(NextG) requesting the City's consent to install and operate a Distributed Antenna System (DAS) network and associated fiber optic network within the City's public right -of -way? RECOMMENDATION: 1. Staff recommends that the City Council conduct a Special Review of the applications, pursuant to Section 15.70.070(F) of the Newport Beach Municipal Code (NBMC); and 2. Deny Telecommunications Permits No. TP2009 -003, TP2009 -004, TP2009 -005, TP2009 -006, TP2009 -007 and the fiber optic network associated with those particular sites; and 3. Approve Telecommunications Permits No. TP2009 -008 and TP2009 -009, with conditions, to allow the installation of wireless telecommunications facilities (telecom facilities) at 3215 (CS) Marcus Avenue and 202 (CS) Santa Ana Avenue and the fiber optic network associated with those particular sites; and NextG Telecom Permits July 6, 2010 Page 2 4. Direct staff to prepare the appropriate resolutions for consideration and adoption at the next City Council Meeting. INTRODUCTION Project Description NextG has filed seven applications with the City to install antenna nodes within the public right -of -way (PROW) along or in the vicinity of East and West Coast Highway. A location map is included as well as photographs of existing and proposed conditions at each location as Attachment CC 1. The nodes (radio transmitters and receivers connected via fiber optic cables to NextG's wireless clients) include an omni - directional antenna, measuring approximately two inches in diameter and 26 inches in length, and an equipment box, measuring 8.2 inches in depth by 18 inches in width by 20.9 inches in height. The antennas would be attached at or near the top of new or existing free - standing poles located within the PROW. The equipment boxes would be mounted to the exterior of the new or existing free - standing poles and would maintain a minimum clearance of 8 feet above existing grade. The facilities do not require the use and placement of other support equipment, such as ground- mounted equipment cabinets or pedestal meters, for power to support the nodes. Rather, NextG has in place an unmetered rate with Southern California Edison (SCE), under which terms the installations would utilize a fuse box, measuring 6 inches in depth by 12 inches in width by 12 inches in height, and a disconnect switch measuring 4 inches in depth by 6 inches in width by 9 inches in height. The fuse box and disconnect switch are proposed to be placed in a small below grade vault next to the new free - standing poles, or mounted on the existing utility poles below the equipment box. A brief project description of the telecom facility proposed by NextG for each application is as follows: 1. Telecom Permit No. TP2009 -003 for 1101 (CS) East Coast Highwav: An omni- directional antenna mounted atop a proposed new free - standing monopole at an overall height of 32 feet above existing grade, located near the southeast corner of Jamboree Road and East Coast Highway. 2. Telecom Permit No. TP2009 -004 for 2346 (CS) East Coast Highway. An omni- directional antenna mounted atop a proposed new free - standing monopole at an overall height of 30 feet 3 inches above existing grade, located at the northwest corner of MacArthur Boulevard and East Coast Highway. 3. Telecom Permit No. TP2009 -005 for 4501 (CS) West Coast Highway: An omni- directional antenna mounted atop a proposed new free - standing monopole at an NextG Telecom Permits July 6, 2010 Page 3 overall height of 30 feet 3 inches above existing grade, located at the southeast corner of Superior Avenue and West Coast Highway. 4. Telecom Permit No. TP2009 -006 for 5100 (CS) East Coast Highway: An omni- directional antenna mounted atop a proposed new free - standing monopole at an overall height of 32 feet above existing grade, located at the northwest corner of Cameo Highlands Drive and East Coast Highway. 5. Telecom Permit No. TP2009 -007 for 6228 (CS) East Coast Highway. An omni- directional antenna mounted atop a proposed new free - standing streetlight pole owned by NextG at an overall height of 26 feet 7 inches above existing grade, located at the southwest corner of Newport Coast Drive and East Coast Highway. 6. Telecom Permit No. TP2009 -008 for 3215 (CS) Marcus Avenue: An omni- directional antenna mounted at a height of 24 feet 7 inches on an existing 34 -foot tall SCE utility pole, located at the northwest corner of 32nd Street and Marcus Avenue. 7. Telecom Permit No. TP2009 -009 for 202 (CS) Santa Ana Avenue: An omni- directional antenna attached near the top of a SCE utility pole at 35 feet above grade, located at the southeast corner of Santa Ana Avenue and Old Newport Boulevard. As part of this application, NextG proposes to replace an existing 31- foot-7- inch -tall SCE utility pole with a new wooden utility pole that would be 43 feet high above existing grade. BACKGROUND Applicable Ordinances The DAS network proposed by NextG is subject to the provisions of Chapters 15.70 and 13.20 of the NBMC. Chapter 15.70 sets forth the regulations and design standards for the installation of wireless telecom facilities, including telecom facilities proposed in the PROW. Because NextG is installing wireless telecom facilities for its customer, it is subject to Chapter 15.70, Section 15.70.020 provides that all telecom facilities are subject to the provisions of this Chapter and Title 13 to the extent a facility is proposed to be located in the PROW. The stated purpose of Chapter 15.70 is: "......is to provide for wireless telecommunication ( "telecom ") facilities on public and private property consistent with federal law while ensuring public safety, reducing the visual effects of telecom equipment on public streetscapes, protecting scenic, ocean and coastal views, and otherwise mitigating the impacts of such facilities. NextG Telecom Permits July 6, 2010 Page 4 More specifically, the regulations contained herein are intended to: (a) Encourage the location of antennas in non - residential areas. (b) Strongly encourage co- location at new and existing antenna sites. (c) Encourage telecom facilities to be located in areas where adverse impacts on the community and on public views are minimized." Chapter 13.20 provides policies regarding the use of the PROW. Because NextG proposes to use the PROW, it is subject to Chapter 13.20. Specifically, Section 13.20.030 of the code states: "It is the policy of City to promote undergrounding of facilities whenever and wherever feasible. Whenever existing facilities are located underground along a particular PROW, new facilities must be