HomeMy WebLinkAbout26 - Initiation of General Plan AmendmentCITY OF NEWPORT BEACH CITY COUNCIL STAFF REPORT Agenda Item No. 26 July 14, 2009 TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL FROM: Planning Department James Campbell, Principal Planner (949) 644 -3210 iampbell (c�city.newport- beach.ca.us SUBJECT: Initiation of General Plan Amendment related to Coastal Land Use Plan Amendment No. 2007 -001 ISSUE Should the City Council initiate an amendment of the General Plan to change the land use designations of properties within 11 areas of the City within the coastal zone in response to the Coastal Commission's modification of Coastal Land Use Plan Amendment No. 2007 -001? RECOMMENDATION Adopt a Resolution initiating an amendment of the General Plan to change the land use designations of properties within 11 areas of the Coastal Zone. DISCUSSION On February 5, 2009, the California Coastal Commission approved the City's amendment of the Coastal Land Use Plan (LC2007 -001) while making 50 suggested modifications. Eleven (11) of the modifications reject the proposed land use categories for 11 geographic areas that were a part of the 2006 General Plan Update. Should the City Council choose to accept these changes, the land use designations within the Land Use Element of the General Plan will need to be modified so the Coastal Land Use Plan and the Land Use Element are consistent. Appropriate environmental analysis for the amendment, as well as an analysis of the application of Charter section 423 to the proposed amendment, will be prepared prior to public hearings before the Planning Commission and City Council. Public Notice Public notice is not required for initiation of General Plan amendments. Notice will be provided in compliance with State law and the Municipal Code for public hearings on the amendment before the Planning Commission and City Council. Submitted by: J� James Campbell Principal Planner Attachment: Resolution j4nt�)Allk Sharon Wood Assistant City Manager RESOLUTION NO. 2009- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH INITIATING AN AMENDMENT TO THE GENERAL PLAN LAND USE ELEMENT CHANGING THE LAND USE DESIGNATIONS OF PROPERTIES LOCATED WITHIN ELEVEN (11) DIFFERENT AREAS WITHIN THE COASTAL ZONE IN RESPONSE TO THE CALIFORNIA COASTAL COMMISSIONS MODIFICATION OF LOCAL COASTAL LAND USE PLAN AMENDMENT NO. LC2007 -001. WHEREAS, on November 13, 2007, The City Council adopted LC2007 -001 amending the City's Coastal Land Use Plan making it consistent with the 2006 General Plan Update; and WHEREAS, on February 5, 2009, the Coastal Commission certified the Coastal Land Use Plan amendment with the modifications to meet the requirements of, and to be in conformity with, the policies of Chapter 3 of the Coastal Act; and WHEREAS, in Eleven (11) areas of the City, the Coastal Commission's modifications necessitate a change in the General Plan Designation to avoid ambiguity or inconsistency between the Coastal Land Use Plan and the Land Use Element of the General Plan; and WHEREAS, City Council Policy K -1 General Plan provides that City - sponsored amendments to the General Plan shall be initiated by the City Council. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach hereby initiates an amendment to the Land Use Element of the General Plan to change the land use designation of eleven (11) areas of the City within the Coastal Zone identified in Exhibit 1. BE IT FURTHER RESOLVED that the City Council directs the Planning Commission and City Council to hold public hearings on the General Plan amendment, and the Planning Department to prepare environmental review and staff reports that contain relevant information pursuant to Charter Section 423.
