The applicant requests a waiver of three parking spaces. The parking study submitted with this application lacked sufficient detail on utilization of on- street and off - street public parking on which to base a recommendation. Staff recommended a continuation to allow the parking consultant time to revise the parking study. This item was continued to 12/3/2009 at commissioner's request. (All Ayes) Item No. 3 Moriarty Residence (PA2008 -207) 2128 Mesa Drive Summary: An appeal by the applicant, Richard Moriarty, of the Zoning Administrator approval of a parcel map to consolidate existing portions of lots and parcels into a single parcel of land for single - family development. The applicant requests relief from conditions of approval relating to Coastal Commission approval and the ingress/egress access easement. The applicant requested an additional continuation with the expectation that all parties involved in negotiations related to the access easement would soon reach an agreement. Although Planning Commissioners were initially reluctant to grant another continuance, after testimony from the applicant's representatives and from the City's Public Works staff as to significant progress in the negotiations, and after reviewing terms of the tentative agreement, they agreed to the continuance. CEQA COMPLIANCE: The project is categorically exempt under Section 15301, of the California Environmental Quality Act (CEQA) Guidelines - Class 1 (Existing Facilities). ACTION: Staff recommends continuing this item to December 3, 2009. ITEM NO. 3 Moriarty Residence 2128 Mesa Drive SUMMARY: An appeal by the applicant, Richard Moriarty, of the Zoning Administrator approval of a parcel map to consolidate existing portions of lots and parcels into a single parcel of land for single - family development. The applicant requests relief from conditions of approval relating to Coastal Commission approval and the ingress /egress access easement. CEQA COMPLIANCE: The project is categorically exempt under Section 15315, California Environmental Quality Act (CEQA) Guidelines - Class 15 (Minor Land Divisions). ACTION: 1) Conduct a de novo hearing; and 2) Adopt Resolution denying the appeal and upholding and affirming the decision of the Zoning Administrator and approving Parcel Map No. NP2008- 024, subject to the findings and conditions of approval included within the attached draft resolution (Attachment No. PC1).