installed, at company's sole expense, underground along that PROW. Further, whenever any above ground facilities are located or relocated underground by a public utility provider along a particular PROW, other Companies shall concurrently relocate company's facilities underground on a cost - sharing basis for all companies involved in a manner consistent with applicable law. No new above ground facilities will be allowed in areas where facilities are undergrounded." (Emphasis added) An above ground facility is defined as "all structures, poles, pedestals, cabinets, electric meters and any other facility installed above surrounding grade in the PROW excluding antennas" (Section 13.20.020). Special Review by City Council Section 15.70.050 (B. Location) states that locations for telecom facilities shall be selected according to the following priority order, and also states that location categories "e° through "h" shall require special view by City Council under the provisions of Section 15.70.070: a. Wall, roof or existing co- location structure or site; b. Existing pole, light standard, or utility tower; c. Commercial sign or architectural feature; d. New or existing "stealth" structure other than a false tree; e. New false tree; f. New "Slim Jim" monopole (i.e. with no antenna elements other than the pole itself); g. New standard monopole with attached antenna elements; h. New lattice tower. NextG Telecom Permits July 6, 2010 Page 5 Section 15.70.070 provides that special review by City Council is required due to the potential for greater- than -usual visual or other impacts a telecom facility may have on nearby property owners, residents, and businesses. Therefore, the five requests to install new free - standing monopoles or a streetlight pole owned by NextG in the PROW require special review by City Council. Section 15.70.070 also provides that the Planning Director may refer any telecom application to the City Council for special review in order to serve the public interest. In this case, the Planning Director has referred the two applications requesting to allow the installation of telecom facilities on existing or new SCE utility poles to City Council for special review because the applications were submitted in conjunction with the other five applications and are a part of the DAS network proposed by NextG. Regulatory Issues NextG Networks of California, Inc. holds a Certificate of Public Convenience and Necessity ( "CPCN ") issued by the California Public Utilities Commission ( "CPUC ") to provide facilities -based telephone service in portions of California, including Newport Beach. NextG is not a wireless service provider, does not have any relevant FCC licenses, does not own or license radio frequency spectrum to be used at these sites, nor does it sell its wireless services to consumers. Rather, NextG constructs and operates DAS networks, which provide access and signal transfer services to third -party wireless service providers. These DAS networks consist of antenna nodes that are typically mounted to existing streetlight poles or new or existing utility structures where permitted by local regulations. NextG is currently in the process of expanding a DAS network in Orange County. A component of this network is to install antenna nodes along the coast, from San Clemente to Newport Beach, and north into Seal Beach. NextG has entered into rights - of -way use agreements with some cities including Dana Point and Laguna Niguel. Next G claims that the CPCN issued by the CPUC and its membership in the Southern California Joint Pole Committee exempts NextG's proposed projects from compliance with the City's ordinances that regulate wireless telecom facilities and with the California Environmental Quality Act (CEQA). In 2009, staff informed NextG representatives that the proposed installations would be subject to the provisions of Chapters 15.70 and 13.20 ( "Wireless Telecommunications Facilities" and "Public Rights -of- Way ") of the NBMC. Staff also informed NextG representatives that the City encourages the installation of equipment on existing City streetlight poles, existing utility poles, or other existing structures in order to comply with the intent and purpose of Chapters 15.70 and 13.20, which includes limiting the number of above - ground installations in the PROW. Staff has also advised NextG of the standard terms of a license agreement to install a facility on existing City -owned streetlight poles, including the fee of $1,500 per month. This fee is based on the City's approved rate schedule (Attachment CC 2). A similar fee of approximately $1,100 is NextG Telecom Permits July 6, 2010 Page 6 currently being paid by Sprint and T- Mobile for facilities installed on City -owned streetlight poles at two different locations in the City. The agreement with each of these wireless service providers was entered into prior to an update to the telecom rates in July 2008. In response, NextG claims a statewide franchise to use the PROW and cites to NBMC Section 15.32.070 (F) contending that this section grants an exception for the undergrounding of certain types of facilities, including "antennae, associated equipment and supporting structures, used by a utility for furnishing communication services." The Office of the City Attorney has notified NextG that it is not exempt from the City's undergrounding requirements. While the NBMC may exempt some existing equipment used by utilities for communication services, it is not applicable to the three new monopoles NextG proposes within the City's Underground Utility Districts #11, 3, and 4, because the resolutions designating these underground districts specifically limit the placement of above - ground facilities in the PROW. Further, Chapter 13.20 regulates the PROW and codifies the City's established policy requiring the undergrounding of above - ground facilities whenever feasible, particularly in areas where facilities are already undergrounded. ANALYSIS Required Findings Per Section 15.70.050 (6.2), applicants proposing telecom facilities that include the installation of a new monopole shall be required to show to the satisfaction of the City Council that: a. Higher priority locations are either not available or are not feasible; b. Establishment of a facility on a new standard monopole or lattice tower is necessary to provide service; and c. Lack of such a facility would result in a denial of service. Per Section 15.70.070 (F), when reviewing an application subject to special review, the City Council may approve an application if it makes the following findings: a. The approval is necessary to allow the facility to function as intended and identified alternatives to the proposal are not feasible. 