RECOMMENDATION After review of the supplementary material submitted by Hoag, conduct public hearing and determine that Hoag is in good faith interim compliance with the Development Agreement. BACKGROUND The City Council conducted a public hearing on April 27, 2010, on Hoag's compliance with the terms of the Development Agreement. City Council determined that Hoag is in good faith compliance with the Development Agreement with the exception of their efforts to implement required noise mitigation at the main loading dock. Questions were also raised about vapor plume reduction at the cogeneration plant. City Council continued the public hearing and directed Hoag to submit a plan to address loading dock noise mitigation. Hoag submitted additional noise compliance information, cogeneration plan operational data and a plan to address noise to implement noise mitigation at the loading dock. That information was reviewed at the June 22, 2010, meeting. The meeting was continued to this meeting due to unresolved issues regarding noise mitigation at the loading dock and cogeneration plant plume reduction. On August 13, 2010, Hoag submitted a supplemental compliance report that includes a comprehensive noise compliance report, information regarding cogeneration plant plume reduction, and a new plan for noise mitigation at the loading dock. Noise Compliance Report Hoag's noise consultant, RS Acoustics, has prepared a revised comprehensive noise compliance report based upon the City's noise consultant's review. The revised report provides clarification and concludes that Hoag is in compliance with applicable noise limits provided within the Hoag Hospital Planned Community Text. 2. Cogeneration Plant Energy Curtailment (plume reduction) Section 8.5 of the amended DA requires Hoag to curtail the cogeneration plant's effective heat rejection by 33% to reduce plume formation during certain atmospheric conditions between 7:00 AM and 7:00 PM from November 15t to April 30th of each year. Hoag installed a weather station in 2009 that allows them to identify plume formation conditions as they occur so they can reduce cooling tower load to reduce the cooling tower plume. As noted in the April 27, 2010, report to the City Council, several months of weather station data was not provided to staff and Hoag has subsequently supplied that information to staff. Hoag's supplemental information indicates that Hoag's engineers comply with the DA through a variety of techniques depending upon specific operational conditions. The principal method is to turn off one generator for a month each year for necessary routine maintenance. Hoag schedules and will continue to schedule maintenance during the months November through April period. Not operating one generator during the month and staggering the three generators reduces heat rejection by 33% for three of the six months. During other three months, Hoag shifts the load to the upper plant and /or reduces the load of the three generators within the cogeneration plant. Hoag only does this when atmospheric conditions are ripe for plume formation. The specific technique on any given day varies and is dependent upon system factors and the hospital's heating and cooling needs. Hoag's chief engineer of record for the plant has certified that the plant has been operated in accordance with the energy curtailment requirement during all 6 months where the energy curtailment is required. Staff believes that the plant is being operated in compliance with Section 8.5 of the DA. 3. Noise Mitigation — Loading Dock As noted in the June 22, 2010, report, Hoag will be installing approximately 650 square feet of sound absorbing panels on the west facing wall of the building at the loading dock. The type of panel is consistent with Mitigation Measure 3.4 -5 and the amount exceeds the minimum specified, which was 450 square feet. Hoag has received approval from the Office of Statewide Health Planning and Development (OSHPD) for the installation of the panels. With completion of the installation, which is scheduled to occur shortly, staff believes Hoag will be in good faith compliance. Hoag Hoapital Annual DA Compliance Review September 14, 2010 Page 3 of 3 Mitigation Measure 3.4 -6 of the SEIR requires relocation of and the construction of a three -sided enclosure around the existing trash compactor (including a roof). The existing cardboard bailer is required to be enclosed with a three -sided enclosure as well. The open sides of each enclosure would face away from residents at Villa Balboa. Hoag was previously hesitant to move forward with implementing this mitigation measure given that they abandoned their plans for the "South Building," which made investing in the loading dock area desirable from a logistical perspective. Hoag's first proposal included partial enclosures of the bailer and compactor, but the compactor was not proposed to be relocated. Hoag was directed to prepare plans that would comply. Hoag's new plan provides for an enclosure of the bailer consistent with Mitigation Measure 3.4 -6. Hoag's new plan for the trash compactor is to enclose the compactor equipment although the roll -off bin that it is attached to would not be enclosed. Additionally, the compactor with the bin is not being proposed to be relocated. Although this proposal is not precisely what Mitigation Measure 3.4 -6 requires, Hoag has indicated to staff their commitment to relocate the trash compactor and provide a full enclosure as part of Hoag Hospital's construction of a new structure or structures on the Upper Campus requiring the transfer of buildable square footage from the Lower Campus or reconfiguration of the loading dock. In staffs opinion, this is a good faith partial and substantial compliance with Mitigation Measure 3.4 -6 for an interim period until such time when the trash compactor will be relocated and full compliance will be achieved as part of Hoag Hospital's construction of a new structure or structures on the Upper Campus requiring the transfer of buildable square footage from the Lower Campus or reconfiguration of the loading dock. Given that there is no noise violation today as indicated in the comprehensive noise compliance report, additional mitigation (fill compliance) is not necessary at this time. In summary, staff believes that Hoag has resolved the outstanding issues from the prior meetings and is in good faith interim compliance with the terms of the development agreement acknowledging that the relocation and full enclosure of the trash compactor will be required as indicated above. RECOMMENDATION Conduct public hearing and determine that Hoag is in good faith compliance with the terms of the Development Agreement. DISCUSSION In 1994, the City executed a Development Agreement (DA) related to the long term development and expansion of Hoag Hospital. The agreement has a 25 -year term and expires in 2019. In May of 2008, the DA and the Hoag Planned Community Text (PC Text) were amended to allow the hospital to increase the intensity of future development on the upper campus commensurate with a reduction in intensity of future development of the lower campus. Additional improvements to reduce noise, improve landscaping within the lower campus, and to reduce the periodic water vapor plume from the cogeneration plant were required. Pursuant to the Development Agreement, the City is required to review the agreement on an annual basis in April to determine Hoag's good faith compliance with the terms of the agreement. Previous compliance review hearings were conducted in 1996, 1998, 1999, 2008 and 2009 and Hoag was found to be in good faith compliance with the agreement. No significant new building projects were initiated during the last year and none were completed. Due to the present economic downturn, Hoag has suspended all new buildings and continues to re- examine the entire building program. This includes the cancellation of the South Building previously planned for the Hoag Upper Campus and Hoag Hoapital Annual DA Compliance Review April 27, 2010 Page 2 of 6 an out - patient building and parking structure once planned for the lower campus. Hoag has been pursuing all noise mitigation improvements and landscaping improvements as required. The attached project status report prepared by Government Solutions on behalf of Hoag includes information regarding DA and mitigation measure compliance over the preceding year for this annual review. 