DISCUSSION: Background: The City Council adopted the Resolution establishing the Master Fee Schedule at the July 8 Council Meeting. The Master Fee Schedule and Valuation Tables establish approximately 1000 fees for services provided by the City. Following the July 8 action, staff identified corrections and updates that need to be made to the Master Fee Schedule. They include: 1. Nine Building Department grading permit fees based on grading volume that were incorrectly computed. These grading permit fees are graduated by the amount of cubic yardage of material removed or filled, in hundred cubic feet increments, and the prior calculations had consistency breaks within the steps. The revised fees correct the inconsistencies between the steps. 2. The Recreation Department's bundled special event permit fee allows applicants with many events during a year to pay a single fee for all events. There is typically only one applicant a year for this category of special event Fee Resolution and Master Fee Schedule September 9, 2008 Page 2 and the fee prior to the study was $2000. The Cost of Services Study identified the cost for this service at $3040.92. The fee for this service has been revised to reflect the cost as identified by the Study. 3. The Planning Department's phased Accessory Outdoor Dining Permit fee had not been calculated correctly. The prior stated fee for the Outdoor Dining Permit was $3316; however, based on the phasing formula, it should be $1458.57. The Heritage Sign Review Permit fee is being amended from a 'fully loaded hourly rate" to $151, based on a recommendation that was not incorporated. 4. Shelter fees were not studied in the Cost of Services Study because they are set by agreement with the shelter provider. The agreement provides for biannual adjustments in July based on changes in the Consumer Price Index (CPI). Historically, the adjustment to the shelter fees required by the agreement are memorialized in the annual updates to the Master Fee Schedule. The changes to shelter fees reflect the CPI adjustments required by the agreement. 5. The Building Valuation Tables are attached as an exhibit to the Master Fee Schedule and were to be phased in over a two-year period. The exhibit attached to the prior Master Fee Schedule did not reflect the first -year phased values. The attached proposed exhibit reflects the first -year phasing. Some valuation based fees (e.g. apartment & R3 occupancies) are reduced approximately 15% by the phasing, while others (public garages & basements) increase by approximately 20% with phasing. 6. The Uniform Fire Code has been revised since the Cost of Services Study was conducted, changing the way Fire Department Hazardous Occupancy Permit fees are calculated. The previous Hazardous Occupancy Permit fee was $187 and is proposed in the attached schedule to be based on the actual time spent, on a fully loaded hourly rate basis. 7. Council directed that full cost recovery for many fees in the July 8 Master Fee Schedule (those denoted with a "P ") be phased in over a three -year period. The prior Schedule calculated the first -year phasing at 33.3 %. The proposed Schedule uses a more accurate 33.33% factor in calculating the annual phasing. This resulted in minor difference in phased fees. Environmental Review: Not applicable. Danner Administrative Services Director Attachments: Proposed Resolution Proposed Master Fee Schedule with 2008 Building Valuation Tables RESOLUTION NO. 2008- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING THE CITY'S MASTER SCHEDULE OF FEES TO BE CHARGED FOR USER SERVICES WHEREAS, in 2006, the City of Newport Beach retained Public Resources Management ( "PRM "), to update the cost allocation plan and cost of services study for City services previously conducted by KPMG Peat Marwick LLP in 1996; and WHEREAS, the PRM study determined the actual cost of providing the services including direct labor costs, administration or 'overhead" costs and the cost of materials and supplies based on 2006/07 actual costs for the majority of City fees for service; and WHEREAS, on February 10, 1997, the City Council of the City of Newport Beach adopted Ordinance 97 -8 establishing Chapter 3.36 (COST RECOVERY FOR USER SERVICES) of the Municipal Code, and it was amended on June 24, 2008; and WHEREAS, Chapter 3.36 of the Municipal Code contains cost recovery percentages for specific services contained in the 1996 study, as it was updated by the PRM