SUBJECT: SUNSET RIDGE PARK - APPROVAL OF AMENDMENT NO. 3 WITH
EPT DESIGN FOR ADDITIONAL FINAL DESIGN SERVICES AND
AMENDMENT NO. 2 WITH BONTERRA CONSULTING FOR
ADDITIONAL ENVIRONMENTAL SERVICES
ISSUE:
Should the City Council approve budget amendments for Professional Services
Agreements with EPT Design for additional final design services and BonTerra
Consulting for additional environmental services related to the Sunset Ridge Park
Project?
RECOMMENDATION:
1. Approve Amendment No. 3 to Professional Services Agreement (PSA) with EPT
Design, of Irvine, for Landscape Architectural Services for preparation of the Sunset
Ridge Final Design at a not to exceed price of $71,660 and authorize the Mayor and
City Clerk to execute the Amendment; and
2. Approve Amendment No. 2 to Professional Services Agreement (PSA) with
BonTerra Consulting, of Costa Mesa, for environmental document preparation for
the Sunset Ridge Park project at a not to exceed price of $85,000 and authorize the
Mayor and City Clerk to execute the Agreement.
DISCUSSION:
On June 10 2008, the City Council approved the Concept Plan for the Sunset Ridge Park
which designated that access would need to be provided through the south -east corner of
the Newport Banning Ranch property, just west of the park property.

Design and environmental consultant contracts were approved by the City Council on
November 25, 2008 with EPT Design for $598,558 and BonTerra Consulting for
$203,047.
Since approval of the Design contract, EPT has continued working on the project plans
and specifications. The plans are approximately 75% complete and we are expecting a
submittal that will be ready for Coastal Commission permitting within a month or so.
During the past 12 months, several additional tasks have been required to refine the
project design, the largest portion of the efforts centered on the access road design
alternatives. In addition, a structural engineer sub - consultant was employed to design the
stacked stone wall that will separate the residential landscape buffer and the sports field
along the Newport Crest properties. Those additional services amounted to an additional
$71,660 in design fees and are further detailed in the attached Amendment No. 3.
BonTerra Consulting has completed and circulated the Draft EIR for the Sunset Ridge
Park Project. The EIR has been more complicated than originally envisioned in the
November 2008 scope of work and has resulted in additional costs to the consultant. At
the City's request, BonTerra has worked closely with City staff throughout the project
design stages to screen out design options that would create an environmental impact.
BonTerra was asked to provide preliminary environmental impact assessments for
numerous variations of the original project design, which resulted in project design
changes and required additional impact analyses. In addition, the option of disposing the
export soil material on the Newport Banning Ranch property was not included in their
original scope of work and resulted in additional environmental review. This unanticipated
involvement in the project design efforts was not included in the scope of services
submitted by BonTerra. BonTerra also submitted applications to regulatory agencies to
accelerate permit processing, which was not included in their original scope. Lastly, the
comments received during the initial scoping and comments to the DEIR have been
extensive and very detailed. This has a direct impact on project effort. For example, the
original scope of worked called for approximately 40 hours of staff time to address the
comments received. We have received over 100 comments on the project and BonTerra
has spent well above this original 40 hour estimate. For these reasons, a budget
augment of $85,000 for additional work on the Sunset Ridge Park EIR has been
submitted and is attached as Amendment No. 2.
Environmental Review:
Contracts for design and environmental review are not projects subject to CEQA.