1. Significant New DA provisions a. Section 5.4 of the amended DA requires an annual review of the DA for compliance. The review must include a noise regulation compliance assessment. RS Acoustics prepared a compliance report for the 2009 Annual Compliance Review that concluded that the Lower and Upper Hoag Campuses were meeting applicable noise standards with the exception of noise in the area of the Ancillary Building. Noise from the Ancillary Building, West Tower, West Hoag Road and the main loading dock contribute to noise that exceeds the nighttime noise standard by 1 dBA. Mitigation of noise from the Ancillary Building is 100% complete at this time (see 2c below). Hoag anticipates that with the imminent completion of the soundwall, compliance will be achieved. A follow -up noise study will be necessary and should compliance not be achieved, additional mitigation may be necessary. b. Section 8.2 of the amended DA requires Hoag to pay $3 million for public improvements in two installments. The first installment was paid in July 2008 and the second installment was paid in July 2009. c. Section 8.3 of the amended DA provides sales & use tax origin provisions. Hoag is required to include a provision in its general construction contracts, when contracts exceed $5 million, that the contractors and subcontractors shall allocate all eligible sales taxes to the City. Hoag has prepared appropriate language within their Master Services Agreement; however, no qualifying contracts have been signed within the last reporting period. Hoag is also required to follow the Direct Payment Permit Process established by the Revenue and Taxation Code and use the permit for all qualifying individual purchases in excess of $100,000. One such purchase within the last year was subject to this procedure. Both of these provisions are ongoing and will be monitored as necessary. Staff believes Hoag is in good faith compliance. d. Section 8.4 of the amended DA requires Hoag to reimburse the City $150,000 for landscaping and irrigation improvements to Sunset View Park. Specifically, the improvements are planned for a 20,500 square -foot area directly north of the cogeneration facility that is not presently landscaped. This project has not been initiated by the City and this reimbursement provision has no completion requirement date or "sunset' clause and Hoag is prepared to reimburse the City upon completion of the improvements. Section 8.5 of the amended DA requires Hoag to curtail the cogeneration plant's effective heat rejection by 33% to reduce plume formation during certain atmospheric conditions between TOOAM and TOOPM from November 1st to April 30th of each year. Hoag installed a weather station in 2009 as required that allows them to identify plume formation conditions as they occur so they can reduce cooling tower load to reduce the cooling tower plume. Hoag has submitted printouts of daily atmospheric conditions and heat load for most months regulated by the DA and staff has requested the missing months of data. Additionally, staff has requested a detailed listing of days where atmospheric conditions necessitated the 33% reduction of effective heat rejection at the cooling towers. Staff has also requested documentation of the 33% reduction of effective heat rejection. The DA also requires that Hoag automate the plant's controls based upon weather station data and staff is awaiting a report on Hoag's progress in accomplishing system integration. As of the drafting of this report, Hoag has not supplied the requested information to demonstrate compliance. Staff anticipates receiving this information in advance of the hearing and will provide a verbal report. 2. Mitigation & Compliance Update a. Villa Balboa window replacement — Hoag offered and was obligated through approval of the Master Plan Update to provide a window replacement program for 12 condominium units located at 260 Cagney Lane (Project Design Feature [PDF] 3.4 -1). The program was to be implemented by March of 2009 and the Villa Balboa Homeowners Association was to provide an estimate for the work prepared by a qualified contractor for Hoag's approval prior to execution of the contract. Villa Balboa would make the improvements and Hoag would be responsible for reimbursement of the approved costs. Subsequent to the City's adoption of the Master Plan Update and PDF 3.4 -1, Hoag and Villa Balboa entered into a private agreement to provide window replacements for 6 additional units at 260 Cagney Lane (18 total units). They also agreed to a modified set of guidelines to implement the window replacement program. Under these modified guidelines, Hoag and Villa Balboa each would provide bid proposals. After a price is agreed upon, Villa Balboa would implement the program and Hoag would reimburse Villa Balboa those costs plus administration fees that are capped. The window replacement program should have been implemented by now. Part of the delay in implementing the program has been testing for asbestos, which recently was completed. Asbestos is not a concern, so the program can move forward. Total costs of the program have been estimated and Villa Balboa has agreed to the scope of work and costs. Hoag has not yet agreed to the total cost of the program and Hoag also believes that with the completion of the West Road soundwall and the previously implemented noise mitigation for the West Tower and Ancillary Building, compliance with the noise ordinance should be achieved Hoag Hoapital Annual DA Compliance Review April 27, 2010 Page 4 of 6 and that the replacement windows might not be needed. Hoag has retained a qualified noise consultant to prepare a comprehensive noise study and testing has been completed, but the final report has not been completed. Regardless of the outcome of noise testing, Hoag must provide funding for the replacement program should Villa Balboa owners choose to take advantage of it; there is no flexibility to eliminate the program without an amendment of the DA. Hoag has pursued the goal of noise reduction and mitigation in good faith and has been working with Villa Balboa to reach an agreement on the cost of the replacement windows. However, Hoag has not completed this item. b. West Road sound wall — The required soundwall is nearly complete. All of the screening landscaping on the side of the wall that faces Villa Balboa has been installed. Additional sidewalk and landscaping improvements on the side of the wall that faces Hoag remain and will be completed in the coming days or weeks. Hoag has complied with the provisions of the DA requiring the soundwall. The effectiveness of the wall is being evaluated at this time by a qualified noise consultant. c. Ancillary Building and West Tower noise reduction — A noise wall, replacement kitchen exhaust fan, and an enclosure around the fan have been installed on the roof of the Ancillary Building. Sound louvers for air handling systems of the West Tower were completed in 2009. Noise from these buildings has been reduced but contributes to an overall noise environment that still exceeds nighttime noise ordinance limits at Villa Balboa by 1 dBA (RS Acoustics January 2010). Hoag believes that the sound absorbing qualities of the newly- erected soundwall may address this issue and is in the process of testing this hypothesis now that the soundwall is effectively complete. Staff is skeptical of this theory due to the elevation differences between the noise sources, wall and residential units. Should nighttime noise remain an issue, additional mitigation will need to be identified. Hoag has implemented all previously identified noise reducing measures and is in good faith compliance. d. Truck deliveries to the loading dock — Mitigation measure 3.4 -4 requires truck deliveries to be restricted to the hours between TOOAM and 8:OOPM. Additional signage has been installed, staff has been trained, and physical access to West Road remains closed during these hours. Mitigation measure 3.4 -8 required signs indicating "no idling" and several signs have been installed. Staff has not received any complaints about excessive idling and staff believes Hoag is in good faith compliance. e. Loading dock sound panels, trash compactor and bailer relocation /enclosure — Mitigation measures 3.4 -5 and 3.4 -6 require 450 square feet of sound absorbing panels to be installed on the west facing wall of the loading dock and the relocation and enclosure of the trash compactor and bailer. These improvements were to be implemented by November of 2008 and Hoag placed these Hoag Hoapital Annual DA Compliance Review April 27, 2010 Page 5 of 6 improvements on hold given their decision to cancel the South Building. Given that these improvements were designed to facilitate and coordinate the ultimate construction of the South Building, Hoag no longer considers these improvements necessary or feasible. Mitigation measures require these improvements irrespective of any other project or permit so Hoag cannot dismiss them. The prior year's RS Acoustics report shows that these improvements may not be necessary given the installation of the soundwall and Hoag proposes to hold the loading dock improvements in abeyance until the soundwall is completed and subsequent acoustical testing can be performed to determine whether or not these improvements are necessary to comply with noise ordinance limits. Hoag is not compliant with these mitigation requirements. f. Grease trap cleaning schedule — Mitigation measure 3.4 -8 requires the grease traps in West Road near Villa Balboa to be cleaned Saturdays between 11:OOAM and 3:OOPM, rather than during the week at times that often disturbed Villa Balboa residents. This schedule has been implemented and no reports of any problems have been received. Staff believes Hoag is in good faith compliance. g. Cogeneration building lattice screen — This improvement has been completed and Hoag is in good faith compliance. h. Lower Campus landscaping — Hoag has just recently begun the installation process for the landscaping within the parking lot, along the slope above the lower campus retaining wall and within the landscape area abutting Coast Highway (the "green screen "). Completion of these improvements is scheduled for mid -June and staff believes that Hoag is in good faith compliance. ENVIRONMENTAL REVIEW This compliance review is exempt from environmental review pursuant to Section 15321 of the Guidelines for Implementation of the California Environmental Quality Act. This section exempts actions by regulatory agencies to enforce or revoke a lease, permit, license, certificate, or other entitlement for use issued, adopted, or prescribed by the regulatory agency or enforcement of a law, general rule, standard, or objective, administered or adopted by the regulatory agency. Construction activities undertaken would not qualify for this exemption. City Council determined that Hoag is in good faith compliance with the Development Agreement with the exception of their efforts to implement required noise mitigation at the main loading dock. Questions were also raised about vapor plume reduction at the cogeneration plant. City Council continued the public hearing and directed Hoag to submit a plan to address loading dock noise mitigation within 60 days. Hoag submitted a noise mitigation plan and information related to plume reduction for City Council review. RECOMMENDATION After review of the supplementary material submitted by Hoag, conduct public hearing and continue this item to July 27, 2010, and direct Hoag to prepare and submit additional information regarding loading dock noise mitigation and cogeneration plant plume reduction. DISCUSSION 1. Noise Compliance Report Hoag's noise consultant, RS Acoustics, has prepared a comprehensive noise compliance report with noise readings at several locations near noise generating activities. The report concludes that Hoag is in compliance with applicable noise limits within the Hoag Hospital Planned Community Text. Staff sent the report to Fred Greve of Mestre Greve Associates for an independent review. Mr. Greve's initial assessment of the report is that it is comprehensive, but there are several areas that require clarification, and additional noise measurements may be warranted. The City's review is on -going and staff will direct Hoag to correct any deficiencies. R v ".1 � 6 Hoag Hoapital Annual DA Compliance Review June 22, 2010 Page 2 of 3 2. Noise Mitigation — Loading Dock Mitigation Measure 3.4 -5 of the SEIR requires 450 square feet of sound absorbing panels to be installed on the west facing wall of the main loading dock area. Staff believes Hoag will be in good faith compliance provided plans are submitted and installation started as anticipated. The existing cardboard bailer is required to be enclosed with a three -sided enclosure as well. The open sides of each enclosure would face away from residents at Villa Balboa. Rather than implementing the mitigation measure as stated, Hoag proposes to leave the trash compactor where it is and to partially enclose it with two walls, one of which would be comprised of the sound absorbing panels used in the construction of the newly constructed soundwall. Hoag also proposes to install two walls made of the same sound absorbing panels around the bailer. As now proposed, neither enclosure would have a roof. Mr. Greve has reviewed Hoag's alternative proposal and concluded that Hoag's proposal will not provide a level of mitigation consistent with that required by Mitigation Measure 3.4 -6. Hoag has been directed to submit plans that comply with Mitigation Measure 3.4 -6. 3. Noise Mitigation — Villa Balboa Window Replacement Program Hoag is obligated through approval of the Master Plan Update and a settlement agreement with Villa Balboa to provide a window replacement program for 18 condominium units located at 260 Cagney Lane. On May 24, 2010, Hoag sent letters to the owners of the affected units by certified mail informing them of the program providing owners with 45 days to indicate their desire to participate. Hoag will fund the window replacement program for those owners who choose to participate. Staff believes Hoag is acting in good faith and is in compliance. 4. Cogeneration Plant Energy Curtailment Section 8.5 of the amended DA requires Hoag to curtail the cogeneration plant's effective heat rejection by 33% to reduce plume formation during certain atmospheric conditions between 7:OOAM and 7:OOPM from November 1St to April 30th of each year. Hoag installed a weather station in 2009 that allows them to identify plume formation conditions as they occur so they can reduce cooling tower load to reduce the cooling tower plume. As noted in the April 27, 2010, report to the City Council, several months of weather station data was not provided to staff. Hoag has supplied staff with the missing data and a letter from the engineer of record that certifies that the plant has been operated in accordance with the energy curtailment requirement. This report has therefore been prepared as a supplement to the March 12, 2010, Second Annual Review of the Development Agreement to provide further information requested by the staff and City Council. Cogeneration Plant Energy Curtailment Monthly Cogeneration Plant Reports for the months of July, August, October, November, December 2009, and January, February 2010, were attached in the March 12`h report. (Attachment 1) Mitigation Measures and PC Text Requirements Noise — West Hoag Drive Mitigation Measure: PDF 3.4 -1— Villa Balboa Window Installation Please find attached (Attachment 2), copies of the 18 letters that were sent to Villa Balboa residents providing notice of their eligibility to have windows and sliding glass door(s) in their condominiums upgraded as part of the Noise Abatement Program being offered by Hoag. These letters were sent on May 24, 2010 by certified mail return receipt requested and gave each owner a 45 -day period to respond with a request to participate in the Noise Abatement Program. The eligible condominium owners were informed that the windows and sliding glass door(s) noise attenuation improvements will be installed by a qualified and licensed contractor retained by the Villa Balboa Community Association, the cost of which shall be reimbursed by Hoag to the Association pursuant to the bid estimate approved by the City of Newport Beach. Once this 4S -day period to respond has run, Hnag will fund the window installations for those residents, responding to the notice. March 12, 2010 Report• As of last year's update, Hoag had proceeded in good faith to complete the requirements of these mitigation measures in the following manner. The West Tower sound louvers were installed on January 9, 2009 and were sound tested in February and met noise standards. The Ancillary Building roof top sound wall was completed in August, 2008. The plans for the relocation of the kitchen exhaust equipment into a mechanical enclosure for the Ancillary Building are completed and were submitted to OSHPD on August 22, 2008 and permits were received on March 17, 2009. The final permit showing completion of the project by OSHPD is attached. During this last year, Hoag finished the work required in these mitigation measures and as noted in the above referenced noise analysis by RS Acoustics (Attachment 1), Hoag has redesigned the kitchen exhaust fans and penthouse enclosure located on the rooftop of the ancillary building per the requirements. With the completion of these improvements, Hoag complies with the day time noise standards and is slightly higher by 1 dBE than the requirement in the nighttime. Once the Sound Wall is complete, Hoag anticipates it will be in complete compliance with all noise standards. June, 2010 Update: Please find attached, an updated Acoustical Study, completed on April 26, 2010, by RS Acoustics, Inc. This study was conducted after the new sound wall along West Hoag Drive was complete. Per the study, (see section 3. 1, page 17), Hoag meets or exceeds the noise standards as set forth in the Development Agreement and is now in full compliance with the noise requirements. (Attachment 3) Mitigation Measure 3.4 -5 — Loading Dock Sound Absorption Panels "Sound absorption panels on the east wall of the loading dock shall be installed. Approximately 450 square feet of absorptive panels shall be used to cover major portions of the back of the loading dock area. The Noise -Foil panels by Industrial Acoustics or a panel with an equivalent or better sound rating shall be used" Per the attached sketch, labeled "Mitigation Measures, 3.4 -5 and 3.4 -6 ", Sound Panels of approximately 650 square feet ( 200 square feet more than required by the mitigation measure) made with Noise Foil Panels will be mounted to the building, per the mitigation measure. (Attachment 4) It is anticipated that the plans will be submitted to OSHPD by June 17, 2010, and construction will commence by the end of August, 2010. 16 Mitigation Measure 3.4 -6 — Relocation of the Trash Compactor "The trash compactor shall be relocated within the loading dock. The trash compactor and baler shall be enclosed in a three -sided structure. The walls shall be concrete block or similar masonry construction. The roof shall be lightweight concrete roof or a plywood surface with concrete tiles; a built -up roof with 5'5" of insulation on the inside would be an acceptable alternative. The open side shall face away from the residents. Doors may be on the side of the enclosure facing residents, but must be closed when the baler or compactor are operating. The compactor and baler should only be operated between the hours of 7:00 AM and 7:00 PM." This mitigation measure will be met in the following manner, per the two attached sketches, "Modified Loading Dock Plan -June 12, 2010 ". The trash compactor area currently has one exterior louvered wall adjacent to it. Hoag is proposing to install a modified enclosure on the two remaining exterior exposed areas facing West Hoag Drive as follows; the front gate will be constructed with the Sound Fighter wall materials, the north wall will be constructed with an exterior grade framed lath and plaster insulated wall system. If the time is outside 7 and 7, then continue monitoring T and RH. 3. If the time is inside 7 and 7 then the EMS automatically calculates heat rejection load. 4. The EMS determines if the calculated heat rejection is greater than 46.2 M BTU /hr. S. If heat rejection is less than 46.2 M BTU /hr. then the EMS continues monitoring T and RH. 6. If the calculated heat rejection is greater than 46.2 M BTU /hr., then the EMS automatically alerts the operator with audible and visual alarms for heat reduction operations. 7. August, 2010 Supplement: Cogeneration Plant Energy Curtailment During the months of October 2009 to April 2010, the weather station on Hoag's Lower Campus provided data to the Co- generation plant operators and activated the alarm when the identified plume atmospheric conditions were present. When the alarm sounded, staff confirmed the cooling tower heat rejection load (BTU /hr) levels were below the established threshold criteria for tower heat rejection. If conditions were under the threshold for heat rejection no additional action was necessary and none was taken. (Should the levels be above the established threshold, additional action would be taken, including a load shift to the upper campus power plant). During the months of October 2009 through April 2010 there were no times when the cooling tower heat rejection load exceeded the threshold limit resulting in maximizing responses to prevailing weather conditions due to the following. October, November and December 2009 - Scheduled maintenance of each of the three Caterpillar generators and absorption units allowed Hoag to insure heat rejection remained at 66% of full capacity by taking down one generator and chiller per month during this period. January, February, March and April 2010 - Protocols were put into place to utilize a combination of thermal loading and load shifting to the Upper Campus power plant to proactively manage the heat rejection to the prescriptive levels. Mitigation Measures and PC Text Requirements Noise — West Hoag Drive June, 2010 Supplement Mitigation Measure: PDF 3.4 -1— Villa Balboa Window Installation Copies of the 18 letters that were sent to Villa Balboa residents providing notice of their eligibility to have windows and sliding glass door(s) in their condominiums upgraded as part of the Noise Abatement Program being offered by Hoag were submitted to City Staff. These letters were sent on May 24, 2010 by certified mail return receipt requested and gave each owner a 45 -day period to respond with a request to participate in the Noise Abatement Program. The eligible condominium owners were informed that the windows and sliding glass door(s) noise attenuation improvements will be installed by a qualified and licensed contractor retained by the Villa Balboa Community Association, the cost of which shall be reimbursed by Hoag to the Association pursuant to the bid estimate approved by the City of Newport Beach. Once this 45 -day period to respond has run, Hoag will fund the window installations for those residents, responding to the notice. The interior of the walls will be lined with Noise Foil Panels as recommended by the acoustical engineer. The roof will be constructed of metal decking with a waterproof membrane and be constructed similar to the north and south walls and will have a bellow material to wrap around the trash enclosure to allow for movement. The east wall of the compactor /sanitizer will be open for access. The west wall of the loading dock will be lined from north to south with Noise Foil Panels as recommended by the acoustical engineer. The baler will be constructed with three walls on the east, west, and south sides. The north side will remain open for access. The roof of the baler enclosure will be constructed of the same materials as the compactor /sanitizer roof structure noted above. The compactor and baler will be operated between the hours of 7:00 AM and 7:00 PM. Plans will be submitted to both the City and OSHPD within 60 days. The hospital campus is split into two distinct planning sections described as the "Upper Campus" to the north, and the "Lower Campus" to the south. The Upper Campus section is bordered by Hospital Road to the north, West Hoag Drive to the west, Newport Boulevard (55) to the east, and a hospital multi -level parking structure extends south to the Newport Blvd. off -ramp connecting Newport Blvd. to Pacific Coast Highway. The Lower Campus section is bordered to the north by Sunset View Park and Villa Balboa townhomes, Superior Avenue to the west, Newport Blvd. to the east, and the southern boundary is bounded by Pacific Coast Highway (Highway 1). Recently a new acoustical barrier ranging from 18' to 23' high was constructed along the west side of West Hoag Drive to shield loading dock generated noise from the residences immediately west of the site. The barrier is constructed of perforated material with a sound absorptive filler on the side facing towards the hospital, and a solid material facing towards the residences of the Villa Balboa Complex. 1.2 Community Noise Assessment Metrics In general, community noise measurements or assessments refer to descriptions of the exterior noise environment in the vicinity of inhabited areas. Descriptions of noise usually include the time and spatial variations in the outdoor noise environment throughout a specific area so that descriptions are relevant to the effect on people within the specified area. Outdoor noise environments vary greatly in magnitude and character among locations throughout a community — from the quiet suburban areas bordering on farmland, to the din of traffic in downtown city streets. They generally vary with time of day, being relatively quiet at night when activities are minimal and noisier in moming and afternoons during peak traffic periods. Noise or unwanted sound is complex and may be comprised of a broad range of sounds often including low and high frequency components, which may also occur at differing decibel levels. To help simplify and quantify the human judgment of relative loudness and provide a simple single- number rating system, the A- weighting network was developed. A- weighted sound level "db(A)" is one of the most widely used methods of stating community noise design goals and regulations in terms of a single number rating system. A- weighted sound levels are obtained with a sound level meter incorporating an electronic weighting network that de- emphasizes the low frequency portions of the noise spectrum, to automatically compensate for the lower sensitivity of the human ear to low frequency sounds. High frequency components of sound, 100011z and above are relatively unchanged in A- weighting networks as the human ear is fairly equally sensitive to all sounds occurring in this high frequency range. The single A- weighted number is the sum of all A- weighted sound energy within a given range incorporating the 32Hz to 8000Hz octave bands. This time component is specified to allow for varying noise conditions such as the fluctuating noise levels associated with vehicular traffic stopping or accelerating from an intersection, The resultant level would be the average of all sound levels measured within the stated time period. If the measurement location is on boundary between two different noise zones, the lower noise level standard applicable to the noise zone shall apply. (Ord. 95 -53 § 1,1995; Ord. 95 -38 § 11 (part), 1995) As discussed in the following section, the ordinance defines the locations where acoustical measurements are to be made to determine compliance with the noise standard criteria. 