'Per Section 15.70.030 (Definitions), feasible means capable of being accomplished in a successful manner within a reasonable period of time, taking into account environmental, physical, legal, and technological factors. The approved facility will not result in conditions which are materially detrimental to nearby property owners, residents, and businesses, nor to public health or safety. The City Council may approve, approve subject to conditions, or deny the telecom permit. 1. Telecom Permit No. TP2009 -003 for 1101 (CS) East Coast Hiohwa 2. Telecom Permit No. TP2009 -004 for 2346 (CS) East Coast Highway 3. Telecom Permit No. TP2009 -005 for 4501 (CS) West Coast Highway 4. Telecom Permit No. TP2009 -006 for 5100 (CS) East Coast Highway 5. Telecom Permit No. TP2009 -007 for 6228 (CS) East Coast Highwav At each of the above listed locations, NextG proposes the installation of a new free- standing monopole or streetlight pole owned by NextG in the PROW. Staff does not believe facts support the findings required to grant approval of the five telecom permits listed above for the following reasons: Finding: Higher priority locations are either not available or are not feasible. In each of the proposed locations, a higher priority location (as specified by Section 15.70.050 (B)) is present such as existing utility poles, existing City -owned streetlight poles or other existing structures. The applicant has not shown installing a DAS node on a higher priority location is not feasible. Finding: Establishment of a facility on a new standard monopole or lattice tower is necessary to provide service. NextG does not own or control the radio frequency spectrum to be transmitted or received at its nodes, nor does it sell wireless services to consumers. Instead, they operate DAS networks to provide access and signal transfer services to third -party wireless service providers. In addition, a higher priority location such as an existing utility pole, existing City-owned streetlight pole or other existing structure is present in the vicinity of each of the proposed locations. Thus, the establishment of a new free- standing monopole or streetlight pole owned by NextG in the PROW is not necessary to provide service. Finding: Lack of such a facility would result in a denial of service. Because NextG does not own or control the radio frequency spectrum to be transmitted or received at its nodes, nor does it sell wireless services to consumers, lack of such a facility would not result in a denial of service. NextG can have no significant gap in coverage as it is not a wireless carrier, but rather a vendor of wireless equipment used by wireless carriers. MetroPCS, NextG's customer, has not proven that there is a significant gap in its coverage with the City, or in the areas around the five locations listed above. NextG Telecom Permits July 6, 2010 Page 8 Finding: The approval is necessary to allow the facility to function as intended and identified alternatives to the proposal are not feasible. As indicated, alternative locations are present in the vicinity of each location where NextG proposes to install a free - standing monopole or streetlight pole in the PROW, including existing utility poles, existing City -owned streetlight poles and other existing structures. The applicant has not shown that identified alternatives are not feasible, and the City would permit attachment to the alternative types of higher priority locations described in the NBMC. Finding: The approved facility will not result in conditions which are materially detrimental to nearby property owners, residents, and businesses, nor to public health or safety. Staff believes the installation of new free - standing monopoles or a new streetlight pole in the PROW would be in conflict the regulations of Chapter 13.20, which codifies the City's established policy to underground facility whenever feasible, and prohibits new above - ground facilities in areas where facility are undergrounded. All utilities have been undergrounded in each of the locations proposed by NextG for the installation of new free - standing monopoles or streetlight poles. Conclusion Staff believes the applicant's proposal for new monopoles within the PROW is inconsistent with the City ordinances that prohibit new above - ground facilities in the PROW. Recommendation Staff recommends the City Council deny the five applications listed above which request the City's consent to allow the installation of new free - standing monopoles or a streetlight pole owned by NextG in the PROW because such installations are not permitted pursuant to the NBMC. Environmental Review Pursuant to Section 15270 of the CEQA Guidelines, projects which a public agency rejects or disapproves are not subject to CEQA review. 6. Telecom Permit No. TP2009 -008 for 3215 (CS) Marcus Avenue NextG requests approval allowing the installation of an omni - directional antenna mounted at a height of 24 feet 7 inches on an existing 34 -foot tall SCE utility pole, located at the northwest corner of 32nd Street and Marcus Avenue. An equipment box, measuring 8.2 inches in depth by 18 inches in width by 20.9 inches in height, would be mounted to the exterior of the pole and maintain a minimum clearance of 8 feet above NextG Telecom Permits July 6, 2010 Page 9 grade. A fuse box measuring 6 inches in depth and 12 inches width by 12 inches in height, and an electrical disconnect switch measuring 4 inches in depth by 6 inches in width by 9 inches in height, are proposed to be mounted directly to the utility pole below the equipment box. Compliance with Height, Location and Design Standards: Section 15.70.050 (Height and Location) provides that antennas may be installed on utility poles within the PROW at a maximum height of 35 feet, and designates existing utility poles as a priority location for the installation of telecom facilities. Section 15.70.060 establishes design standards, and provides criteria for consideration by the reviewing authority, which includes blending, screening and size of the proposed facility. In this case, the proposed antenna and equipment box are minimal in size, and blend in with the existing utility pole. Staff recommends that the fuse box and electrical disconnect switch be placed in a 17 inch by 30 inch vault below grade adjacent to the existing utility pole in order to reduce visual impacts associated with the facility. Section 15.70.060 also requires that telecom facilities and /or support equipment proposed to be located in the PROW comply with the provisions of Title 13. The Public Works Department has reviewed the proposed project plans and submittal items, and has provided a condition of approval requiring that all work conducted by the applicants in the PROW shall be approved under an encroachment permit, and that the construction plans shall satisfy the requirements of Chapter 13.20. Radio Frequency Emissions Safety Evaluation: Congress has delegated sole national authority to the Federal Communications Commission (FCC) to set radio frequency standards in the United States. While Congress by law prohibits the City from setting our own RF emissions safety standards (or even adopting the FCC's standards as our own), Congress does permit the City to determine whether a proposed wireless facility meets the required FCC Office of Engineering and Technology Bulletin 65 requirements for RF emissions safety. In the case of wireless sites located on shared utility poles, the provisions of CPUC General Order 95, Rule 94 set out the requirements to ensure compliance with the FCC rules. Staff has received and reviewed the FCC Local and State Government Advisory Committee (LSGAC) Guide Appendix A Form, (Attachment CC 3) submitted by NextG on behalf of MetroPCS. The form discloses that the proposed site will comply with the required FCC RF emissions safety standards because the antenna will be mounted to an existing SCE utility pole. The proposed installation in this location ensures that RF emissions at ground level will not exceed the Bulletin 65 General Population /Uncontrolled emissions safety limit, and that the requirements of CPUC General Order 95, Rule 94 are also demonstrated. NextG Telecom Permits July 6, 2010 Page 10 Because the FCC form discloses that the proposed NextG installation in this location will comply with the Commission's RF emissions safety rules, no further inquiry is warranted, and the City does not have a basis to deny or further condition the project because of concerns regarding RF emissions safety. Required Findings: Staff believes that the following facts support the findings required to grant approval for the proposed installation at this location: a. Finding: The approval is necessary to allow the facility to function as intended and identified alternatives to the proposal are not feasible. Facts in Support of Finding: NextG selects locations based on the direction of their customers (in this case, MetroPCS). The DAS nodes are interspersed with existing traditional wireless macro cell sites to provide a system that meets the coverage objectives of the customer. Approving the installation of a DAS node would allow the facility to function as intended in this location. Alternatives to the proposal were not identified because existing utility poles are considered a priority location for the installation of telecom facilities. b. The approved facility will not result in conditions which are materially detrimental to nearby property owners, residents, and businesses, nor to public health or safety. Facts in Support of Finding: The installation of a DAS node in this location is consistent with the height, location and design standards specified in Sections 15.70.050 and 15.70.060 of the NBMC. Existing utility poles are a priority location for the installation of a telecom facility; and the proposed antenna and equipment box are minimal in size and will blend in with the existing SCE utility pole. The fuse box and electrical disconnect switch would be placed in a 17 inch by 30 inch vault below grade adjacent to the existing utility pole in order to reduce visual impacts associated with the facility. Installation of the facility in the PROW shall require the approval of an encroachment permit from the Public Works Department and shall require compliance with the provisions of Chapter 13.20. The proposed facility will not have an effect on public streetscapes, or scenic ocean and coastal views because the facility is proposed to be installed on an existing SCE utility pole located in the PROW, and in an area where there are no scenic ocean or coastal views. The proposed facility will comply with the applicable rules and regulations of the FCC. As conditioned, the approved DAS node in this location will not result in conditions that are materially detrimental to nearby property owners, residents, and businesses, nor to public health or safety. NextG Telecom Permits July 6, 2010 Page 11 Recommendation: Staff believes that the findings can be made to approve the installation of a wireless telecom facility in this location, and recommends that City Council approve the application subject to conditions (Attachment CC 4). If City Council concurs with staffs recommendation, staff will prepare a resolution with findings and conditions of approval for consideration at the next City Council meeting. Environmental Review This activity has been determined to be categorically exempt under the requirements of the California Environmental Quality Act under Class 1 (Existing Facilities). 7. Telecom Permit No. TP2009 -009 for 202 (CS) Santa Ana Avenue At this location, NextG requests to install an omni- directional antenna attached near the top of a new SCE utility pole at 35 feet above grade. The SCE utility pole is located at the southeast corner of Santa Ana Avenue and Old Newport Boulevard. NextG requests City permission to remove the existing 31- foot -7- inch -tall SCE utility pole and install a new wooden utility pole that would be 43 feet tall. An equipment box, measuring 8.2 inches in depth by 18 inches in width by 20.9 inches in height, would be mounted to the exterior of the pole and maintain a minimum clearance of 8 feet above grade. A fuse box measuring 6 inches in depth and 12 inches width by 12 inches in height, and an electrical disconnect switch measuring 4 inches in depth by 6 inches in width by 9 inches in height, are proposed to be mounted directly to the utility pole below the equipment box. Compliance with Height, Location and Design Standards: Pursuant to Section 15.70.050 (Height and Location), existing utility poles are considered a priority location for the installation of wireless telecom facilities. NextG requests that a new SCE utility pole be allowed to be installed at a height of 43 feet above grade in order to accommodate the relocation of existing aerial feeds and power lines. Staff is concerned that a new utility pole that is 11 feet 5 inches taller than the existing utility pole would have a negative impact on public streetscapes and on scenic views to