Meek Co.CITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 9 May 12, 2009 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Public Works Department Frank Tran, Project Engineer 949 - 644 -3340 orftran @city.newport- beach.ca.us SUBJECT: RIVO ALTO COPING REPLACEMENT; FINLEY AVENUE AT 36TH STREET BULKHEAD REPAIR; 26TH STREET TIDE GATE STRUCTURE AND BULKHEAD IMPROVEMENTS; AND VIA LIDO WALL REPLACEMENT - COMPLETION AND ACCEPTANCE OF CONTRACT NO. 3657 Recommendations: 1. Accept the completed work. 2. Authorize the City Clerk to file a Notice of Completion. 3. Authorize the City Clerk to release the Labor and Materials bond 35 days after the Notice of Completion has been recorded in accordance with applicable portions of the Civil Code. 4. Release the Faithful Performance Bond 1 year after Council acceptance. Discussion: On September 11, 2007, the City Council authorized the award of the subject contract to John S. Meek Co., Inc., (MEEK). Under this contract, MEEK constructed four projects: 1. Rivo Alto Coping Replacement: This project included removing and reconstructing a concrete coping and fence atop the bulkhead located at the east end of the Rivo Alto Channel. 2. Finley Avenue at 36th Street Bulkhead Repair: This project consisted of repairing bulkheads at the Finley Avenue street end at 36th Street. 3. 26th Street Tide Gate Structure and Bulkhead Improvements: This project included removing and reconstructing a concrete bulkhead, coping, tie rods and anchor blocks; and constructing an electrically- operated tide gate drainage structure. Via Lido Wall Replacement: This design -build project consisted of removing the crib wall adjacent to Via Lido at the approach to the Lido Isle bridge, and designing and constructing a segmental retaining wall (SRW). The contract has now been completed to the satisfaction of the Public Works Department. The contract construction costs were: Original bid amount: $836,000.00 Actual amount of bid items constructed: $836,000.00 Total amount of change orders: $17,649.80 Amount of credit for constructing a SRW: ($42.575.00) Final contract cost: $811,074.80 The City received a credit for $42,575 for constructing a segmental retaining wall rather than a mechanically stabilized earth wall as bid. Change orders were approved for costs associated with the construction delay of 26th Street Tide Gate (see the following paragraph for the explanation), an upgrade to a stainless steel ladder for the tide gate box, and disposal of an asbestos pipe. The final contract cost (including change orders and credit) was three percent below ( -3 %) the original bid amount. A summary of the project schedule is as follows: Estimated completion date per June'07 schedule: July 01, 2008 Project award for construction: September 11, 2007 Estimated completion date at award: July 21, 2008 Actual substantial construction completion date: February 20, 2009 The project generally went according to the planned schedule; however, staff intentionally delayed the last component of the project to accommodate the request of the "Balboa Boat Yard" owner on 261h Street End. The owner requested to have the work at 26th Street End started after Summer 2008 due to his busy business operation during the summer. MEEK has worked very well with the adjacent residents and businesses, and the project's finished products pleased the residents and businesses. Environmental Review: This project is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the CEQA Implementing Guidelines. This exemption covers the maintenance and alteration of existing public facilities with negligible expansion of the facilities. Prior to starting work, two City- prepared construction informational notices were distributed by the contractor to residents within the Work vicinity. The first notice was distributed ten days prior to the scheduled work. The second notice was distributed 48 hours before the work commenced. Total Project Cost In addition to the primary construction contract, this project involved other project expenses.