10.26.055 Noise Level Measurement A. The location selected for measuring exterior noise levels in a residential area shall be at any part of a private yard, patio, deck or balcony normally used for human activity and identified by the owner of the affected property as suspected of exceeding the noise level standard. This location may be the closest point in the private yard or patio, or on the deck or balcony, to the noise source, but should not be located in nonhuman activity areas such as trash container storage areas, planter beds, above or contacting a property line fence, or other areas not normally used as part of the yard, patio, deck or balcony. The location selected for measuring exterior noise levels in a nonresidential area shall be at the closest point to the noise source. The measurement microphone height shall be five feet above finish elevation or, in the case of a deck or balcony, the measurement microphone height shall be five feet above the finished floor level. B. The location selected for measuring interior noise levels shall be made within the affected residential unit. The measurements shall be made at a point at least four feet from the wall, ceiling or floor, or within the frame of a window opening, nearest the noise source. The measurements shall be made with windows in an open position. (Ord. 95 -38 § 11 (part), 1995) Special provisions for Heating, Venting and Air Conditioning equipment are provided for in the ordinance as follows: 10.26.045 Heating, Venting and Air Conditioning — Special Provisions A. New HVAC Equipment. New permits for heating, venting and air conditioning (HVAC) equipment in or adjacent to residential areas shall be issued only where installations can be shown by computation, based on the sound rating of the proposed equipment, not to exceed an A- weighted sound pressure level of fifty (50) dB(A) or not to exceed an A- weighted sound pressure level of fifty-five (55) dB(A) and be installed with a timing device that will deactivate the equipment during the hours of ten p.m. to seven a.m. The method of computation used shall be that specified in "Standard Application of Sound Rated Outdoor Unitary Equipment," Standard 275, Air conditioning and Refrigeration Institute, 1984 or latest revision thereof. B. Existing HVAC Equipment. 1. HVAC equipment legally installed prior to April 22,1981, shall be permitted to operate with an exterior noise limit of sixty-five (65) dB(A) until January 1, 1998. 2. HVAC equipment legally installed prior to April 22,1981, shall be exempted from the interior noise level standard as specified in Section 10.26.030 of this chapter until January 1, 1998. 3. HVAC equipment legally installed after April 22, 1981, and prior to the date of adoption of this chapter shall not exceed a maximum exterior noise limit of fifty- five (55) dBA during the ninety-day compliance period set forth in Section 10.26.005. In the event that HVAC equipment cannot meet the requirements set forth in this chapter, then the exterior noise limit for such equipment may be raised to sixty -five (65) dBA and exempted from the interior noise level standard as specified in Section 10.26.030 of this chapter, provided that the applicant obtains the written consent of all the owners of the affected properties. (Ord. 95 -38 § 11 (part), 1995) 1.4 Hoag Memorial Hoslrital Planned Community Development Criteria & District Regulations Amendment to Restated Development Agreement Paragraph 1.17 Noise Limitation The existing Planned Community (PC) Text provides that noise generated from Hoag Hospital from new mechanical appurtenances shall not exceed 55 dB(A) at the Property lines. This noise limitation was established prior to the adoption of the City's Noise Element in the General Plan and Noise Ordinance. It is proposed that noise generated and originating from the Property be governed by the city Noise Ordinance with certain exceptions. Planned Community Development Criteria and District Regulations M. Noise Standards Noise generated at the Hoag Hospital property shall be governed by the City of Newport Beach Noise Ordinance, except as noted below for the Loading Dock Area. Refer to Figure 2, Loading Dock Area Location for effected areas. 1. The applicable noise standard at the Hoag Hospital property line adjacent to the loading dock area shall be as follows: 2. Within the Loading Dock Area during daytime hours, vehicles shall be exempt from applicable noise standards as listed above. Vehicle idling shall be prohibited on West Hoag Drive and within the loading dock areas, except that refrigerated vehicles may idle while at the loading docks when refrigeration is necessary. In addition, the grease pit cleaning which is exempt from the City Noise Ordinance as a maintenance activity shall occur on a Saturday between the hours of 11:00 am and 3:00 pm. The first being building mechanical equipment noise from fixed sources, and the second being the fluctuating noise activity associated with the daytime operation of the main loading dock. Based on the Planned Community Development Criteria and District Regulations in the previous section, hospital building mechanical equipment should comply with the standards of the City of Newport Beach, and noise generated in the general area of the loading dock area is to comply with the standards of the PC development Criteria. Per the City ordinance, the location for measuring exterior noise levels in a residential area shall be at any part of a private yard, patio, deck or balcony normally used for human activity. Per the PC text, the location for measuring loading dock activity shall be directly at the property line. Our measurements of mechanical equipment were on Hoag Hospital property near or at the property line and also on the residential property allowable by City ordinance. Because sound level decreases with RS_ L COUSTICS inc. 15751 Beaver Run Rd., Canyon Country, CA 91387 P (661) 251 -3965 F (661) 310 -3783 Hoag Memorial Hospital Presbyterian 2010 Acoustical Test Program Report Page 9 increased distance from the source, we would anticipate that the mechanical equipment noise levels measured at the property line would be slightly less if they were measured within the unoccupied areas of the residential complex. 1.6 Test Equipment Noise levels measurements were conducted with the following equipment which was calibrated immediately prior to and following the test procedures: • Larson Davis Type 824 Type 1 integrating one -third octave band sound level meter • Larson Davis Model PRM902 microphone preamplifier • Larson Davis Type CAL200 precision Class 1 sound level calibrator calibrated to a reference traceable to the National Institute of Standards and Technology. • Larson Davis Type 25601/2' microphone accepted to meet the specifications of IEC 60651 and ANSI 51.4 -1983 Type 1. The measurement equipment satisfies the American National Standards Institute (ANSI) Standard 1.4 for Type 1 precision sound level measurements. 2.1 Ancillary Building and West Tower Mechanical Equipment Noise level measurements of the Ancillary building rooftop mechanical equipment and West Tower Mechanical Equipment room were conducted on 13 April 2010 starting at 12:00 am (midnight) when the influence of offsite noise sources and traffic is reduced. hl order to measure the worst case noise levels, we utilized a 35' telescoping microphone stand to elevate the measuring microphone to an elevation intersecting the rooftop equipment and the upper level condominium residences which have a fairly direct line of sight to the rooftop. The measurement positions were approximately 15' east of the West Hoag Drive curb nearest the property line due to the fenced off construction zone area. See Appendix sheet A -2 for ancillary building measuring locations and sheet A -3 for West Tower mechanical equipment measuring locations. 