Harkless, City Clerk 949 -644 -3005, Harkless@city.newport-beach.Ga.us SUBJECT: SOUTHERN CALIFORNIA ASSOCIATION OF GOVERNMENTS (SCAG) DISTRICT 15 ELECTION: SCAG REGIONAL COUNCIL AND ORANGE COUNTY COUNCIL OF GOVERNMENTS ( OCCOG) BOARD REPRESENTATIVE RECOMMENDATION: Confirm the appointment of Mayor Pro Tern Daigle for a one -year term through May 2009 as the District 15 representative, pursuant to SCAG election procedures governing districts where there is only one SCAG member city within a district. DISCUSSION: Background: On April 29, 2008 the City received a "call for candidates" from the Interim Executive Director of the Orange County Council of Governments ( OCCOG) for the District 15 seat on the Southern California Association of Governments (SCAG) Regional Council (copy attached). The District 15 representative also automatically serves as the District 15 appointment to the OCCOG board of directors. District 15 comprises the cities of Costa Mesa, Fountain Valley and Newport Beach, pursuant to revisions to Regional Council district boundaries that were approved by SCAG's governing body on April 3, 2008. The term for the District 15 seat is one year (through May 2009). The cities of Costa Mesa and Fountain Valley are not members of SCAG and elected not to become members, therefore it has been requested that the City Council appoint one of its Council Members as the District 15 representative, pursuant to SCAG election procedures governing districts where there is only one SCAG member city within a district. Pursuant to the election requirements, Mayor Pro Tern Daigle submitted a declaration of candidacy for this position prior to the May 15, 2008 deadline. SCAG DISTRICT 15 ELECTION May 27, 2008 Page 2 Pursuant to the bylaws, the representative for each district selects their own alternate to OCCOG. Currently Council Member Gardner is the appointed alternate, however she has indicated that she can no longer serve in this capacity. Mayor Pro Tern Daigle is in the process of determining if another Newport Beach Council Member is interested in serving in this capacity. This appointment does not require Council action. In the event no one volunteers to serve in this capacity prior to the Council meeting of May 27th, it is her intent to appoint Fountain Valley Mayor Cheryl Brothers as the alternate. Mayor Brothers has expressed an interest in serving as the alternate. She served on the Board prior to the redistricting. Environmental Review: None Prepared and submitted by: LaVonne M. If there is more than one eligible and declared candidate for the District 15 election, an election will be conducted by June 2, 2008. City Clerks, please post the enclosed election notice. The District 15 seat represents the cities of Costa Mesa, Fountain Valley and Newport Beach on the SCAG Regional Council and the OCCOG Board of Directors. May 15, 2008 at 5:00 p.m. Mayors and/or Council Members from SCAG member cities in District 15 are eligible to seek election. Currently, the City of Newport Beach is the one SCAG member city in District 15. Candidates from the cities of Costa Mesa and Newport Beach shall be eligible for the District 15 seat, if their city becomes a SCAG member city by Thursday, May 15, 2008. Declarations of candidacy (name, title and city) for the SCAG / OCCOG Regional Council Representative must be received no later than Thursday, May 15, 2008. The elected District representative would represent all cities in District 15 on the six- county SCAG governing board — the Regional Council — for a one -year term. The elected SCAG District representative also automatically serves as the District 15 representative on the Orange County Council of Governments board of directors for a one -year term. Declarations of candidacy must be received by letter, fax or email by 5:00 p.m., Thursday, May 15, 2008. If two or more eligible candidates are declared for the District 15 seat, an election will be held at a place and time to be determined, no later than Monday, June 2, 2008.
