that the Bonita Canyon (0.8 tolled miles used) and the La Paz (1 tolled mile used) have the same rate. The Newport Coast Drive (1.8 tolled miles used) and the Aliso Creek (2.2 tolled miles used) should also be the same rate. There currently exists a very easy bypass around the NCD ramp. In the northbound direction it is 0.1 mile longer and adds about 2.5 minutes to a trip. In the southbound direction it is 0.5 miles longer and adds about 2 minutes to a trip. (See Exhibit 2, Time Runs for the NCD Bypass.) If the recommended disproportionately high toll rates are implemented, by 2031 drivers using the bypass could save $3.00 and only add 3-4 minutes to their trips. This is poor fiscal planning on the part of the Toll Agency and could have dire unintended consequences for the fiscal model used in the study. May 7, 2008 Page 3 In this letter, I have focused on the 2031 toll rates as an example. The inequities for the northerly end of the SIHTC exist in all of the toll assignments. The Newport Beach City Council's position Is there should not be one segment of the toll road singled out for disproportional higher rates just because it appears to be "what the traffic will bear." Equity for all riders using the toll road should be a core principle on which toll rates are based. We do not believe that is the case with the recommendation from the study, and we have thus far failed to receive an adequate explanation for it.
