Development Agreement Annual Compliance Review
ISSUE
Continuance of the Hoag Development Agreement annual compliance review
BACKGROUND
The City Council conducted a public hearing on April 27, 2010, on Hoag's compliance
with the terms of the Development Agreement. The City Council directed Hoag to
submit additional information and then continued the public hearing to June 22, 2010.
On June 22, 2010, the public hearing was continued again to this meeting due to
unresolved issues regarding noise mitigation at the loading dock and cogeneration plant
plume reduction.
RECOMMENDATION
Continue this item to August 10, 2010.
DISCUSSION
Staff has been diligently working with Hoag to resolve the two outstanding issues noted
above. Hoag needs additional time to finish their concept plan to implement noise
mitigation at the loading dock and to finalize the information outlining what steps Hoag
took to reduce the water vapor plume at the cogeneration plant as required pursuant to
the Development Agreement.

Dear Mayor Curry and Members of the City Council:
Based on recent conversations between the City staff and Hoag Hospital staff, it was mutually
agreed that a further continuance of the hearing on the Hoag Hospital Development Agreement
annual compliance review would be beneficial in resolving several outstanding issues.
Accordingly, in the mutual interest of Hoag and the City, Hoag Hospital is respectfully
requesting the City Council to continue the hearing on the annual review of the Hoag Hospital
Development Agreement to your meeting on August 10, 2010.
Your acceptance and granting of this request for a continuance is appreciated.
