Item No.2 Gina's Pizza Minor Use Permit (PA2011 -006)

Summary: A minor use permit to allow a food service, eating and drinking establishment
with no late hours, an outdoor dining area. and a Type 41 (On Sale Beer and
Wine, Eating Place) Alcoholic Beverage Control (ABC) license.
Commission discussion and public testimony focused on the potential noise
impacts to neighboring residential properties from the outdoor dining area To
comply with the noise ordinance standards, the proposed plans included an
acoustical engineer recommended noise walitharrier designed to mitigate
potential noise impacts to a level compliant with the municipal code. The
Commission approved the application as recommended but, included a condition
allowing a re- design of the noise wall, subject to staff approval, as long as the
design results in compliance with the noise ordinance. Additionally, the
Commission approval limits the hours of outdoor dining to 9:00 p.m. Suncay-
Thursday and 10:00 p.m. Friday - Saturday. The indoor dining room is allowed to
remain open until 11:00 p.m. daily. A condition prohibiting smoking on the
outdoor dining area was aiso included.

CEQA
COMPLIANCE: The project is categorically exempt under Section 15303, of the California
Environmental Quality Act (CEQA) Guidelines - Class 3 (New Construction or
Conversion of Small Structures). The Class 3 exemption includes a store, motel,
office, restaurant, or similar structure not involving significant amounts of hazardous
substances, and not exceeding 2,500 square feet in floor area.
ACTION: 1) Conduct public hearing; and
2) Adopt Resolution No. _ approving Minor Use Permit No. UP2011 -002
subject to the findings and conditions in the attached Draft Resolution.