AMENDMENT NO. THREE TO
PROFESSIONAL SERVICES AGREEMENT
WITH EPT DESIGN FOR
SUNSET RIDGE PARK FINAL DESIGN SERVICES
THIS AMENDMENT NO. THREE TO PROFESSIONAL SERVICES
AGREEMENT, is entered into as of this day of , 2010, by and
between the CITY OF NEWPORT BEACH, a Municipal Corporation ( "CITY "), and EPT
DESIGN, INC., a California Corporation whose address is 9821 Irvine Center Drive,
Irvine, California 92618 ( "CONSULTANT "), and is made with reference to the following:
RECITALS:
A. On September 25, 2007, CITY and CONSULTANT entered into a Professional
Services Agreement, hereinafter referred to as "AGREEMENT," for professional
engineering services for the conceptual design drawings for the landscape
development of Sunset Ridge Park, hereinafter referred to as "PROJECT."
B. CITY and CONSULTANT have entered into two separate AMENDMENTS of the
AGREEMENT, the latest dated November 25, 2008.
C. Due to circumstances not reasonably foreseeable at the time of the
AGREEMENT or prior AMENDMENTS CITY desires to enter into this
AMENDMENT NO. THREE to reflect additional services not included in the
AGREEMENT or prior AMENDMENTS and to increase the total compensation.
D. CITY desires to compensate CONSULTANT for additional professional services
needed for PROJECT.
E. CITY and CONSULTANT mutually desire to amend AGREEMENT, hereinafter
referred to as "AMENDMENT NO. THREE," as provided here below.
NOW, THEREFORE, it is mutually agreed by and between the undersigned parties as
follows:
1. ADDITIONAL SERVICES TO BE PERFORMED
In addition to the services to be provided pursuant to the AGREEMENT and
AMENDMENT NO.'s ONE and TWO, CONSULTANT shall diligently perform all
the services described in AMENDMENT NO. THREE including, but not limited to,
all work set forth in the Scope of Services attached hereto as Exhibit A and
incorporated herein by reference. The City may elect to delete certain tasks of
the Scope of Services at its sole discretion.
2. COMPENSATION
City shall pay Consultant for the services on a time and expense not -to- exceed
basis in accordance with the provisions of this Section and the Schedule of
Billing Rates attached to the AGREEMENT. Consultant's total amended
compensation for all work performed in accordance with this Agreement,
including all reimbursable items and subconsultant fees, shall not exceed Eight
Hundred Thirty -Nine Thousand, One Hundred Eighteen Dollars and no /100
($839,118.00) without prior written authorization from City.
3.1 The amended compensation reflects Consultant's additional
compensation for additional services to be performed in accordance with
this AMENDMENT NO. THREE, including all reimbursable items and
subconsultant fees, in an amount not to exceed Seventy -One Thousand,
Six Hundred Sixty Dollars and no /100 ($71,660.00), without prior written
authorization from City.
4. INTEGRATED CONTRACT
Except as expressly modified herein, all other provisions, terms, and covenants
set forth in AGREEMENT shall remain unchanged and shall be in full force and
effect.

these options. Coordinate and distribute digital file and

Based on the position that the City of Newport Beach and
Caltrans have taken with regard to the need to widen PCH
as well as the need for a new traffic signal at the new
intersection, additional dry utility tasks will be necessary to
accomplish the results needed for these undertakings.
Task 1: Widening of Pacific Coast Highway
This undertaking requires tasks for the coordination with
the Civil, Caltrans, the City of Newport Beach, Southern
California Gas, and Southern California Edison, to have
dry utility facilities relocated and installed. Tasks will
include o need to prepare new off -site dry utility plans that
are subject to Caltrans Encroachment Permit, coordination
with the Civil and the Dry Utility Plans for the preparation
of plans and processing of Billing Documents and
Agreements as well as assistance with Permit processing
tasks related to the Undertakings.

Fees will not include the preparation of any Traffic Control
Plans as it is anticipated that the Traffic Control Plans
prepared by the Civil for the roadway improvements will
accommodate the dry utility tasks. Please note that design
plans for the City of Newport Beach Street Lighting are
also excluded from this addendum request. Should the City
require a separate Street Light Plan, a separate scope will

"New Business" submittals and processing are handled
separate from any billable relocation projects by the dry

Fabritec Structures
Four fabric structures have been proposed for shade on
the project site. Two at the ball field, one at the resfroom,
and one for the children's play area, EPTDESIGN has

Consultant will develop one concept direction and produce
CAD model outlining basic geometry of structures)
consistent with standard tension structure design practices.
This stage will consist of one refinement maximum.
Task 2: Form Finding

Task 3: Final Engineering Model Analysis
We will take the preliminary model and develop a final
design model and conduct final analysis using the local
design codes.

Task 1: Review Park Landscape Planting Palettes
BonTerra Consulting will review plant palettes proposed for
the Sunset Ridge Park landscape and habitat enhancement
areas for compliance with project documentation and
permits, as well as for general biological suitability. The
review will focus on (1) habitat value and (2) plant species
diversity and suitability in terms of existing project- specific
and local native vegetation types. The review of park
landscape plant palettes will also consider potential for
invasiveness and hybridization with existing native species,
as well as ornamental value. A brief Letter Report that
documents any recommended plant palette revisions will
be provided to the City of Newport Beach and
EPTDESIGN. BonTerra Consulting will attend up to three
meetings with the City of Newport Beach, EPTDESIGN,
and other project team members to discuss proposed plant
palettes and any recommended revisions.