the bay and ocean from public streets in the vicinity. Therefore, staff recommends that the omni - directional antenna be installed on top of the existing SCE utility pole at a height not to exceed 35 feet, which would place the antenna above the existing aerial feeds and power lines. This would be consistent with Section 15.70.050 which provides that antennas may be installed on utility poles within the public right -of- way at a maximum height of 35 feet. Staff has prepared a condition of approval requiring that the facility be designed utilizing the existing SCE utility pole with the omni- directional antenna placed on top of the existing pole (Attachment CC 5). NextG Telecom Permits July 6, 2010 Page 12 Section 15.70.050.0 requires that a new telecom facility proposed within 1,000 feet of an existing facility shall be required to co- locate at the same site as the existing facility unless the reviewing authority determines, based on evidence submitted by the applicant, that such co- location is not feasible. This site is within 1,000 feet of existing facilities located 3333 West Coast Highway and 3121 West Coast Highway. NextG has submitted a statement informing the City that because traditional wireless macro cell facilities operate at significantly higher power and signal output levels in comparison to NextG's facilities, the operational characteristic results in system incompatibilities that would inhibit NextG's ability to provide adequate signal propagation. In short, the existing macro cell facilities located at 3121 West Coast Highway would overwhelm the DAS facility and NextG would experience signal obstruction and attenuation if they were to co- locate. Based on this statement, staff believes such co- location is not feasible. Section 15.70.060 establishes design standards for free - standing antennas, and provides criteria for consideration by the reviewing authority, which includes blending, screening and size of the proposed facility. In this case, the proposed antenna and equipment box are minimal in size, and would blend in with the existing utility pole. Staff recommends that the fuse box and electrical disconnect switch be placed in a 17 inch by 30 inch vault below grade adjacent to the existing utility pole in order to reduce visual impacts associated with the facility. Section 15.70.060 also requires that telecom facilities and /or support equipment proposed to be located in the PROW comply with the provisions of Title 13. The Public Works Department has reviewed the proposed project plans and submittal items, and has provided a condition of approval requiring that all construction plans shall satisfy the requirements of Chapter 13.20, and that all work conducted by the applicants in the PROW shall be approved under an encroachment permit. Radio Frequency Emissions Safety Evaluation: As stated above, Congress has delegated sole national authority to the Federal Communications Commission (FCC) to set radio frequency standards in the United States. While Congress by law prohibits the City from setting our own RF emissions safety standards (or even adopting the FCC's standards as our own), Congress does permit the City to determine whether a proposed wireless facility meets the required FCC Office of Engineering and Technology Bulletin 65 requirements for RF emissions safety. In the case of wireless sites located on shared utility poles, the provisions of CPUC General Order 95, Rule 94 set out the requirements to ensure compliance with the FCC rules. Staff has received and reviewed the FCC LSGAC Guide Appendix A Form, (Attachment CC 6) submitted by NextG on behalf of MetroPCS. The form discloses that the proposed site will comply with the required FCC RF emissions safety standards because the antenna will be mounted to an existing SCE utility pole. The proposed installation in this location ensures that RF emissions at ground level will not exceed the NextG Telecom Permits July 6, 2010 Page 13 Bulletin 65 General Population /Uncontrolled emissions safety limit, and that the requirements of CPUC General Order 95, Rule 94 are also demonstrated. Because the FCC form discloses that the proposed NextG installation in this location will comply with the Commission's RF emissions safety rules, staff has determined that no further inquiry is necessary or justified, and the City does not have a basis to deny or further condition the project because of concerns regarding RF emissions safety. Required Findings: Staff believes that the findings can be made to grant approval for the proposed installation at this location based on the following facts in support of the findings: a. Finding: The approval is necessary to allow the facility to function as intended and identified alternatives to the proposal are not feasible. Facts in Support of Finding: NextG selects locations based on the direction of their customers (in this case, MetroPCS). The DAS nodes are interspersed with existing traditional wireless macro sites to provide a system that meets the coverage objectives of the customer. Approving the installation of a DAS node in this location would allow the facility to function as intended. Staff explored an alternative of requiring the facility to be co- located on an existing wireless facility site at either 3333 West Coast Highway or 3121 West Coast Highway, but the proposal was rejected because co- location would not be feasible. b. The approved facility will not result in conditions which are materially detrimental to nearby property owners, residents, and businesses, nor to public health or safety. Facts in Support of Finding: The installation of a DAS node in this location, as conditioned, would be consistent with the height, location and design standards specified in Sections 15.70.050 and 15.70.060 of the NBMC. Existing utility poles are a priority location for the installation of telecom facilities. Staff recommends a condition be imposed requiring the retention of the existing SCE utility pole with the omni- directional antenna installed on top of the existing pole. The proposed antenna and equipment box are minimal in size and would blend in with the existing SCE utility pole. The fuse box and electrical disconnect switch would be conditioned to be placed in a 17 inch by 30 inch vault below grade adjacent to the existing utility pole in order to reduce visual impacts associated with the facility. Installation of the facility in the PROW shall require the approval of an encroachment permit from the Public Works Department and shall require compliance with the provisions of Chapter 13.20. As conditioned, the proposed facility will not have an affect on public streetscapes, or scenic ocean and coastal views because the facility is proposed to be installed on an existing SCE utility pole located in the PROW. The approved DAS node in this location, as proposed by staff, will not result in conditions that are materially detrimental to nearby property owners, residents, and businesses, nor to public health or safety. Antenna attached to buildings or other pre - existing structures with equipment cabinetry on City public property (not right of way) — Equipment cabinetry will be charged based on square feet at the same rate as above, plus a flat rate of $500 /month. 