TITLE: Accept a Check in the Amount of $175,000 from the Newport Beach Arts Foundation
to Support Arts Programming in the City
ABSTRACT:
In May 2015, the Balboa Performing Arts Theater Foundation distributed their remaining assets, $175,000,
to the Newport Beach Arts Foundation with the stipulation that the money be used for Performing Arts in
the City of Newport Beach as requested through the Newport Beach Arts Commission with preference to
the Balboa Village.
RECOMMENDATION:
Approve Budget Amendment No. 15BA -052 to increase revenue estimates by $175,000 in account 4002-
5901 (Arts- Private Donations). The funds will be appropriated by budget amendment starting in the 2015-
2016 fiscal year.
FUNDING REQUIREMENTS:
The Budget Amendment records $ 175,000.00 in additional revenues from a donation made by the
Newport Beach Arts Foundation and will be available for appropriations beginning in the 2015 -2016 fiscal
year. The revenue will be posted to the 4002 -5901 account, (Arts- Private Donations).
DISCUSSION:
In April 2015, the Balboa Performing Arts Theatre Foundation was dissolved and the remaining assets of
$175,000 were distributed to the Newport Beach Arts Foundation to be used for Performing Arts in the City
of Newport Beach as requested through the Newport Beach Arts Commission with preference to the
Balboa Village. The Newport Beach Arts Foundation is turning these funds over to the City of Newport
Beach for performing arts programming beginning in fiscal year 2015 -2016.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California Environmental Quality Act
( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable

indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in
Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item).
