HomeMy WebLinkAbout04 - Federal Transportation Enchancement Program Funding from OCTACITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 4 June 8, 2010 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Public Works Department Iris Lee, Senior Civil Engineer 949 - 644 -3323 or ilee @newportbeachca.gov SUBJECT: ADOPT A RESOLUTION AUTHORIZING APPLICATION FOR FEDERAL TRANSPORTATION ENHANCEMENT PROGRAM FUNDING FROM ORANGE COUNTY TRANSPORTATION AUTHORITY RECOMMENDATION: Adopt Resolution No. 2010- authorizing the submittal of Bristol Street North Landscape Improvements project to be considered for Transportation Enhancement program funding from Orange County Transportation Authority (OCTA). DISCUSSION: Transportation Enhancement (TE) funding of approximately $12.4 million may be made available for FY 10/11 to 11/12 from the Federal Transportation Act through the Safe, Accountable, Flexible, Equity Act: A Legacy for Users (SAFTEA -LU). The TE program will fund projects that better integrate transportation facilities into the surrounding communities including landscape projects and other projects that enhance aesthetics. Orange County Transportation Authority (OCTA) is initiating a call for projects to be funded under the TE program. With Council approval, Staff will submit an application package to OCTA for the Bristol Street North Landscape Improvements project for TE funding. This project will construct a water - efficient irrigation system and drought - tolerant landscaping within the dirt shoulder along the southerly side of Bristol Street North between Jamboree Road and Campus Drive. As part of the application, OCTA requires City approval of the attached resolution. It should be noted that the federal SAFETEA -LU legislation expired September 30, 2009. Congress has extended SAFETEA -LU until December 31, 2010; therefore, the TE program and this call are subject to the passage of the next transportation reauthorization bill. Resolution for Transportation Enhancement Program Funding from Orange County Transportation Authority June 8, 2010 Page 2 Environmental Review: This project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15304 of the CEQA Guidelines. This exemption covers the new landscaping with minor alterations to land. The Notice of Exemption was filed at the Orange County Recorder's Office on February 16, 2010. . As stipulated in the TE guidelines, the project must obtain National Environmental Policy Act (NEPA) approval. NEPA requirements will be addressed prior to award of construction. Prepared by: Senior Civil Engineer SuhmittPri hv- Attachment: Transportation Enhancement Funding Resolution RESOLUTION NO. 2010- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AUTHORIZING APPLICATION FOR FUNDS FOR THE TRANSPORTATION ENHANCEMENT (TE) PROGRAM UNDER THE 2005 SAFE, ACCOUNTABLE, FLEXIBLE, EFFICIENT, TRANSPORTATION ACT - LEGACY FOR USERS FOR BRISTOL STREET NORTH LANDSCAPE IMPROVEMENTS PROJECT. WHEREAS, the United State Congress enacted the Safe, Accountable, Flexible, Efficient, Transportation Equity Act ā€” Legacy for Users August 2005, replacing the Transportation Equity Act for the 21 5{ Century which make funds available to the Orange County Transportation Authority (OCTA) for transportation enhancement activities; and WHEREAS, OCTA has established the procedures and criteria for reviewing proposals; and WHEREAS, the City of Newport Beach possesses authority to nominate transportation enhancement activities and to finance, acquire, and construct the proposed project; and WHEREAS, by formal action the City Council of City of Newport Beach authorizes the nomination of Bristol Street North Landscape Improvements, including all understanding and assurances combined therein, and authorizes the person identified as the official representative of the City of Newport Beach to act in connection with the nomination and to provide such additional information as may be required; and WHEREAS, the City of Newport Beach will maintain and operate the property acquired, developed, rehabilitated, or restored for the life of the resultant facility or activity; and WHEREAS, with the approval of the California Department of Transportation (Caltrans) and OCTA, the City of Newport Beach or its successors in interest in the property may transfer the responsibility to maintain and operate the property; and WHEREAS, the City of Newport Beach will give Caltrans and OCTA's representatives access to and the right to examine all records, books, papers or documents related to the transportation enhancement activity; and WHEREAS, the City of Newport Beach will cause work on the project to be commenced within a reasonable time after receipt of notification from the State of California that funds have been approved by the Federal Highway Administration and that the project will be carried to completion with reasonable diligence; and WHEREAS, the City of Newport Beach will comply where applicable with provisions of the California Environmental Quality Act, the National Environmental Policy Act, the American with Disabilities Act, and any other federal, state, and /or local laws, rules and /or regulations; NOW, THEREFORE, BE IT RESOLVED that the City of Newport Beach hereby authorizes David Webb as the official representative of the City of Newport Beach to apply for the Transportation Enhancement Activities Program under the Safe, Accountable, Flexible, Efficient Transportation Equity Act ā€” Legacy for Users for Bristol Street North Landscape Improvements. BE IT FURTHER RESOLVED, that the City of Newport Beach agrees to fund its share of the project costs and any additional costs over the identified programmed amount.