4. Similar consideration shall be given to any other existing or proposed wireless communications facility that may be located on the subject property. The OCSCD that the meeting has taken place. The applicant recognizes that the frequencies used by the cellular facility located at 3215 (CS) Marcus Avenue are extremely close to the frequencies used by the City of Newport Beach for public safety. This proximity will require extraordinary "comprehensive advanced planning and frequency coordination" engineering measures to prevent interference, especially in the choice of frequencies and radio ancillary hardware. This is encouraged in the "Best Practices Guide" published by the Association of Public -safety Communications Officials- International, Inc. (APCO), and as endorsed by the Federal Communications Commission (FCC). 15. The applicant shall not prevent the City of Newport Beach from having adequate spectrum capacity on the City's 800 MHz radio frequencies at any time. 16. Prior to activation its facility, the applicant shall submit to a post - installation test to confirm that "advanced planning and frequency coordination" of the facility was successful in not interfering with the City's Public Safety radio equipment. This test will be conducted by the Communications Division of the Orange County Sheriff- Coroner Department or a Division- approved contractor at the expense of DRAFT Conditions for TP2009 -008 for 3215 (CS) Marcus Avenue Page 2 the applicant. This post - installation testing process shall be repeated for every proposed frequency addition and /or change to confirm the intent of the "frequency planning" process has been met. 17. Prior to activation of the facility, the applicant shall submit a letter to the Planning Director prepared by the Orange County Sheriff - Coroner Department indicating that the OCSD has reviewed the results of the post - installation test and that the facility will not cause interference with the City's Public Safety radio equipment. 18. Within 30 days after installation of the telecom facility, a radio frequency (RF) compliance and radiation report prepared by a qualified RF engineer acceptable to the City shall be submitted in order to demonstrate that the facility is operating at the approved frequency and complies with FCC standards for radiation. If the report shows that the facility does not so comply, the use of the facility shall be suspended until the facility is modified to comply and a new report has been submitted confirming such compliance. 19. Prior to issuance of an encroachment permit, a deposit of $1,000 shall be paid to the City of Newport Beach. This deposit is required by the Planning Department to ensure preparation and submittal of the RF Compliance and Radiation Report, referenced in the above Condition. The deposit will be used to defray any and all fees associated with review of the report by an independent technical consultant, pursuant to Section 15.70.070 B -10 of the Telecom Ordinance. Any unused deposit fees will be refunded to the applicant upon determination of compliance with the approved frequency and FCC standards. 20. The applicant shall provide a "single point of contact" in its Engineering and Maintenance Departments that is monitored 24 hours per day to insure continuity on all interference issues, and to which interference problems may be reported. The name, telephone number, fax number and e-mail address of that person shall be provided to the Planning Department and Newport Beach Police Department's Support Services Commander prior to activation of the facility. 21. Should interference with the City's Public Safety radio equipment occur, use of the facility shall be suspended until the radio frequency is corrected and verification of the compliance is reported. 22. The applicant shall insure that lessee or other user(s) shall comply with the terms and conditions of this permit, and shall be responsible for the failure of any lessee or other users under the control of the applicant to comply. 23. Should the property be sold or otherwise come under different ownership, any future owners or assignees shall be notified of the conditions of this approval by either the applicant, current property owner or leasing agent. The telecom facility approved by the permit shall comply with any easements, covenants, conditions or restrictions on the underlying real property upon which the facility is located. 25. The telecom facility shall not be lighted except as deemed necessary by the Newport Beach Police Department for security lighting. The night lighting shall be at the lowest intensity necessary for that purpose and such lighting shall be shielded so that direct rays do not shine on nearby properties. Prior to the final of building permits, the applicant shall schedule an evening inspection by the Code Enforcement Division to confirm compliance with this condition. 26. The operator of the telecom facility shall maintain the facility in a manner consistent with the original approval of the facility. 27. The City reserves the right and jurisdiction to review and modify any telecom permit approved pursuant to Chapter 15.70 of the Newport Beach Municipal Code, including the conditions of approval, based on changed circumstances. The operator shall notify the Planning Department of any proposal to change the height or size of the facility; increase the size, shape or number of antennas; change the facility's color or materials or location on the site; or increase the signal output above the maximum permissible exposure (MPE) limits imposed by the radio frequency emissions guidelines of the FCC. Any changed circumstance shall require the operator to apply for a modification of the original telecom permit and obtain the modified telecom permit prior to implementing any change. 