RESCINDING RESOLUTION NO. 2009 -5 AND A CHANGE TO STREET
SWEEPING RESTRICTIONS ON VISTA DEL ORO AND MAR VISTA
ISSUE
Staff requests adoption of a Resolution establishing "No Parking" Restrictions on
designated streets on specific days and times to improve street sweeping effectiveness
and rescinding Resolution No. 2009 -5.
RECOMMENDATION
1. Rescind Resolution 2009 -5.
2. Adopt a Resolution establishing "NO PARKING" restrictions on designated
streets on specific days and times to improve street sweeping effectiveness for
street sweeping throughout the City including revisions to add the north side of
26th Street from Newport Boulevard to the east street end and to revise "NO
PARKING' restrictions on the full length of Vista Del Oro and Mar Vista Drive.
DISCUSSION
Staff has determined that a section along the north side of 26th Street from Newport
Boulevard to the east street end is not in the current Council Resolution establishing
"No Parking" restrictions to facilitate street sweeping. To effectively operate street
sweeping along this section of 26th Street, staff recommends restricting parking on
Tuesdays from 8:30 a.m. to 12:30 p.m. As shown in Exhibit A, the proposed no parking
restrictions are for the public parking along the north side of 26th Street only.
In addition, General Services has requested to revise the street sweeping schedule
along Vista Del Oro and Mar Vista Drive from Thursday to Fridays. In accordance with

this change, the revised street sweeping parking restrictions are proposed to be Friday
from 9:30 a.m. to 12:30 p.m. for the entire length of Vista Del Oro and Mar Vista Drive,
as shown in Exhibit B.
Upon Council approval of this Resolution, General Services will post appropriate signs
reflecting the street sweeping parking restrictions. Once the signs are in place, the
Police Department will enforce the area as posted.
ENVIRONMENTAL REVIEW
Staff determined that the project is exempt from the California Environmental Quality
Act (CEQA) pursuant to Section 15378 of the Guidelines. The action is not considered
to be a project as defined by CEQA.
PUBLIC NOTICE
With the street sweeping contracted out, General Services will be managing the street
sweeping operation and will coordinate the public notification efforts.
FUNDING AVAILABILITY
Additional funding for this project will not be needed. The cost to install the signs is
minimal.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ESTABLISHING "NO PARKING'
RESTRICTIONS ON DESIGNATED STREETS ON SPECIFIC
DAYS AND TIMES TO IMPROVE STREET SWEEPING
EFFECTIVENESS AND RESCINDING RESOLUTION NO. 2009 -5
WHEREAS, Section 12.44.150 of the Newport Beach Municipal Code provides
that the City Council shall by Resolution designate streets or portions of streets on which
the parking or standing of vehicles is to be prohibited. The City Council shall designate in
the Resolution the days of the week and the exact hours during which such prohibition
shall be in effect; and
WHEREAS, the City Council has determined that it is reasonable and in the public
interest to prohibit parking of vehicles at certain times and in certain areas of the City in
order to effectively operate the City street sweeping program;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport
Beach that parking of vehicles shall be prohibited between the hours of 8:30 A.M. to
12:30 P.M. on the following days and in the following areas:
