RECOMMENDATION: Authorize the City Manager to extend the Harbor Patrol contract for mooring administrative services on a month -to -month basis for $24,166.67 per month. DISCUSSION: For the past 23 years, the Orange County Sheriff's Harbor Patrol has managed the City's 1,200 moorings via a Joint Powers Agreement that the Council and Board of Supervisors had periodically renewed every five years or so. The contract officially expired on December 31, 2008, but was subsequently renewed for one more year at the same rate (approximately $110,000) while the City and County renegotiated a contract. For 2010, however, the Harbor Patrol proposed a significant increase in the yearly fee for mooring management for the same services as previously rendered. As a result, the City decided to not automatically renew the contract, but to issue a Request for Proposals (RFP) for mooring management services to see what private industry could provide. In addition, Council Policy dictates that the City must routinely issue RFPs rather than renewing contracts on a regular basis. The RFP process for mooring management services is nearly complete and the final candidates have already had an interview with the review panel. However, staff was unable to reach a decision and bring a negotiated contract to the City Council before December 31, 2009. Therefore, in order to continue services without creating undue hardship for the public, the staff has requested that the County proceed with their current Hai bar Patrol Mooring Administration —Interim Month to Month Sen ices January 12, 2010 Page 2 level of service on a month to month basis for approximately 3 -4 months. County staff have indicated they are willing to do this, at the rate they proposed for 2010. TERMS OF THE AGREEMENT: This extension will commence immediately and will expire after a contract has been executed with the vendor selected through the mooring administration RFP process. The County will invoice the City on the first of each month for the same price that they proposed for 2010 ($290,000 per year / 12 months = $24,166.67/month). Funding has been budgeted in FY 2009 -10, account 2371 -8080 for $110,000 (previous year's rates) which will last approximately 4.5 months. This will give the City plenty of time to negotiate a contract with the successful bidder in the RFP process. A formal contract is not attached because staff is asking for authority to grant a simple extension to cover this interim period. The City's payment of the County's invoice will suffice for acceptance of terms. ENVIRONMENTAL REVIEW: The City Council's approval of this item does not require environmental review.