28. This telecom permit may be modified or revoked by the City Council should they determine that the facility or operator has violated any law regulating the telecom facility or has failed to comply with the requirements of Chapter 15.70 of the NBMC, or this telecom permit. 29. Any operator who intends to abandon or discontinue use of a telecom facility must notify the Planning Director by certified mail no less than 30 days prior to such action. The operator or property owner shall have 90 days from the date of abandonment or discontinuance to reactivate use of the facility, transfer the rights to use the facility to another operator, or remove the telecom facility and restore the site. This is encouraged in the "Best Practices Guide" published by the Association of Public- safety Communications Officials - Intemational, Inc. (APCO), and as endorsed by the Federal Communications Commission (FCC). 16. The applicant shall not prevent the City of Newport Beach from having adequate spectrum capacity on the City's 800 MHz radio frequencies at any time. Prior to activation its facility, the applicant shall submit to a post - installation test to confirm that "advanced planning and frequency coordination" of the facility was successful in not interfering with the City's Public Safety radio equipment. This test will be conducted by the Communications Division of the Orange County Sheriff - Coroner Department or a Division - approved contractor at the expense of the applicant. This post - installation testing process shall be repeated for every proposed frequency addition and /or change to confirm the intent of the "frequency planning" process has been met. 18. Prior to activation of the facility, the applicant shall submit a letter to the Planning Director prepared by the Orange County Sheriff - Coroner Department indicating that the OCSD has reviewed the results of the post - installation test and that the facility will not cause interference with the City's Public Safety radio equipment. 19. Within 30 days after installation of the telecom facility, a radio frequency (RF) compliance and radiation report prepared by a qualified RF engineer acceptable to the City shall be submitted in order to demonstrate that the facility is operating at the approved frequency and complies with FCC standards for radiation. If the report shows that the facility does not so comply, the use of the facility shall be suspended until the facility is modified to comply and a new report has been submitted confirming such compliance. 20. Prior to issuance of an encroachment permit, a deposit of $1,000 shall be paid to the City of Newport Beach. This deposit is required by the Planning Department to ensure preparation and submittal of the RF Compliance and Radiation Report, referenced in the above Condition. The deposit will be used to defray any and all fees associated with review of the report by an independent technical consultant, pursuant to Section 15.70.070 B -10 of the Telecom Ordinance. Any unused deposit fees will be refunded to the applicant upon determination of compliance with the approved frequency and FCC standards. 21. The applicant shall provide a "single point of contact" in its Engineering and Maintenance Departments that is monitored 24 hours per day to insure continuity on all interference issues, and to which interference problems may be reported. The name telephone number, fax number and e-mail address of that person shall be provided to the Planning Department and Newport Beach Police Department's Support Services Commander prior to activation of the facility. 22. Should interference with the City's Public Safety radio equipment occur, use of the facility shall be suspended until the radio frequency is corrected and verification of the compliance is reported. 23. The applicant shall insure that lessee or other user(s) shall comply with the terms and conditions of this permit, and shall be responsible for the failure of any lessee or other users under the control of the applicant to comply. Should the property be sold or otherwise come under different ownership, any future owners or assignees shall be notified of the conditions of this approval by either the applicant, current property owner or leasing agent. 25. The telecom facility approved by the permit shall comply with any easements, covenants, conditions or restrictions on the underlying real property upon which the facility is located. 26. The telecom facility shall not be lighted except as deemed necessary by the Newport Beach Police Department for security lighting. The night lighting shall be at the lowest intensity necessary for that purpose and such lighting shall be shielded so that direct rays do not shine on nearby properties. Prior to the final of building permits, the applicant shall schedule an evening inspection by the Code Enforcement Division to confirm compliance with this condition. 27. The operator of the telecom facility shall maintain the facility in a manner consistent with the original approval of the facility. 28. The City reserves the right and jurisdiction to review and modify any telecom permit approved pursuant to Chapter 15.70 of the Newport Beach Municipal Code, including the conditions of approval, based on changed circumstances. The operator shall notify the Planning Department of any proposal to change the height or size of the facility; increase the size, shape or number of antennas; change the facility's color or materials or location on the site; or increase the signal output above the maximum permissible exposure (MPE) limits imposed by the radio frequency emissions guidelines of the FCC. Any changed circumstance shall require the operator to apply for a modification of the original telecom permit and obtain the modified telecom permit prior to implementing any change. 29. This telecom permit may be modified or revoked by the City Council should they determine that the facility or operator has violated any law regulating the telecom facility or has failed to comply with the requirements of Chapter 15.70 of the NBMC, or this telecom permit. 