2.1.1 Ancillary Building Rooftop Mechanical Equipment There is an acoustical barrier located along the parapet of the Ancillary building which extends from approximately 18" above the deck to T above the deck intended to shield and reduce noise levels of the rooftop located mechanical equipment. In addition to this acoustical barrier the nearby existing building parapet helps provide attenuation of rooftop mechanical equipment noise which may be flanking through the void underneath the barrier. It is our understanding that all four (4) kitchen grease exhaust fans in the rooftop penthouse were operating during our test. The balance of the rooftop equipment including condensers and multiple mushroom exhaust fans also appeared to be operating. The noise levels were relatively constant over the duration of the test with mechanical equipment being the primary contributor with minor short - duration offsite noises being occasionally audible. RS ACOUSTICS inc. 15751 Beaver Run Rd., Canyon Country, CA 91387 P (661) 251 -3965 F (661) 310 -3783 Hoag Memorial Hospital Presbyterian 2010 Acoustical Test Program Report Page 10 The measurements resulted in a 15 minute averaged noise level of Leq 51 dB(A) from Ancillary building rooftop equipment thus satisfying the maximum nighttime allowable Leq 55 dB(A) set forth by the Planned Community Development Criteria. 2.1.2 West Tower Mechanical Equipment Room There is an uninterrupted and direct line of sight between the measurement position on the roadbed and the west facing louvers serving the mechanical room. However to reduce any potential effects of reflections and directivity, we utilized a 35' telescoping microphone stand to elevate the measuring microphone to an elevation close to the louvers and to the upper level condominium residences which also have a fairly direct line of sight to the louvers. The noise levels generated by the mechanical room resulted in noise levels of Leq 50.8 dB(A). These levels however most probably include some noise contribution from the mechanical equipment located on the Ancillary building roof. We did not verify what equipment within the mechanical room was operating during our test. The 15 minute averaged noise level of Leq 50.8 dB(A) generated by the West Tower Mechanical Equipment Room satisfies the maximum nighttime allowable Leq 55 dB(A) set forth by the Planned Community Development Criteria. 2.2 Main Loading Dock 2.2.1 Daytime Noise Measurements & Activity Measurements were conducted on 12 April 2010 during the approximate period between the hours of 6:30 am to 9:00 am. Minor construction was still occurring on West Hoag Road to complete the finish details of the acoustical barrier. This work necessitated the closure of the southbound lane of West Hoag Road. An additional measurement was conducted at the west side of the barrier on 21 June 2010 at 12:45 pm at an elevation of 25' above grade to determine the loading dock noise levels impacting the residences at this higher elevation. Construction along Hoag Drive had been completed prior to our test and both lanes of traffic were open. Measurements were conducted at both east (hospital side) and west (residential side) of the new acoustical barrier. Residential (West) Side of Acoustical Barrier Five (5) separate measurement locations on the west side of the acoustical barrier at 10', 15', and 25' elevations are shown in the Appendix sheets A -4 through A -9. Dock - related activity included deliveries, compactor operation and palletizing cardboard, forklift operation, carts rolling on dock, and occasional unidentified "banging" or hammering noise generated in the loading dock and construction areas. Three separate measurements were conducted during "normal" loading dock operating conditions in the absence of any substantial noise events such as large tractor - trailer deliveries. Positions 1, 3, 15751 Beaver Run Rd., Canyon Country, CA 91387 P (661) 251 -3965 F (661) 310 -3783 Hoag Memorial Hospital Presbyterian 2010 Acoustical Test Program Report Page 11 and 4 shown in Appendix sheets A -4, A -6, and A -7 resulted in measured noise levels of Leq 51.4 dB(A), Leq 53.7 dB(A), and Leq 54.0 dB(A) respectively. During our measurement program, the Sani -Pak container (dumpster) was removed from the dock parking lot. This operation which includes impact sounds and high engine rpm reached 56.8 dB(A) Leq when measured at the residential side of the acoustical barrier. See sheet A -5 in the appendix for additional information. Approximately 45 minutes subsequent to this event, the emptied Sani -Pak container was delivered back to the loading dock which generated 56.4 dB(A) LRq at the residential side of the barrier. (See sheet A -8). When measured at the residential side of the acoustical barrier, the 15 minute averaged noise levels ranging from Leg 51.4 dB(A) to Leq 54.0 dB(A) during "normal" dock operations, and the Leq 56.4 dB(A) to Leq 56.8 dB(A) levels generated during Sani -Pak removal and delivery satisfy the maximum allowable LRq 65 dB(A) set forth by the Planned Community Development Criteria. Hospital (East) Side of Acoustical Barrier Measurements were conducted at the east side of the barrier at the curb of West Hoag Drive directly across from the loading dock. The measuring microphone was located at an elevation of 5' above the road bed for the entirety of the measurement program. Typical dock operations included medium truck deliveries and cardboard compactor operations however large tractor trailer rigs were not present. Noise levels of 75.7 dB(A) L.., and a 15 minute average of 59.9 dB(A) Leq were recorded. See appendix sheet A -10 for additional information. Large truck deliveries entered the dock from the north along West Hoag Drive. Generally, to back into the dock, the trucks must be maneuvered in a manner which places the truck motor and exhaust fairly close to the property line and measuring microphone. Two (2) separate tests were conducted during large truck arrival and maneuvering to the loading dock. The first test resulted in an average level of LQq 72.3 dB(A) and an L... 84.1 dB(A), and the second test resulted in an average level of Leq 71.1 dB(A) and an L... 98.3 dB(A). See appendix sheets A -12 and A -13 respectively for additional information. The text of the Planned Community Development Criteria exempts vehicles from the applicable noise standards. The PC text also uses the property line adjacent to the loading dock as the location of measurements to determine ordinance compliance. It is reasonable to assume that the maximum allowable noise levels of the PC text would pertain to those impacting the residences, or the levels measured at the residential side of the acoustical barrier. The noise levels measured on Hoag Hospital property are well within the property line, and east of the new acoustical barrier should therefore be exempt from the formal requirements of the PC text. That being said, the measured 15 minute average Leq 59.9 dB(A) due to "normal" dock operations described above satisfy the maximum allowable L q 65 dB(A) set forth by the Planned Community Development Criteria. RS ACOUSTICS inc. 15751 Beaver Run Rd., Canyon Country, CA 91387 P (661) 251 -3965 F (661) 310 -3783 Hoag Memorial Hospital Presbyterian 2010 Acoustical Test Program Report Page 12 2.2.2 Nighttime Noise Measurements & Activity Acoustical measurements near the loading dock at both sides of the acoustical barrier were conducted on 12 April 2010 starting at approximately 10:00 pm. As the loading dock is closed during the nighttime hours, the predominant noise source was offsite traffic, and to a lesser degree mechanical equipment at the hospital. At the east side of the barrier along the curb of Hoag Road, we measured noise levels of 64.6 dB(A) Lmax, and a 15 minute average of 52.5 dB(A) Uq were recorded. (See sheet A -13). At the west side of the barrier near the residential buildings, the nighttime noise levels measured at Position 4 were 45.4 dB(A) Leq with the microphone at a 10' elevation above the landscaping thus satisfying the maximum allowable L, 55 dB(A) noise levels set forth by the Planned Community Development Criteria. (See sheet A -14). 