Subject: Budget Augment for the Sunset Ridge Park Project
Dear Mr. Sinacori:
BonTerra Consulting submits this request for a budget augment for additional work requested
by the City on the Sunset Ridge Park Environmental Impact Report (EIR). The following
summarizes our additional work efforts on the project:
Regulatory Permitting. Submittal of permit applications to the regulatory agencies
including U.S. Fish and Wildlife Service (USFWS) and the U.S. Army Corps of Engineers
(USAGE) is not part of the EIR preparation work program. At the request of the City, we
have attended three meetings with the City and these regulatory agencies, provided GIs
services, reviewed draft versions of supplemental documentation for the Biological
Application to the USFWS in coordination with the USACE, and participated in
conference calls with City staff and regulatory agencies. All tasks were necessary to
accelerate permit processing by USFWS and USACE by adding City's Biological
Application to that previously submitted by the Newport Banning Ranch applicant.
Modifications to the Project Description. BonTerra Consulting was asked to provide
preliminary environmental impact assessments for 12 variations of the original project
design. Unanticipated project design changes included changes in location of
component park uses, the alignment and grade of the access road, and the grade of the
park itself. City staff requested iterative impact analyses for numerous alternative
alignments for the roadway extending from Coast Highway to the park. Subsequent
inclusion of a haul road and two soil stockpile areas on the Newport Banning Ranch
property also required unanticipated impact analyses. These changes resulted in
additional GIs analysis, changes to graphics, additional biological field work, revisions to
EIR sections, word processing, and editing.
Air Quality. Because the City wanted to evaluate options for the park and for the road
prior to the selection of a preferred project alternative, BonTerra prepared air quality
modeling for an additional five options that included variations on park elevation, off -site
disposal of excess dirt, and variations to the road alignment. A&AhkdftAL� A

Technical Reports Prepared by the City's Project Team. BonTerra Consulting's scope
assumed review of existing technical studies and data on geology and soils, hydrology
and water quality, and visual simulations. Based on our review, we identified gaps in the
technical data with respect to geology and soils, and hydrology and water quality. In
these first reports, no data was provided for that portion of the site associated with the
Newport Banning Ranch property. Out of scope work included generating new technical
data that was necessary to fill technical gaps.
Hazards and Hazardous Materials. BonTerra Consulting was to summarize the findings
of a previously- prepared, hazardous materials database search. We subsequently
learned that the City did not have any data related to a potential, abandoned oil drilling
site and possible attendant contamination on the park parcel. Utilizing information
provided by the Newport Banning Ranch applicant, we prepared a revised,
comprehensive section addressing possible contamination from previous oil drilling
operations.
Initial Study /Notice of Preparation. Rather than preparing one draft of the Initial Study
and Notice of Preparation (IS /NOP) and one set of revisions, BonTerra prepared several
versions of the document because of subsequent City- directed modifications to the
project. In addition, due to the public controversy, the City included additional reviewers
after we were authorized to finalize the IS /NOP. As a result we had two more sets of
revisions.
• EIR Alternatives. Our scope assumed three alternatives; we analyzed five alternatives in
the EIR.
• Additional review cycles. Our scope assumed one round of review of the EIR by the City.
The City added one additional round of review in order that the screencheck EIR be
revised and then submitted to the Newport Banning Ranch applicant for review.
• Management. The schedule for the project has been extended because of the project
revisions, resulting in a longer duration of involvement in the project. The management
budget and overall cost of the project was based on an approximately 10 -month budget;
instead, our involvement will be approximately 15 months.
• Meetings. Our scope assumed 12 meetings including telephone meetings. We have
attended approximately 20 meetings, with participation by several persons from our firm
(Dana Privitt, Ann Johnston, Gary Medeiros, Pam Castens, etc.). Each meeting required
at least two hours of participation. In addition to the meetings, we participated in
telephone meetings and conference calls which exceeded the number of actual
meetings.
Responses to Comments. The City has received over 75 comment letters with extensive
comments (50 -100 comments per letter). Approximately 250 hours (54 hours budgeted)
of staff time will be needed to respond to these comment letters and to additional
comment letters expected with the second public review period. We also conducted a
subsequent jurisdictional delineation at the request of the City to respond to comments
regarding the presence of additional wetlands on the project site.
