Accept the completed work and authorize the City Clerk to file a Notice of Completion. 2. Authorize the City Clerk to release the Labor and Materials bond 35 days after the Notice of Completion has been recorded in accordance with applicable portions of the Civil Code. 3. Release the Faithful Performance Bond one year after Council acceptance. 4. Authorize Staff to reimburse $8,500.00 to Corona del Mar Business Improvement District. Construction Contract Summary: Discussion: On August 11, 2009, the City Council authorized the award of this contract to Macadee Electrical Construction (Macadee). Under this contract, Macadee removed streetlight standards, luminaires, and appurtenances, and installed new streetlight standards, foundations, decorative mast arms, decorative light fixtures, pull boxes and cabinets. The contract has now been completed to the satisfaction of the Public Works Department. Under this contract, Macadee removed streetlight standards, luminaires, and appurtenances, and installed new streetlight standards, foundations, decorative mast arms, decorative light fixtures, pull boxes and cabinets. The contract has now been completed to the satisfaction of the Public Works Department. The contract construction costs were: CORONA DEL MAR STREETLIGHT IMPROVEMENT PROJECT Completion and Acceptance of Contract No. 4090 January 26, 2010 Page 2 Original bid amount: Actual amount of bid items constructed: Total amount of two change order: Final contract cost: $165,669.00 $164,629.00 - $1,078.00 $163,551.00 There were two change orders that resulted in a net credit of $1,078.00: Item No. Description Amount la Credit for not removing six streetlight foundations, less potholing cost. - $6,015.00 1 b Furnish and install one additional Myers service cabinet. $3,290.00 2 Additional streetfi ht painting work. $1,647.00 Total Project Change Orders - $1,078.00 When the streetlight foundations were exposed, six were found to be in satisfactory condition and not in need of replacement resulting in a credit to the City of $6,015.00. A summary of the project schedule is as follows: Estimated completion date per Master Schedule: February 12, 2010 Project award for construction: August 11, 2009 Date of Notice -to- Proceed: October 1, 2009 First day of work: October 12, 2009 Estimated completion date on Notice -to- Proceed: November 30, 2009 Actual substantial construction completion date: January 8, 2010 The project took 35 days longer than the time prescribed in the contract documents. The additional time was due to delayed delivery of the decorative light fixtures. The manufacturer is based in the east coast and its operations were impacted by harsh weather conditions. As this was beyond the control of the contractor, liquidated damages were not assessed. Environmental Review: This project was determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15302, Class 2(c) of the CEQA Implementing Guidelines. This exemption covers the removal and replacement of existing utilities with negligible expansion. Public Notice: The Notice Inviting Bids was advertised in the City's official publication and in construction industry publications. Prior to starting work, two City - prepared construction notices were distributed by the contractor to the nearby residents and businesses advising them of the work.