2.2.3 Supplementary Mitigation Measures Although activity levels from the hospital loading dock are effectively mitigated and satisfy the PC Development Criteria, it is our understanding that additional noise control enclosures are proposed for installation at the cardboard baler and the compactor in the loading dock area. The baler would be enclosed on three sides with acoustical panels having sound absorbing material directly behind a perforated metal facing at the interior side facing the baler, and the exterior facing would be impervious solid sheet metal. The enclosure would be roofed over with similar sound absorbing panels. The beneficial acoustical shielding provided by an enclosure around the baler would directly reduce noise levels at the residential units, especially those closest to the baler. Additionally the sound absorptive interior of the enclosure would theoretically absorb almost all sound impinging upon it and effectively eliminate the sound energy currently reflecting off adjacent buildings, being directed over to the residences; A large compactor and container unit is located at the southeast comer of the loading dock. The primary noise sources of typical daily operation are generated by the power unit, hydraulic ram, and loading of the compactor by hospital personnel. A noise control enclosure of perforated metal panels at the walls and at roof which will completely enclose these noise sources, along with a seal fitting snugly to the compactor will provide a substantial reduction of noise levels by reducing both direct sound energy, and that which is reflected off the perpendicular walls of the adjacent buildings. 2.3 Dietary Loading Dock Noise Levels & Activity 2.3.1 Daytime Noise Measurements & Activity Measurements were conducted on 21 June 2010 starting at approximately 10:00 am at the western curb of West Hoag Road directly across from the dietary loading dock. The measuring microphone was located at an elevation of 5' above the road bed for the entirety of the IRS ACOUSTICS inc 15751 Beaver Run Rd., Canyon Country, CA 91387 P (661) 251 -3965 F (661) 310 -3783 Hoag Memorial Hospital Presbyterian 2010 Acoustical Test Program Report Page 13 measurement program. The acoustical barrier along the west side of Hoag Road does not occur opposite the Dietary Dock. During the measurement program three (3) small delivery vans entered the loading dock from the north and two (2) departed to the north. Additionally, the compactor located at the north side of the loading dock driveway was loaded and operated. In addition to the deliveries and compactor noise, background noise levels from off -site traffic on Hospital Road and Newport Blvd. were also audible. See appendix sheet A -15 for location and additional information. At the curb directly across from the Dietary Loading dock, the daytime noise levels measured were found to be Leq 62.1 dB(A) which satisfies the maximum allowable Leq 65 dB(A) noise levels set forth by the Planned Community Development Criteria for daytime hours. 2.3.2 Nighttime Noise Measurements & Activity Nighttime noise level measurements were conducted on 12 April 2010 between the hours of 10:30 pm to 11:00 pm. Our measurement location was at the western curb of West Hoag Drive directly across from the dietary loading dock. The measuring microphone was located at an elevation of 5' above the road bed for the entirety of the measurement program. See Appendix pages A -16 for location and additional data. Predominant background noise levels observed near the dietary dock area were primarily from off -site traffic on Hospital Road and Newport Blvd. Hospital mechanical equipment could also be heard in the background. Our measurements resulted in a 15 minute Leq 52.0 dB(A), with a maximum recorded level of L., 69.3 dB(A) at this position which satisfies the maximum allowable L.q 55 dB(A) noise levels set forth by the Planned Community Development Criteria for nighttime hours. 2.4 Cogeneration Facility Noise Levels & Activity It is our understanding that the seasonal cooling needs of the hospital require only one (1) of the four (4) cooling towers in the cogeneration facility to be operational. The number of cooling towers operating during our test was not verified however by our office. 2.4.1 Daytime Noise Measurements & Activity Measurements were conducted on 12 April 2010 during the hours of 1:00 pm to 2:00 pm at approximately 10' from the south face of the condominium at 200 Paris Lane. Measurements were conducted at two elevations, the first at 4' above the roadbed, shown in appendix sheet A -17, and the second at 20' above the road bed as shown on sheet A -18 in the appendix. The noise levels measured at 20' determine the noise levels experienced at the third floor of the condominiums which may have a direct line -of -sight to the hospital cooling towers and minimal acoustical shielding effects. These upper floor units would experience the greatest noise impact from the cooling towers. During the daytime measurements, the preponderance of ambient noise experienced was due to traffic on the nearby Superior Avenue and to a lesser degree from traffic on Pacific Coast Highway. Except during the quietest moments when traffic flow on Superior was controlled by the signal at Pacific Coast Highway, noise from the cooling towers and cogeneration facility was considered inaudible. With the microphone located at a 4' elevation above the roadbed, we measured L q 52.7 dB(A) for a 15 minute duration and the maximum level recorded was Lm.. 60.7 dB(A). With the microphone raised to the higher 20' elevation, we measured L� 56.7 dB(A) with a maximum recorded level of L.. 59.1 dB(A). This section of the residential area is located within 100' from the Hoag Hospital property line and therefore would be considered as Zone III — "Mixed -Use Residential" which utilizes maximum permissible noise level criteria of Leq 50 dB(A) during the night, and Leq 60 dB(A) during the day due to hospital operations. Maximum levels must not exceed L.. 70 dB(A) during the night and L... 80 during the day. With one (1) cooling tower operating, the measured noise levels of Laq 52.7 dB(A) at the 4' elevation and the L, 56.7 dB(A) at the 20' satisfy the Zone III Noise criteria. The measured L.x 60.7 dB(A) L... 59.1 dB(A) also satisfies the requirements of the Zone III Noise criteria. These measured levels however were generated primarily by offsite traffic sources. An accurate measurement of the cogeneration facility cooling towers can only be accomplished during the nighttime hours when traffic contribution is at the minimum. 2.4.2 Nighttime Noise Measurements & Activity Measurements were conducted on 13 April 2010 during the hours of 1:00 am to 2:00 am at approximately 10' from the south face of the condominium at 200 Paris Lane. Measurements were conducted at two elevations, the first at 4' above the roadbed, shown in appendix sheet A -19, and the second at 20' above the road bed as shown on sheet A -20 in the appendix. During the nighttime measurements of the cogeneration facility, the ambient noise levels experienced was a combination of traffic noise, a street -side transformer exhaust fan, waves crashing at the beach, and the cooling towers within the cogeneration facility. Measurements were conducted in the early morning hours to reduce the effects of offsite noise sources to the extent possible. The exhaust fan operated for short durations of 2 to 3 seconds automatically and was not under our control. With the microphone located at a 4' elevation above the roadbed, we measured Uq 47.2 dB(A) for a 15 minute duration and the maximum level recorded was L.�. 54.0 dB(A). With the microphone raised to the higher 20' elevation, we measured I.eq 48.5 dB(A) with a maximum recorded level of L.a.59.1 dB(A). Per the City of Newport Beach noise ordinance, noise levels can not exceed Leg 50 dB(A) during the night due to hospital operations, and maximum levels must not exceed L.. 70 dB(A) at both residential areas and mixed -use areas. With one (1) cooling tower operating, the measured noise levels of Leg 47.2 dB(A) at the 4' elevation and the Leg 48.5 dB(A) at the 20' elevation satisfy the maximum allowable Leq 50 dB(A) noise level criteria. The worst case L... 59.1 dB(A) also satisfies the L.. 70 dB(A) maximum allowable noise level requirements of the Zone III and residential use noise criteria. On 10 July 2008, RS Acoustics Inc. conducted acoustical tests of the cogeneration facility to determine the noise levels generated by the operation of four (4) cooling towers and other associated equipment of the cogeneration facility. During these nighttime tests, we measured the noise levels at the residential condominiums closest to the i cooling towers to be Leq 49.5 dB(A) at the worst case upper floor level and the noise levels measured at 5' above grade were found to he Leq 45.3 dB(A). While the Leq 48.5 dB(A) measured at the 20' elevation on 13 April 2010 satisfy the requirements of the noise ordinance when one (1) cooling tower is operating, previous tests show that the operation of all four (4) cooling towers also satisfy the noise ordinance requirements, 2.5 General Ambient Conditions To illustrate the general noise environment in and around the hospital, daytime and nighttime ambient noise measurements were conducted on 12 April and 13 April 2010 at the locations shown in the Appendix. The purpose of these measurements is to document the current conditions and track any changes over time. The noise levels measured in these locations are primarily from traffic sources and aircraft operations only. Specific hospital equipment and on -site operations were of too great a distance and were not contributory to these measurements. 