SUBJECT: Unscheduled Vacancy on the Building and Fire Board of Appeals
RECOMMENDATION:
Declare a vacancy on the Building and Fire Board of Appeals due to the
resignation of Paul Root effective July 30, 2009.
Confirm the Mayor's appointment of I I , and
to serve on the Ad -Hoc Appointments Committee.
Direct the City Clerk to post and publish a Special Vacancy Notice requesting
that applications be submitted by 4:00 p.m. on Thursday, August 27, 2009, and
schedule the submission of the nominations to the Council on September 8, 2009
with the final appointment to be made on September 22, 2009.
DISCUSSION:
On January 30, 2009, the City Clerk received a notice of resignation relative to Paul
Root from the Building and Fire Board of Appeals effective immediately. Members of
the Building and Fire Board of Appeals serve indefinite terms.
Pursuant to Council Policy A -2, I have prepared a Special Vacancy Notice for posting
and publication of the unscheduled vacancy. As per the notice, applications will be
accepted by the City Clerk's Office until 4:00 p.m. on Thursday, August 27, 2009. At the
close of the application period, I will forward the applications to the newly appointed ad-
hoc appointments committee for them to review and conduct any necessary interviews.
The two nominations made by the committee will be forwarded to the full Council for
confirmation on Tuesday, September 8, 2009, with the final appointment scheduled for
Tuesday, September 22, 2009.

Jay,
Mrs. Root called me today and she told me that her husband, Mr. Root, one of our board
members, has Altzheimers and he doesn't feel up to being a board member anymore.
Therefore, he is resigning.
Mrs. Root said he is not too bad, just the short term memory is going. But otherwise he is in
good spirits she said. I told her I'm very sorry and that he was a very nice board member to
work with, and we'll miss him.
How are we going about getting a new board member?
And I thought we should perhaps do something to honor his many years as board member, like
a plague /award, etc.? What do you think?

BUILDING AND FIRE BOARD OF APPEALS
AUTHORIZATION: Established by Uniform Building Code, Vol. 1, Chapter 2,
amended by Ordinance No. 82 -22, adopted October 12,1982;
and responsibilities amended by Resolution No. 86-84 on
September 22, 1986; amended by Ordinance No. 97- 31 on
August 11, 1997; amended by Ordinance No. 2006 -11 on
May 9, 2006.
MEMBERSHIP: Citizens (7) Two of whom shall be physically disabled as
defined by the State of California Disabled Access
Standards repeated herein below.
TERM: Indefinite
PURPOSE &
RESPONSIBILITIES: A. Determine the suitability of alternate materials and
methods of construction;
B. Provide for reasonable interpretations of the
provisions of the Building and Fire Codes;
C. To ratify the Building Official's findings and
determinations regarding disabled access matters and
to hear written appeals brought by any person
regarding the Building Official's or the Fire Marshal's
orders, decisions or determinations;
D. Five (5) members of the Building and Fire Board of
Appeals shall act as the Rehabilitation Commission
and conduct hearings on abatement of substandard
buildings in accordance with Chapter 15.28 of the
Newport Beach Municipal Code. The Secretary to the
Building and Fire Board of Appeals shall select the
five (5) Rehabilitation Commissioners from the seven
(7) members of the Building and Fire Board of
Appeals on a rotating basis.

following unscheduled vacancy (one seat):
Building and Fire Board of Appeals (indefinite term)
Knowledge of Building, Fire, and Life Safety Codes is highly desirable.
The deadline for filing applications is 4:00 p.m. on Thursday. August 27.