study, and speck services identified by the PRM study; and WHEREAS, the City Council of the City of Newport Beach adopted Resolution 97 -15 on February 10, 1997, adopting a Master Fee schedule for municipal services based on the 1996 study and Chapter 3.36 of the Municipal Code; and WHEREAS, the City Council introduced amendments to Chapter 3.36 on June 24, 2008, and adopted the amendments on July 8, 2008; and WHEREAS, the City Council desires the Master Fee Schedule to be updated to reflect the new costs and cost recovery percentages pursuant to the amended Chapter 3.36, and to add new fees, and delete old fees for City services pursuant to the PRM study; and WHEREAS, the City Council adopted the current Master Fee Schedule on July 8, 2008, later identified corrections and updates that need to be made to the Master Fee Schedule and desires to make those updates. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: SECTION 1: The schedule of fees for service attached to this Resolution as Exhibit "A" and the 2008 Building Valuation Table attached to this Resolution as Exhibit "B" are hereby adopted. SECTION 2: The non - development related fees imposed by this Resolution shall take effect immediately. The development related fees imposed by this Resolution shall take effect on November 8, 2008. DISCUSSION: Background: The City Council adopted the Resolution establishing the Master Fee Schedule at the July 8 Council Meeting. The Master Fee Schedule and Valuation Tables establish approximately 1000 fees for services provided by the City. Following the July 8 action, staff identified corrections and updates that need to be made to the Master Fee Schedule. They include: 1. Nine Building Department grading permit fees based on grading volume that were incorrectly computed. The revised fees are higher than those previously listed for adoption. 2. Recreation Department bundled special event permit fee was not accurate. The prior fee was $0. The revised fee is $3040.92. 3. Planning Department's phased Accessory Outdoor Dining Permit fee had not been calculated correctly. The prior stated fee for the Outdoor Dining Permit was $3316; however, it should be $1458.57. The Heritage Sign Review Permit fee is being amending from "fully loaded hourly rate" to $151, based on a recommendation that was not incorporated. Danner Administrative Services Director Attachments: Proposed Resolution Proposed Master Fee Schedule with 2008 Building Valuation Tables RESOLUTION NO. 2008- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING THE CITY'S MASTER SCHEDULE OF FEES TO BE CHARGED FOR USER SERVICES WHEREAS, in 2006, the City of Newport Beach retained Public Resources Management ( "PRM "), to update the cost allocation plan and cost of services study for City services previously conducted by KPMG Peat Marwick LLP in 1996; and WHEREAS, the PRM study determined the actual cost of providing the services including direct labor costs, administration or "overhead" costs and the cost of materials and supplies based on 2006/07 actual costs for the majority of City fees for service; and WHEREAS, on February 10, 1997, the City Council of the City of Newport Beach adopted Ordinance 97 -8 establishing Chapter 3.36 (COST RECOVERY FOR USER SERVICES) of the Municipal Code, and it was amended on July 8, 2008; and WHEREAS, Chapter 3.36 of the Municipal Code contains cost recovery percentages for specific services contained in the 1996 study, as it was updated by the PRM study, and specific services identified by the PRM study; and WHEREAS, the City Council of the City of Newport Beach adopted Resolution 97 -15 on February 10, 1997, adopting a Master Fee schedule for municipal services based on the 1996 study and Chapter 3.36 of the Municipal Code; and WHEREAS, the City Council desires the Master Fee Schedule to be updated to reflect the new costs and cost recovery percentages pursuant to the amended Chapter 3.36, and to add new fees, and delete old fees for City services pursuant to the PRM study; and WHEREAS, the City Council adopted the current Master Fee Schedule on July 8, 2008, and later identified corrections and updates that need to be made to the Master Fee Schedule and desires to make those updates. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: SECTION 1: The schedule of fees for service attached to this Resolution as Exhibit "A" and the 2008 Building Valuation Table attached to this Resolution as Exhibit "B" are hereby adopted.