2.5.1 Catalina Drive & Old Newport Blvd. The first location for our measurements was the intersection of Catalina Drive and Old Newport Blvd. This environment consisted of small residences and businesses. The general noise source was traffic along Newport Blvd., and to a lesser extent Pacific Coast Highway. Traffic on Catalina drive was not a major contributor to the ambient noise environment. (See sheets A -21 and A -22). An off -site, underground transformer exhaust fan located on Superior Ave. immediately north of Sunset View Park operated intermittently during the nighttime test sequence. Although the transformer is not part of Hoag Hospital, we did measure the levels which were found to be Leq 59.6 dB(A) and L.. 80.2 dB(A). See appendix sheet A -25 for additional information. The noise levels measured at nighttime without the transformer operation was found to be LN 55.1 dB(A) and L. 73.6 dB(A). (See sheets A -23 and A -24 for additional information). RS ACOUSTICS inc. 15751 Beaver Run Rd., Canyon Country, CA 91387 P (661) 251 -3965 F (661) 310 -3783 Hoag Memorial Hospital Presbyterian 2010 Acoustical Test Program Report Page 17 We assume that the intent of Settlement term M3 is the measurement noise generated by the hospital cogeneration facility at the south side of this building, however we additionally measured the ambient noise levels at the northeast corner of 200 Paris Lane, within the complex as shown in Appendix sheets A- 28 and A -29. Noise level measurements within the Villa Balboa complex were conducted on 12 April 2010 starting at approximately 12:40 pm. Two sets of measurements were conducted. The first included noise levels of Villa Balboa related rubbish collection service working at Lille Lane and Paris Lane, and multiple operations of the gates leading to subterranean parking garage with residents arriving and departing. (See appendix sheet A -28). The second measurement was conducted in the absence of these intrusions shown in appendix sheet A -29. The first measurement resulted in Leq 72.6 dB(A) and Lma. 93.2 dB(A). The general ambient noise consisted of traffic noise from Pacific Coast Highway and to a lesser extent, Superior Avenue. Mechanical equipment or other noises from Hoag Hospital were not identifiable. The maximum noise levels measured during the first measurement was from the metal gate operation at the nearby condominiums. The second measurement resulted in Uq 48.4 dB(A) and Lma. 54.8 dB(A). The ambient noise levels were again identifiable as offsite traffic noise from Pacific Coast Highway and Superior Avenue. Acoustical shielding of the condominium buildings provided sufficient noise reduction to make mechanical c equipment noise from the hospital cogeneration facility inaudible. 2.7 Measurements at Unit 304 — 260 CaLyney Lane Daytime and nighttime noise level measurements at residential Unit 304 on 260 Cagney Lane were conducted on 13 April 2010 to determine the noise environment existing on the exterior balcony which faces the hospital, as also within the unit's interior. This unit was fully furnished and has a direct line of sight to the rooftop mechanical equipment as well as to the louvers located in the west wall of the second story mechanical equipment room of the West Tower. 2.7.1 Daytime Noise Measurements Measurements were conducted on 13 April during the day in the unit's exterior balcony, and within the unit's living room with the windows facing east closed, and again with the windows open. (See sheets A -30, A -31, and A -32 in the appendix). The measuring microphone was located at an elevation of 5' above the floor and centrally located within the balcony, and also centrally located in the interior living room, approximately 5' from the east exterior wall. Background noise levels on the balcony were primarily from off -site traffic, general activity at the hospital including conversations between multiple employees in the outdoor eating area, construction, and hospital mechanical equipment. Exterior noise sources were difficult to accurately distinguish within the unit when the windows are closed. Measured noise levels with the exterior windows open resulted in a 15 minute Lea, 45.4 dB(A), and a maximum level of Lmax 61.9 dB(A). On the balcony, we measured a 15 minute Leq 56.5 dB(A) from the multiple sources, with a maximum recorded level of L.x 72.3 dB(A). The measured noise levels of Leq 56.5 dB(A) on the exterior balcony satisfy the maximum allowable Leq 65 dB(A) daytime noise level criteria of the Planned Community Development Criteria. 2.7.2 Nighttime Noise Measurements Measurements were also conducted in Unit 304's exterior balcony and within the unit's living room during the nighttime hours. The measuring microphone was located at an elevation of 5' above the floor and centrally located within the balcony, and also centrally located in the interior living room, approximately 5' from the east exterior wall. (See A -33 and A -34 in the appendix). Background noise levels on the balcony were primarily from off -site traffic and hospital mechanical equipment. Exterior noise sources were difficult to accurately distinguish within the unit when the windows are closed. Interior noise level measurements resulted in a 15 minute Ixq 33.9 dB(A), and a maximum level of Lomax 49.7 dB(A) with the windows closed. On the balcony, we measured a 15 minute Leq 51.1 dB(A) from the exterior sources, with a maximum level of Lmax 59.1 dB(A). The noise levels of Leq 51.1 dB(A) measured on the exterior balcony of the residential Unit 304 satisfies the maximum allowable Leq 55 dB(A) nighttime noise level criteria set forth by the Planned Community Development Criteria. 3.1 Conclusion and Summary of Acoustical Testing Results The following presents a summary of our results which are also included in the following Table 3.1.a Ancillary Bldg. Rooftop Mechanical Equipment Mechanical equipment at the rooftop of the Ancillary building when measured at nighttime generated Leq - 51.0 dB(A) which satisfies the Leq - 55.0 dB(A) maximum allowable noise level set forth in the Planned Community Development Criteria. West Tower Mechanical Equipment Nighttime measured noise levels of the mechanical equipment in the West Tower mechanical equipment room was Leq - 50.8 dB(A) which satisfies the Leq - 55.0 dB(A) maximum allowable noise level set forth in the Planned Community Development Criteria. Nighttime noise levels from the loading dock area were Leq -45.4 dB(A) when measured near the residences west of the acoustical barrier which satisfies the Leq -55 maximum allowable noise levels of the Planned Community Development Criteria. Dietary Loading Dock Daytime noise levels measured near the Dietary loading dock were Leq- 62.1 dB(A) and nighttime levels were found to be L q- 52.0 dB(A) which satisfies the Leq -65 maximum allowable daytime noise levels and the Leq -55 maximum allowable nighttime levels set forth in the Planned Community Development Criteria. Cogeneration Facility Daytime noise measurements of the cogeneration facility produced results of Leq - 52.7 dB(A) at 4' elevation and Leq - 56.7 dB(A) at 20' elevation. The ordinance requires that the cogeneration equipment not exceed Leq - 55.0 dB(A) for Zone I occupancy and Leq - 60.0 dB(A) for Zone III — Mixed Use occupancy. The daytime ambient noise is generated from offsite traffic levels with the cogeneration facility generally inaudible. Nighttime noise levels nearest the residences adjacent to the cogeneration facility were Laq - 47.2 dB(A) at 5' elevation and Leq - 48.5 dB(A) at 20' elevation which satisfies the Leq - 50 dB(A) maximum allowed by the City of Newport Beach ordinance. Previous measurements conducted by RSA resulted in cogeneration facility noise levels of Leq - 45.3 dB(A) at 5' elevation and Leq - 49.5 dB(A) at 20' elevation for all four (4) cooling towers operating. These measurements show that all four cooling towers operating also satisfy the L q - 50 dB(A) maximum allowable levels allowed by the City of Newport Beach. 200 Paris Lane Noise measurements at the north side of 200 Paris Lane within the Villa Balboa complex were generated by sources within the complex and offsite traffic. As we discussed in our meeting last week in your office, Hoag will install the improvements to the trash compactor and baler as required by this Mitigation Measure except for the relocation of the trash compactor.
