Adopt Resolution No. 2009 - limiting the parking of vehicles on certain streets to two hours and rescinding Resolution No. 2001 -88. 2, Introduce Ordinance No. 2009 - approving revisions to the Preferential Parking Zone "2" — Newport Heights and Cliff Haven and pass to second reading on September 22, 2009. DISCUSSION: Staff received a request from the resident at 400 Snug Harbor Road to delete the two - hour parking limitation adjacent to her home and to remove her home from the Zone 2 permit zone. The City Council is authorized to amend parking regulations pursuant to Newport Beach Municipal Code Section 12.44.010(C) when special parking or traffic conditions are found to exist. A number of streets in the Cliff Haven area have two -hour parking limits from 8:00 a.m. to 2:00 p.m. on Monday through Friday to address the issue of Newport Harbor High School students parking throughout the neighborhood. An extensive survey of the neighborhood was conducted prior to establishing the limits of the two -hour parking zone. The current resident at 400 Snug Harbor Road stated that high school students are not impacting the parking situation adjacent to her home, and the parking limit is causing a hardship. Staff recommends revision to the existing Zone 2 permit area and related parking restrictions to remove 400 Snug Harbor Road from the zone based upon the special parking conditions (i.e., student parking is not affecting the resident at 400 Snug Harbor Road). Existing Resolution No. 2001 -88 designates a two -hour parking limit on Snug Harbor Road from Clay Street southerly to and including 400 on the east side. The residence at 400 Snug Harbor Road is located mid -way between Clay Street and Cliff Drive and the last house in the zone. The proposed Resolution would revise the two -hour parking Revision of Two-Hour Parking Limit on a Portion of Snug Harbor Road September 8, 2009 Page 2 limit on the east side of Snug Harbor Road to read: "from Clay Street southerly to and including 406 on the east side." As part of the parking revisions, staff is also recommending the City Council adopt an ordinance amending the parking regulations provided in Newport Beach Municipal Code Subsection 12.68.060(6)(13) to read: "from Clay Street southerly to and including 406 on the east side." Environmental Review: Staff recommends the City Council find that the Ordinance accompanying this staff report is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(cX3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. The parking of vehicles between the hours of 8:00 a.m. and 6:00 p.m., except Saturday, Sunday, and holidays, is limited to two (2) hours on the following streets: 16th Street Babcock Street to Placentia Avenue, except the easterly 220 feet: on the south side. -3- Bayview Way From Jamboree Road to the easterly terminus of Bayview Way. 5. The parking of vehicles between the hours of 8:00 a.m. and 1:00 p.m., except Saturday, Sunday, and holidays, is limited to two (2) hours on the following streets: Buckingham Lane Easterly side from Westcliff Drive to Bedford Lane. Riverside Avenue Northwest side from a point beginning 418 feet from the centerline of Riverside Avenue at Cliff Drive and ending 563 feet from that centerline. 6. The parking of vehicles between the hours of 8:00 a.m. and 6:00 p.m., Monday through Thursday, except holidays, is limited to two (2) hours on the following street: Clubhouse Avenue Short Street to the Rialto. 7. The parking of vehicles between the hours of 8:00 a.m. and 6:00 p.m., Tuesday through Thursday, except holidays, is limited to two (2) hours on the following streets: Clubhouse Avenue Short Street to the Rivo Alto. Short Street Newport Boulevard to Clubhouse Avenue. 8. The parking of vehicles between the hours of 8:00 a.m. and 5:00 p.m. on weekdays is limited to two (2) hours on the following streets: Tustin Avenue Avon Street to 300 feet northerly of Avon Street. RESOLUTION NO. 2009- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH LIMITING THE PARKING OF VEHICLES ON CERTAIN STREETS AND RESCINDING RESOLUTION NUMBER 2001 -88 WHEREAS, Newport Beach Municipal Code Section 12.44.010(B) provides that when authorized signs are in place giving notice thereof, no person shall stop, stand, or park any vehicle between the hours of 8:00 a.m. and 6:00 p.m. of any day for a period of time longer than two (2) hours upon such streets or portions thereof as the City Council shall designate by resolution; and WHEREAS, Newport Beach Municipal Code Section 12.44.010(C) authorizes the City Council to vary the hours or days of parking restrictions when special parking or traffic conditions exist; and WHEREAS, pursuant to the authority found in Sections 12.44.010(6) and (C) the City Council adopted Resolution No. 2001 -88 establishing a comprehensive set of parking regulations within the City; and WHEREAS, the City Council now desires to repeal Resolution No. 2001 -88 and amend the parking regulations based upon the special parking and traffic conditions that currently exist within the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach as follows: 1.. ADOPTED, this day of 2009 ATTEST: Leilani Brown, City Clerk Edward Selich Mayor of the City of Newport Beach -5- ORDINANCE NO. 2009- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH AMENDING SUBSECTION 12.68.060(B)(13) OF THE NEWPORT BEACH MUNICIPAL CODE REGARDING THE RESIDENTIAL PARKING PERMIT PROGRAM FOR PORTIONS OF NEWPORT HEIGHTS AND CLIFF HAVEN The City Council of the City of Newport Beach does hereby ordain that certain Newport Beach Municipal Code section is amended to read as follows: SECTION 1: Subsection 12.68.060(B)(13) of Chapter 12.68 is amended to read as follows: "13. Snug Harbor Road From Clay Street southerly to and including 406 on the east side and 401 on the west side of Snug Harbor Road." SECTION 2: If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. SECTION 3: The City Council finds that this Ordinance is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. SECTION 4: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance.
