Approve the project plans and specifications. 2. Award Contract No. 4228 to R.E. Shultz Construction for the Total Bid Price of $44,160.00, and authorize the Mayor and the City Clerk to execute the contract. 3. Establish a contingency amount of $6,640.00, approximately 15 percent to cover the cost of unforeseen work. Discussion: At 9:00 a.m. on June 10, 2010, the City Clerk opened and read the following bids for the replacement or recovering of resilient play surfaces at the West Newport Community Center, Bayview Park, Eastbluff Park, and San Miguel Park: BIDDER TOTAL BID AMOUNT Low R.E. Shultz Construction $44,160.00 2 Aghapy Group, Inc. $47,020.00 3 Malibu Pacific, Inc. $93,250.00 The low total bid amount is seven percent below the Engineer's Estimate of $47,700.00. The low bidder, R.E. Shultz Construction, possesses a California State Contractors License Classification "A" as required by the project specifications. A check of the Contractor's references indicates they have satisfactorily, completed similar projects for our City and other municipalities. This contract consists of removing and disposing of existing improvements, grading, constructing P.C.C. base and flexible play surfaces, repairing and overlaying worn inflexible play surfaces with new flexible play surface material, adjusting playground equipment, and completing other incidental items in place as required by the Drawings and Specifications. Playground Resilient Surface Renovation — Phase 2 —Award of Contract No. 4494 July 6, 2010 Page: 2 While the City's standard contingency is ten percent, for small projects, this could easily be depleted by minor changes in conditions. Therefore, staff requests a contingency of $6,640.00, representing approximately 15 percent of the contract value. Pursuant to the Contract Specifications, the Contractor will have 25 consecutive working days to complete the work. Environmental Review: The project was determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (c) of the CEQA Implementing Guidelines. This exemption covers the maintenance and repair or existing facilities involving negligible or no expansion of existing facilities. Public Notice: The Notice Inviting Bids was advertised in the City's official publication and in construction industry publications. Affected businesses and residents surrounding the work sites will be notified by the Contractor prior to the start of the project. Geotechnical and Material Testing Services: Geotechnical, material testing, and survey services are not anticipated for this project.