30. Any operator who intends to abandon or discontinue use of a telecom facility must notify the Planning Director by certified mail no less than 30 days prior to such action. The operator or property owner shall have 90 days from the date of abandonment or discontinuance to reactivate use of the facility, transfer the rights to use the facility to another operator, or remove the telecom facility and restore the site. However, attachments to streetlights to be viable, the terms must be reasonable, as described in prior meetings and in my previous letter. Without rehashing the point of my previous letter, the City is currently asking for a license fee that is more than double the amount of revenue that NextG receives for its installation from its customer, and more than 100 times the actual cost to place and own our own pole. If it is the City's wish to maintain its perceived "market" rate for its infrastructure, it may do so for others; at this juncture, however, NextG has presented both options (new poles and existing poles) for the City's consideration. Respectfully, we disagree with your assertion regarding the undergrounding requirements, and exceptions thereto, contained in the City's Code. Chapter 15.32 of the City's Code specifically and explicitly sets forth the City's rules regarding undergrounding of facilities in the public rights of way. Section 15.32.070(F) explicitly states: I NextG has applied for seven total sites in the City as follows: two (2) attachment proposed on infrastructure jointly owned by NextG through the Southern California Joint Pole Committee, and five installations which could either be collocated on a City streetlight, or for a new pole pursuant to Section 15.32.070(F). Antennae, associated equipment and supporting structures, used by a utility for furnishing communication services. Newport Beach Code § 15.32.070(17). This language is very specific and very clear. It authorizes NextG to install antennae and associated equipment, including supporting structures (i.e. poles) even in areas that have otherwise been wholly undergrounded pursuant to City Council Resolution. Resolution Nos, 8382, 8721, 8143 and 851 all contain recitals that the Resolutions are passed "in the manner prescribed by said Chapter 15.32." There is no language in those Resolutions eliminating the various exceptions in Section 15.32.070 and no amendment to these Resolution that eliminates the exemption in §15.21.070(F). Your argument that Chapter 13.20 somehow overrides and essentially eliminates the exception in Section 15.32.070(F) is meritless. Although Chapter 13.20 generally governs use of the public rights of way, it contains no specific provision governing undergrounding— because that is governed by Chapter 15.32. Section 13.20.030 articulates the City's general "policy" in favor of undergrounding, but that is a general statement of policy; precatory language that merely reiterates what has been codified, specifically in Chapter 15.32. There is nothing in Chapter 13.20 that overrides or eliminates the specific rules regarding undergrounding set forth in Chapter 15.32. Indeed, your argument that Chapter 13.20, generally, means that NextG cannot install new poles to support its antennas and associated equipment would effectively repeal not only Section 15.32.070(F) but all of the exceptions set forth in Section 15.32.070. It is a well established cannon of statutory interpretation that a specific provision, such as Section 15.32.070(F), controls over a generalized policy. Moreover, it is well established that a statute must be interpreted to give effect to all of its provisions. Your asserted reading would eliminate Section 15.32.070 altogether, in violation of that rule. Of course, this issue could be avoided if the City were willing to allow access to its existing poles at a fair and reasonable price. Indeed, we certainly believe that Chapter 13.20 could be used by the City as a mechanism for finding a way to accommodate the placement of NextG's facilities on City-owned infrastructure on business terms that are acceptable. Chapter 13.32. 030(A) seeks to facilitate or soothe City's preference for undergrounding by encouraging facilities to be collaboratively used by everyone "on a cost - sharing basis." The City's policy to share facilities "on a cost- sharing basis," are words that are strikingly similar to cost -basis language found in Cal. Gov't Code §50030 (providing that fees "shall not exceed the reasonable costs of providing the service for which the fee is charged and shall not be levied for general revenue purposes. ") Indeed, the City's policy in Chapter 13, together with the explicit limits on municipal right of way p. 2 of 4 fees enshrined in Cal. Gov't Code §50030 could, and should, be used by City policymakers to facilitate NextG's use of existing infrastructure rather than installing new poles ? NextG stands by its application. Without waiving its rights under Public Utility Code § 7901 and Government Code § 50030, NextG's offer for attachment to municipal infrastructure remains on the table (at $500 /year), as does NextG's alternative applications for new poles (consistent with §15.32.070(F) and with P.U. Code §7901). As you know, there is an upcoming presentation before the City Council on July bw, 2010, and I plan on attending the presentation in person, and would welcome the opportunity to confer with you beforehand. I have had only a few minutes to review the associated Staff Report, but on page 5, my recollection of the Santa Ana Avenue site is that the buildings along the portion of that street behind the former Arches Restaurant enjoy beautiful views of the harbor, peninsula and ocean beyond. The potential for a greater -than -usual impact on private views would seem to me to be a sufficient reason for Council review not only of the proposed sites along Coast Highway, but also of NextG's original proposed new, taller SCE utility pole in the Santa Ana Avenue viewshed (and sufficient reason for rejection of that proposal). Although the proposed antenna appears very small, the installation of a larger pole to accommodate it would certainly be an intrusion that the neighbors might not appreciate – especially when as you say elsewhere rejection of NextG's proposal would not result in denial of service in the usual sense. I also notice that Condition 11 of the Draft Conditions of Approval for the 202 (CS) Santa Ana Avenue facility mentions "Marcus Avenue." 1 believe this was intended to read "Santa Ana Avenue." Finally, I would, in general, be more aggressive about questioning the justification information provided by cell carriers and associated companies like NextG. I don't know the details of the NextG proposal, but as an example of the need for greater scrutiny, in preparation for my trip to Washington I was given a pre-paid T- Mobile phone. With it, at least as a consumer, I was unable to verify the existence of `any' problem with in- vehicle signal levels at the Irvine Avenue /23rd Street intersection – despite repeated assertions by T- Mobile that there is a coverage gap there so severe as to require a new facility. Their phone worked fine there. I need to get back to my friends now.
