The Commission set out a tentative schedule of regular and special meetings with the goal of making a recommendation on the draft zoning code on or before June 29, 2010. Report of the actions of the Planning Commission Regular Meeting: Item No. 1 Minutes dated April 22, 2010 Summary: Amend minutes and continue to June 3, 2010 meeting. (6 Ayes, 1 Abstained) Item No.2 D'Ambrosia Residence (PA2010 -017) 1500 Serenade Terrace Summary: The application consists of a code amendment to change the front -yard setback established on Districting Map No. 24 from 38 feet to 16 feet. Discussion by the Commission focused potential impacts to the character of the neighborhood. One member of the public, the president of the Irvine Terrace Community Association, spoke is support of the application. This item was recommended for approval. (All Ayes) Item No.3 Cliff Drive Appeal (PA2009 -149) 2949 Cliff Drive Summary: An appeal of the Zoning Administrator's decision to deny Modification Permit No. MD2009 -030. Modification Permit No. MD2009 -030 would have allowed the following encroachments into required setbacks: up to 1 foot into the 4 -foot side yard setback for a 10- foot -10- inch -high portion of an outdoor room; up to 5 feet 4 inches into the 10 -foot rear yard setback for an 11- foot -3- inch -high portion of an Planning Commission Agenda Report May 25, 2010 Page 2 outdoor room; and 5 feet 4 inches into the 10 -foot rear yard setback for a 14 -foot- 3- inch -high exterior fireplace. After hearing from the applicant's representative, the Commission concluded there were no facts in support of the findings required to approve the modification permit. This item was denied. (All Ayes) Item No.4 Newport Bay Marina (PA2001 -210) 2300 Newport Boulevard Summary: Review and approval of a Construction Traffic Management and Control Plan and a Parking Management Plan for the Newport Bay Marina project. This item was removed from calendar until as such time the applicant has submitted an adequate Construction Traffic Management and Control Plan and a Parking Management Plan. ITEM NO.2 D'Ambrosia Residence (PA2010 -017) 1500 Serenade Terrace SUMMARY: A code amendment to change the front -yard setback established on Districting Map No. 24 from 38 feet to 16 feet. CEQA COMPLIANCE: The project is categorically exempt under Section 15305, of the California Environmental Quality Act (CEQA) Guidelines - Class 5 (Minor Alterations in Land Use Limitations). The project involves a change in setback established on a Districting Map, which is consistent with this exemption. ACTION: 1) Conduct public hearing; and 2) Adopt Resolution No. recommending City Council adoption of Code Amendment No. CA2010 -002 (Attachment No. PC1) to revise Districting Map No. 24 to establish a 16 -foot front -yard setback at 1500 Serenade Terrace. ITEM NO. 3 Cliff Drive Appeal (PA2009 -149) 2949 Cliff Drive SUMMARY: An appeal of the Zoning Administrator's decision to deny Modification Permit No. MD2009 -030. Modification Permit No. MD2009 -030 would have allowed the following encroachments into required setbacks: up to 1 foot into the 4-foot side yard setback for a 10- foot -10- inch -high portion of an outdoor room; up to 5 feet 4 inches into the 10 -foot rear yard setback for an 11- foot -3- inch -high portion of an outdoor room; and 5 feet 4 inches into the 10 -foot rear yard setback for a 14- foot -3- inch -high exterior fireplace. CEQA COMPLIANCE: The project is categorically exempt under Section 15301, of the California Environmental Quality Act (CEQA) Guidelines - Class 1 (Existing Facilities). The accessory structures are alterations that involve no expansion of use. ACTION: 1) Conduct a de novo hearing; and 2) Deny the appeal and uphold and affirm the decision of the Zoning Administrator and deny Modification No. 2009 -030, subject to the findings included within the attached draft resolution (Attachment No. PC1).
