Brown, City Clerk 949 - 644 -3005, (brown @newportbeachca.gov SUBJECT: ADOPTION OF RESOLUTION TO AMEND THE MEMBERSHIP AND PURPOSE & RESPONSIBILITIES OF THE CHARTER UPDATE COMMISSION; AND CONFIRM APPOINTMENTS TO THE CHARTER UPDATE COMMISSION. RECOMMENDATION: 1) Adopt Resolution No. 2010 - amending Resolution No. 2009 -91 regarding the Membership and Purpose & Responsibilities of the Charter Update Commission, and updating the areas of possible update to the Charter; 2) Confirm the Mayor's appointments of Mayor Pro Tem Henn as the non - voting Council liaison and Mayor Curry as the alternate non - voting Council liaison; and 3) Make appointments from the fourteen (14) applications submitted to serve on the Charter Update Commission. DISCUSSION: Membership Pursuant to Resolution No. 2009 -91, the Charter Update Commission shall be comprised of seven (7) citizens of the community appointed by the City Council. Council shall make an effort to appoint one member from each district of the City, but if there are no qualified applicants from any district that position can be filled by an applicant from another district. In order to assist in answering any questions the Commission may have and to facilitate the meetings, Mayor Curry suggested that the Commission also include a non - voting Council liaison (Mayor Pro Tem Henn) and alternate non - voting Council liaison (Mayor Curry). This change in membership is reflected in the draft resolution. Purpose & Responsibilities Resolution No. 2009 -91 indicates that a Charter Update Commissioner must be able to attend meetings on specific, predetermined dates. As written, this provides no flexibility in scheduling meetings. The suggested language change is reflected in the draft resolution. In addition, staff identified four additional areas of possible update to the Charter to achieve modemization and efficiency. They are added to the list of issues to be considered by the Commission if you approve the resolution and the revised list is attached as Exhibit C. The issues are: • C3 was amended to allow for review of Charter section 1113 dealing with the procedure for a capital improvement tax so that it can be made consistent with Proposition 218. • M8 was added to allow for review of Charter section 1404 dealing with misdemeanor penalties to allow for flexibility it setting the penalties in the future should California law change and should the Council so desire. Appointments At the Regular Meeting of December 8, 2009, the City Council established the Charter Update Commission. The City Clerk advertised the vacancy pursuant to Council Policy A- 2 on Saturday, December 12, 2009, and the deadline to apply was Friday, January 8, 2010. Mayor Curry and Council Members Webb and Selich were appointed to the Council Ad Hoc Appointments Committee on January 12, 2010, to review the applications. Since only fourteen (14) applications were received and not all Councilmanic districts were represented, the Council Ad Hoc Appointments Committee recommended that all the applications be forwarded to Council for appointment. Voting will be conducted by paper ballot that is supplied by the City Clerk. The Charter Update Commission is currently scheduled to complete its work by June, 2010. Council shall make an effort to appoint one member from each district of the City, but if there are no qualified applicants from any district that position can be filled by an applicant from another district; and WHEREAS, the purpose and responsibilities of the Charter Update Commission requires that the Commission members attend meetings on specific dates; and WHEREAS, the City Council wishes to amend the membership of the Charter Update Commission to also include a non - voting Council liaison and an alternate non- voting Council liaison; and WHEREAS, the City Council wishes to amend the purpose and responsibilities of the Charter Update Commission to allow for more flexibility in scheduling meetings. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that 1. The Council hereby expands the membership of the Charter Update Commission to include a non - voting Council liaison and an alternate non - voting Council liaison, and amends the meeting attendance requirement, as reflected in Attachment A. 2. The Council hereby expands the list of issues to be addressed by the Charter Update Commission by adopting the Revised List of Issues attached as Attachment B to this resolution. Charter section 403 directs that vacancies on the Council shall be filled by appointment within thirty days, or set an election, and the appointee shall sit until the next general municipal election and his or her successor is qualified. Charter 1401 effectively provides that there is to be no new oil exploration, drilling, production, or refining in the City that was not in existence at the effective date of the Charter or on the effective date of newly annexed properties. This requirement potentially limits the City's ability to enter into modern financial transactions. Franchising procedures are now governed by the municipal code. Allowing for municipal code regulation of the procedures as opposed to Charter regulation provides for flexibility in a changing economic environment. Centralized purchasing may work in some cases, but not in all. Advances in technology and controls may make decentralized purchasing less expensive. Does the Council wish to address this issue, either to clarify how this provision falls within term limits or to otherwise modify the provisions? Consider ways to make these provisions more flexible in order to allow for modification of existing drilling while not opening the City as a whole for new oil exploration or drilling.
